CIRCULAR
REGULATIONS ON THE PROVISION AND USE OF TELECOMMUNICATION DATA
Pursuant to the Law on Telecommunications promulgated on November 23Issued on November 23, 2009;
Pursuant to Decree No. 17/2017/NĐ-CP dated February 17, 2017 of the Government stipulating functions, tasks, powers, and organizational structure;defined on land.

At the proposal of the Director of the Telecommunications Department;
This Circular regulates the provision and use of telecommunications data for state management purposes in the telecommunications sector and the responsibilities of relevant agencies, organizations, and individuals. Calling device
Article 1. Scope of Regulation and Applicability
is the telecommunications subscriber number initiating a voice call or data call or sending a message.
Article 2. Interpretation of Terms
In this Circular, the following terms are understood as follows:
1. Provincial People's Committees set specific pricesNo. Called device is the telecommunications subscriber number receiving a voice call or data call or receiving a message.
3. Call duration is the time from the initiation to the termination of a call; the time of sending or receiving a message.
4. Original data is the raw data provided by the telecommunications enterprise or new data after standardization that retains the same scale as the raw data provided by the telecommunications enterprise.
5. Authorized representative is the person authorized in writing by the Director of the Telecommunications Department or the legal representative of the telecommunications enterprise to perform the task of handing over or receiving telecommunications data.
Article 3. Provision of Telecommunications Data Telecommunications enterprises shall be responsible for providing the Telecommunications Department with various types of telecommunications data according to the structure, time, scope, and method of provision as follows:
1. Types of telecommunications data and data structure:
a) Mobile subscriber information as specified in point b, Clause 8, Article 1 of Decree No. 49/2017/NĐ-CP dated April 24, 2017 of the Government amending and supplementing Article 15 of Decree No. 25/2011/NĐ-CP dated April 6, 2011 of the Government detailing and guiding the implementation of certain provisions of the Telecommunications Law and Article 30 of Decree No. 174/2013/NĐ-CP dated November 13, 2013 of the Government stipulating administrative penalties for violations in the postal, telecommunications, information technology, and radio frequency sectors, the structure of mobile subscriber information is specified in Appendix 01 of this Circular;
b) Data on calling devices, called devices, and call duration contained in detailed call records (CDR). These data are original data recorded in the switch system of the telecommunications enterprise and stored by the telecommunications enterprise for 24 months from the date of the request for data provision.
2. Time and scope of data provision:
a) The data specified in point a, Clause 1 of this Article, except for the data specified in Section 2 of Appendix 01 issued together with this Circular, must be provided monthly before the 15th day of the following month, the data provided is the data stored by the telecommunications enterprise up to 24 hours 00 on the last day of the reporting month;
b) The data specified in point a, Clause 1 of this Article, except for the data specified in Section 1 of Appendix 01 issued together with this Circular, do not need to be provided regularly, the telecommunications enterprise only provides when requested in writing by the Telecommunications Department;
c) The data specified in point b, Clause 1 of this Article must be provided upon urgent written request by the Telecommunications Department for specific purposes as stipulated in Clause 1, Article 5 of this Circular.
The request for data provision must clearly specify the purpose of using the data; the scope of data provision (data about one specific subscriber, a group of subscribers, or all subscribers of the enterprise within a defined period); the time required by the enterprise to hand over the data; the authorized representative to receive the data.
3. Method of data provision
a) The data specified in point a, Clause 1 of this Article, except for the data specified in Section 2 of Appendix 01 issued together with this Circular and the data specified in point b, Clause 1 of this Article, shall be provided through a transmission link connecting the telecommunications enterprise to the Telecommunications Department.
In case of technical failures or force majeure with the transmission link, the Telecommunications Department sends a written request for the enterprise to provide data by directly copying it onto the storage device of the Telecommunications Department. The request must clearly specify the time and location of receiving the data, and the authorized representative to receive the data;
b) The data specified in point a, Clause 1 of this Article, except for the data specified in Section 1 of Appendix 01 issued together with this Circular, shall be provided through online access. The telecommunications enterprise provides the interface and login credentials for the Telecommunications Department to access the data from the connection address at the Telecommunications Department.
In case of technical issues or force majeure with the transmission line, the Telecommunications Agency shall send a request document requiring the enterprise to provide data by directly copying it into the storage device of the Telecommunications Agency. The request document must clearly state the time and location for receiving the data, and the authorized representative receiving the data.
b) The data specified in point a, Clause 1 of this Article, excluding the types of data specified in Section 1 of Appendix 01 issued together with this Circular, shall be provided through online access. The telecommunications enterprise shall provide an interface and login account for the Telecommunications Agency to access the data from the connection address at the Telecommunications Agency.
Article 4. Transfer and Acceptance of Telecommunication Data
1. The transfer and acceptance procedures for data shall be carried out at the Telecommunications Administration's office between the authorized representatives transferring the data and those accepting it. The process of transferring and accepting data shall be recorded in a protocol and conducted in accordance with the following steps:
a) The authorized representative transferring the data shall verify the qualifications of the authorized representative accepting the data;
b) Confirm the type of data and the scope of data provision; transfer the data structure for the types of data specified in point b, Clause 1, Article 3 of this Circular;
c) Check the sealing for cases where telecommunication enterprises provide data using mobile storage devices;
d) Carry out the data transfer process;
đ) Verify the integrity and completeness of the data transmitted via file transfer protocols on the enterprise telecommunication and Telecommunications Administration's mainframe systems;
e) Recheck the integrity and completeness of the data according to the data provision requirements on the Telecommunications Administration's storage system;
g) Sign the transfer and acceptance protocol for data.
2. The Telecommunications Administration shall be responsible for securing the data provided by telecommunication enterprises from the moment the authorized representatives sign the transfer and acceptance protocol for data.
Article 5. Purpose, Objectives, and Principles of Utilizing Telecommunication Data
1. The telecommunication data provided by telecommunication enterprises pursuant to this Circular shall only serve the Telecommunications Administration to perform the following tasks:
a) Inspect and supervise the management of mobile subscriber information by telecommunication enterprises;
b) Inspect the use of telecommunication number ranges;
c) Statistics and analysis of the telecommunication market;
d) Inspect the accuracy of billing records; the rate of calls incorrectly charged and invoiced;
đ) Resolve complaints about telecommunication service charges, internet charges, and disputes regarding interconnection charges among telecommunication enterprises;
2. Telecommunication data may only be utilized from processed original data in aggregated form, and direct access to original data is not permitted except in the following cases:
a) Such data serves as evidence of violations or is subject to inspection to determine acts of violation under laws governing the management of mobile subscriber information and billing;
b) Such data is personal information requested for complaint resolution and serves to respond to complaints about service charges.
3. The Director of the Telecommunications Administration shall decide on the entities permitted to use the results of data processing to ensure that the data is used for its intended purpose and by the appropriate entities.
Article 6. Classification, Security, and Storage of Telecommunication Data
1. Telecommunication data shall be classified and secured as follows:
a) Original data shall be managed confidentially and may only be copied or extracted from the Telecommunications Administration's storage system upon decision by the Director of the Telecommunications Administration to carry out the tasks specified in points a, d, and đ, Clause 1, Article 5 of this Circular;
b) Aggregated data shall be classified according to levels of confidentiality, internal circulation, or public dissemination. Management and utilization of data must comply with current legal regulations.
2. The Telecommunications Administration shall store telecommunication data provided by telecommunication enterprises as follows:
a) Stored on independent devices not connected to the Internet; equipped with mechanisms to protect against unauthorized access; monitored regularly to ensure that only authorized individuals can access the data and to record activities on the data storage device;
b) Data specified in point a, Clause 1, Article 3 of this Circular shall be stored in the Telecommunications Administration's centralized database for a minimum period of twenty-four (24) months from the date of receipt from telecommunication enterprises;
c) Data specified in point b, Clause 1, Article 3 of this Circular, serving the tasks specified in points a, b, and c, Clause 1, Article 5 of this Circular, shall be stored in the Telecommunications Administration's centralized database during the data processing period but not exceeding sixty (60) days from the date of receipt of the data. From this date onward, the Telecommunications Administration must delete the original data provided by the enterprise and only retain the aggregated data obtained from the data processing;
d) Data specified in point b, Clause 1, Article 3 of this Circular, serving the tasks specified in points d and đ, Clause 1, Article 5 of this Circular, shall be stored for a period consistent with relevant regulations concerning the purpose of data usage.
Article 7. Responsibilities of Relevant Units
1. Responsibilities of the Telecommunications Administration:
a) Secure the data and access accounts provided by enterprises;
b) Issue and implement regulations on the collection, management, and use of telecommunication data based on principles ensuring information security and data confidentiality; specify detailed procedures related to data collection, processing, and utilization; clearly define the rights and responsibilities of each unit and individual involved in managing, operating, and utilizing the telecommunication data collection system and using telecommunication data; ensure that telecommunication data is used for the purposes specified in Clause 1, Article 5 of this Circular;
c) Coordinate with telecommunication enterprises in resolving complaints regarding data security.
2. Responsibilities of telecommunication enterprises:
a) Provide complete, accurate, and timely data as stipulated in Article 3 of this Circular; ensure the authenticity and integrity of the data as recorded on the enterprise's technical system;
b) Establish and maintain conditions for the transmission lines providing telecommunication data as required by the Telecommunications Administration.
Article 8. Implementation clause
1. This Circular takes effect from November 15, 2017.
2. During implementation, if any issues arise, agencies, organizations, and individuals should report them to the Ministry of Information and Communications (Telecommunications Administration) for review and adjustment;
4. The Head of the Office, the Director of the Telecommunications Administration, the Heads of agencies and units under the Ministry; the General Directors, Directors of telecommunication enterprises, and other related organizations and individuals are responsible for implementing this Circular./.
