PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular prescribes the occupational code, job title standards, appointment, and grading according to the job title for public primary school teachers in state-run general education institutions, continuing education institutions, and special education institutions that have primary education levels (hereinafter referred to collectively as public primary schools).

2. This Circular applies to public primary school teachers in state-run general education institutions.

Article 2. Occupational Code and Job Title Classification for Public Primary School Teachers in public elementary schools

The job titles for public primary school teachers in state-run general education institutions include:

1. Primary School Teacher Grade II - Code: V.07.03.07

2. Primary School Teacher Grade III - Code: V.07.03.08

3. Primary School Teacher Grade IV - Code: V.07.03.09

Article 3. General Standards on Professional Ethics for Public Primary School Teachers2. To love, treat students fairly and respect their personalities; protect their legitimate rights and interests; unite and help colleagues.

Point 1. To be conscious of cultivating ethics, to demonstrate high sense of responsibility, to maintain personal integrity, honor, and reputation as a teacher; to set a good example for students.

STANDARDS FOR THE OCCUPATIONAL TITLE OF PUBLIC PRIMARY SCHOOL TEACHERS

Point 3. Other ethical standards for teachers as prescribed in the Education Law and the Civil Servant Law.

Chapter II

STANDARDS FOR THE PROFESSIONAL TITLE OF ELEMENTARY SCHOOL TEACHER

Article 4. Primary School Teacher Grade II - Code V.07.03.07

1. Tasks

In addition to the duties of Primary School Teacher Grade III, Primary School Teacher Grade II must also perform the following duties:

a) Participate in editing, compiling, and developing training programs and materials for primary school teachers and students;

b) Lead school activities for teacher development and specialized topics, or participate in evaluating and reviewing colleagues' innovative experiences and applied educational research topics at the district level or higher;

c) Participate in professional inspections of primary school teachers at the district level or higher;

d) Participate in the judging panel for primary school teaching excellence competitions or class teacher excellence competitions or excellent team leaders at the district level or higher;

đ) Participate in organizing and evaluating student competitions at the district level or higher.

2. Qualification requirements for education and training

a) Hold a bachelor's degree in primary education or a relevant field from a pedagogical university or higher;

b) Have a foreign language proficiency level of Level 2 as prescribed in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 of the Ministry of Education and Training promulgating the Foreign Language Proficiency Framework for Vietnam or hold a certificate in ethnic languages for positions requiring the use of ethnic languages;

For foreign language teachers, the second foreign language proficiency level must reach Level 2 as prescribed in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 of the Ministry of Education and Training promulgating the Foreign Language Proficiency Framework for Vietnam;

c) Have basic information technology skills as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications stipulating the Information Technology Skill Standards;

d) Hold a certificate for training primary school teachers Grade II.

3. Professional Qualification Standards

a) Proactively promote and mobilize colleagues to implement Party and State policies, laws, and regulations and requirements of the education sector and locality regarding primary education;

b) Guide colleagues in implementing primary education programs and plans;

c) Creatively apply and evaluate the application of knowledge about education and age psychology in the practical education of primary school students by colleagues;

d) Actively and proactively coordinate with colleagues, parents of students, and the community to improve the effectiveness of primary school student education;

đ) Actively apply and have the ability to disseminate innovative experiences or applied educational research products at the district level or higher;

e) Be recognized as a grassroots labor model or excellent primary school teacher or excellent class teacher or excellent team leader at the district level or higher;

g) A civil servant promoted from the position of Primary School Teacher Grade III to Primary School Teacher Grade II must have held the position of Primary School Teacher Grade III or equivalent for at least six years, including at least one year in the position of Primary School Teacher Grade III and having graduated from a pedagogical university before the promotion examination or assessment for at least one year.

Article 5. Primary School Teacher Grade III III - Code V.07.03.08

1. Tasks

In addition to the duties of a primary school teacher grade IV, a primary school teacher grade III must also perform the following duties:

a) Serve as a lecturer or demonstrate teaching at primary school teacher training classes or trial new models and methods;

b) Guide student teachers in practical pedagogical training;

c) Lead content for teacher training and specialized subject activities within departments; write innovative experiences; participate in evaluating and reviewing innovative experiences and applied educational scientific research topics of colleagues at the school level or higher;

d) Participate in professional inspection work for primary school teachers from the school level or higher;

đ) Participate in the jury for excellent primary school teacher competitions, excellent class advisors, and excellent team leaders;

e) Participate in organizing and evaluating primary school student competitions from the school level or higher.

2. Qualification requirements for education and training

a) Hold a college degree in primary education or a relevant college degree in a suitable specialty for the taught subjects;

b) Possess a foreign language proficiency level of 2 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam, or possess a certificate in ethnic languages for positions requiring the use of ethnic languages;

For foreign language teachers, the second foreign language proficiency level must reach level 2 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam;

c) Have basic information technology skills as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications stipulating the Information Technology Skill Standards;

d) Hold a certificate for primary school teacher grade III training;

3. Professional Qualification Standards

a) Master the Party's policies, guidelines, laws, regulations, and requirements of the industry and locality regarding primary education;

b) Effectively implement primary education plans and programs;

c) Flexibly apply and guide colleagues to apply knowledge about education and age-specific psychology into practical primary education;

d) Actively cooperate with colleagues, parents of students, and the community to enhance the effectiveness of primary education;

đ) Regularly apply and have the ability to evaluate or guide colleagues to create innovative experiences or applied educational scientific research products at the school level or higher;

e) Be recognized as a grassroots labor model or excellent primary school teacher or excellent class advisor or excellent team leader at the school level or higher;

g) A staff member who is promoted from the title of primary school teacher grade IV to the title of primary school teacher grade III must have held the title of primary school teacher grade IV or equivalent for at least three years, including at least one year holding the title of primary school teacher grade IV and having graduated from a college of education for at least one year before applying for or being considered for promotion;

Article 6. Primary School Teacher Grade IV - Code V.07.03.09

1. Tasks

a) Teach and educate students according to the primary education program and teaching plan;

b) Participate in identifying and nurturing gifted students and remedying weak students at the primary level;

c) Apply innovative experiences and results of applied educational scientific research into practical teaching and education, and make teaching aids and equipment for primary schools;

d) Implement reforms in teaching methods, classroom organization, teaching activities, and assessment of learning outcomes towards promoting students' initiative, positivity, and self-study skills;

đ) Complete training programs; engage in self-study and professional development; participate in professional activities; participate in universalizing primary education and eliminating illiteracy;

e) Coordinate with the Ho Chi Minh Communist Youth Union, parents of students, and related organizations to organize and guide educational activities, and participate in counseling primary school students;

g) Organize creative experience activities and competitions for primary school students;

h) Adhere to assigned tasks, inspections, and evaluations by educational management levels;

i) Perform other tasks assigned by the principal.

2. Qualification requirements for education and training

a) Hold a secondary degree in primary education or a relevant secondary degree in a suitable specialty for the taught subjects;

b) Possess a foreign language proficiency level of 1 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam, or possess a certificate in ethnic languages for positions requiring the use of ethnic languages;

For foreign language teachers, the second foreign language proficiency level must reach level 1 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam;

c) Possess basic information technology skills as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 issued by the Ministry of Information and Communications on Basic Information Technology Skills Standards;

3. Professional Qualification Standards

a) Understand the Party's policies, guidelines, laws, regulations, and requirements of the industry and locality regarding primary education;

b) Implement primary education plans and programs;

c) Apply knowledge about education and age-specific psychology into practical primary education;

d) Know how to coordinate with colleagues, parents of students, and the community to improve the effectiveness of primary education;

đ) Apply reforms in teaching methods, classroom organization, and teaching activities at primary schools;

e) Know how to write innovative experiences or applied educational scientific research; know how to apply innovative experiences and results of applied educational scientific research into practical teaching and education of primary school students.

Chapter III

GUIDELINES FOR APPOINTMENT AND SALARY GRADING TEACHER OCCUPATIONAL TITLES

Article 7. Principles for appointment and salary classification according to occupational titles for civil servants1. The appointment to occupational titles for civil servants as stipulated in this Circular must be based on the job positions, responsibilities, and professional qualifications currently held by the civil servant, in accordance with Article 8 of this Circular.

2. When appointing from the current civil service rank to the corresponding primary school teacher occupational title, it shall not be combined with an increase in salary grade or promotion in the civil servant's occupational title.

Civil servants who have been appointed to the primary school teacher ranks specified in Decision No. 202/TCCP-VC dated June 8, 1994, of the Minister, Head of the Organizational-Cadre Department of the Government regarding the issuance of vocational standards for certain ranks of civil servants in the education and training sector (hereinafter referred to as Decision No. 202/TCCP-VC); Decision No. 61/2005/QĐ-BNV dated June 15, 2005, of the Minister of Home Affairs regarding the temporary issuance of occupational titles and rank codes for some ranks of civil servants in the education and training, culture-information sectors (hereinafter referred to as Decision No. 61/2005/QĐ-BNV), now being appointed to the primary school teacher occupational title as stipulated in this Circular, shall be as follows:

Article 8. Cases for Appointment to Professional Titles

1. Appointment to the primary school teacher occupational title Grade II (code V.07.03.07) for civil servants currently holding the primary school teacher senior rank (code 15a.203);

2. Appointment to the primary school teacher occupational title Grade III (code V.07.03.08) for civil servants currently holding the primary school teacher principal rank (code 15a.204);

3. Appointment to the primary school teacher occupational title Grade IV (code V.07.03.09) for civil servants currently holding the primary school teacher rank (code 15.114).

1. The primary school teacher occupational titles stipulated in this Circular shall apply the Professional and Vocational Salary Scale for State Public Service Staff (Table 3) issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004, of the Government on the wage system for cadres, civil servants, public officials, and armed forces personnel (hereinafter referred to as Decree No. 204/2004/NĐ-CP), as follows:

Article 9. Salary Grading Method

a) The primary school teacher occupational title Grade II shall apply the civil servant salary coefficient type A1 (from coefficient 2.34 to coefficient 4.98);

b) The primary school teacher occupational title Grade III shall apply the civil servant salary coefficient type A0 (from coefficient 2.10 to coefficient 4.89);

c) The primary school teacher occupational title Grade IV shall apply the civil servant salary coefficient type B (from coefficient 1.86 to coefficient 4.06).

2. The salary classification into the civil servant occupational title stipulated in Clause 1 of this Article for civil servants who have been classified into the primary school teacher rank according to the provisions of Decision No. 202/TCCP-VC; Decision No. 61/2005/QĐ-BNV; Decree No. 204/2004/NĐ-CP; Clause 4 Item II Joint Circular No. 81/2005/TTLT-BNV-BTC dated August 10, 2005, of the Ministry of Home Affairs and the Ministry of Finance guiding the implementation of the transition from old salary classification to new salary for some newly added or changed civil servant and public official ranks in the water resources, education and training, culture-information, health, and market management sectors shall be carried out as follows:

Civil servants appointed to the primary school teacher occupational title with the same salary grade coefficient as in the old rank shall be classified at the same grade and percentage (%) of seniority allowance exceeding the ceiling (if any) currently enjoyed in the old rank (including the time for the next grade increase review or seniority allowance exceeding the ceiling if any in the old rank) into the newly appointed occupational title.

Example: Ms. Nguyen Thi C has been classified into the primary school teacher rank (code 15.114), grade 4, salary coefficient 2.46 since February 1, 2013. Now she is appointed by the competent authority to the primary school teacher occupational title Grade IV (code V.07.03.09), then she will be classified at grade 4, salary coefficient 2.46 of the primary school teacher occupational title Grade IV from the date of signing the decision; the time for the next grade increase review will be calculated from February 1, 2013.

3. Promotion in rank for primary school teacher civil servants shall be implemented after being appointed by the competent authority to the primary school teacher occupational title stipulated in this Circular and implementing salary classification according to the guidance in Clause 1 Item II Circular No. 02/2007/TT-BNV dated May 25, 2007, of the Ministry of Home Affairs guiding salary classification when upgrading, transferring ranks, or changing types of cadres and public officials.

1. This Circular takes effect from November 3, 2015.

Chapter IV

IMPLEMENTING PROVISIONS

Article 10. Effective Date

2. Abolish the vocational standards for the civil servant rank of primary school teachers in the education and training sector as stipulated in Decision No. 202/TCCP-VC dated June 8, 1994, of the Minister, Head of the Organizational-Cadre Department of the Government regarding the issuance of vocational standards for certain ranks of civil servants in the education and training sector.

3. Abolish the regulations on occupational titles and rank codes for primary school teacher civil servants at Decision No. 61/2005/QĐ-BNV dated June 15, 2005, of the Minister of Home Affairs regarding the temporary issuance of occupational titles and rank codes for some ranks of civil servants in the education and training, culture-information sectors.

4. Abolish the regulations on the list of primary school teacher civil servant ranks in the List of Civil Servant Ranks and Civil Servant Ranks issued together with Decision No. 78/2004/QĐ-BNV dated November 3, 2004, of the Minister of Home Affairs.

1. Civil servants who have been appointed to the primary school teacher ranks according to the provisions of Decision No. 202/TCCP-VC; Decision No. 61/2005/QĐ-BNV, now being appointed to the primary school teacher occupational title as stipulated in this Circular, the competent authority managing and using civil servants shall be responsible for creating conditions for civil servants to supplement the missing criteria of the appointed primary school teacher occupational title.

Article 11. Application Provisions

1. Civil servants who have been appointed to the ranks of elementary school teacher in accordance with Decision No. 202/TCCP-VC; Decision No. 61/2005/QĐ-BNV, now being appointed to the professional title of elementary school teacher as prescribed in this Joint Circular shall be provided by the competent authority managing and using the civil servant with conditions to enable the civil servant to meet the remaining standards of the professional title of elementary school teacher to which they are appointed.

2. Civil servants who have been appointed to the primary school teacher rank without meeting the standard (code 15c.209) as stipulated in Decision No. 61/2005/QĐ-BNV up to the date this Circular takes effect and do not meet the conditions and criteria for appointment to the primary school teacher profession title grade IV shall be retained and continue to enjoy the benefits and policies at their current rank for no more than five (5) years from the date this Circular takes effect. For primary school teachers currently holding the primary school teacher rank without meeting the standard (without reaching the college level), code 15c.209, up to the date this Circular takes effect, under fifty-five (55) years old for males and under fifty (50) years old for females, the competent authority managing and using civil servants must arrange for them to study to improve their qualifications to meet the criteria for the primary school teacher profession title grade IV. If civil servants meet the criteria and conditions for the primary school teacher profession title grade IV, the unit employing the civil servant shall report to the management unit of the civil servant for consideration and decision on appointment to the primary school teacher profession title grade IV. In case civil servants are assigned to study to improve their qualifications but do not participate in the study or fail to meet the requirements, the employing unit shall report to the management unit of the civil servant for consideration and reassignment to other work or implementation of staff reduction.

Article 12. Implementation Organization

1. This Circular serves as the basis for implementing the recruitment, use, and management of primary school teachers in public primary schools within the national education system.

2. Private primary schools may apply the provisions of this Circular to recruit, use, and manage primary school teachers at their institutions.

3. The heads of public primary schools directly managing and using civil servants shall be responsible for:

a) Reviewing job positions of the unit, developing plans for appointing the primary school teacher profession title in primary schools within their management authority, submitting to the competent authority for examination and decision or deciding according to the delegated authority;

b) Deciding on the appointment of the primary school teacher profession title for teachers under their management to the corresponding primary school teacher profession title in public primary schools according to the authority or delegated authority after the appointment plan has been approved by the competent authority;

4. Ministries, agencies equivalent to ministries, agencies under the Government, People's Committees of provinces and centrally-administered cities are responsible for:

a) Directing subordinate units under their management to implement the appointment of the profession title and salary grading for civil servants who are primary school teachers in public primary schools;

b) Approving plans for the appointment of the profession title and salary grading for civil servants who are primary school teachers in public primary schools under their management from the current civil servant rank to the corresponding primary school teacher profession titles as stipulated in this Circular; resolving issues within their authority during the process of appointing the profession title and salary grading;

c) Deciding on the appointment of the profession title and salary grading for civil servants who are primary school teachers under their management to the corresponding primary school teacher profession titles in public primary schools according to their authority;

d) Reporting the results of the appointment of the profession title and salary grading for civil servants who are primary school teachers in public primary schools under their management to the Ministry of Education and Training and the Ministry of Home Affairs;

Article 13. Responsibility for Implementation

1. The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies; Chairpersons of People's Committees of provinces and centrally-administered cities are responsible for implementing this Circular.

2. Any difficulties encountered during implementation should be reported to the Ministry of Education and Training for consolidation and coordination with the Ministry of Home Affairs for consideration and resolution./.
