PROVISIONS ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE GENERAL SPORT ADMINISTRATION UNDER THE MINISTRY OF CULTURE, SPORTS AND TOURISM
Pursuant to the Law on Government Organization dated June 19, 2015;
Pursuant to the Law on Physical Culture and Sports dated November 29, 2006;
Pursuant to Decree No. 123/2016/ND-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
Pursuant to Decree No. 79/2017/NĐ-CP dated July 17, 2017 of the Government on the functions, tasks, powers and organizational structure of the Ministry of Culture, Sports and Tourism;Department of Sports under the Ministry of Culture, Sports and Tourism;
At the proposal of the Minister of Culture, Sports and Tourism;
The Prime Minister issues this Decision to provide for the functions, tasks, powers and organizational structure of the General Sports Administration under the Ministry of Culture, Sports and Tourism. Promotion review period for professional titles refers to the period during which public servants undergo examination or promotion review. The Department of Sports belongs to the Ministry of Culture, Sports and Tourism.
Article 1. Position and Functions
1. The General Sports Administration is an organization under the Ministry of Culture, Sports and Tourism, performing the function of advising and assisting the Minister of Culture, Sports and Tourism in managing state affairs and enforcing laws related to sports throughout the country; managing and organizing public services in sports according to the provisions of the law.
2. The General Department of Physical Culture and Sports has legal personality, uses a seal with the National Emblem, maintains a separate account at the State Treasury, and is headquartered in Hanoi city.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Submit to the Minister of Culture, Sports and Tourism for submission to the competent state agency:
a) Draft laws, draft resolutions of the National Assembly, draft ordinances, draft resolutions of the Standing Committee of the National Assembly; draft resolutions, decrees of the Government on sports and other projects and programs assigned by the Minister of Culture, Sports and Tourism;
b) Strategies, overall plans, national programs for the development of sports and important national projects and works on sports; draft decisions, directives of the Prime Minister on sports;
c) Negotiations, signing, joining international treaties on sports;
d) Organizing national sports meetings, regional, continental and world sports meetings.
2. Submit to the Minister of Culture, Sports and Tourism for decision:
a) Long-term, five-year and annual plans for the development of sports and projects and programs on sports;
b) Circulars, decisions, directives on managing mass sports activities, sports for persons with disabilities, recreational sports, high-performance sports, professional sports and other activities in the field of sports;
c) Organizing championships of each sport at the regional, continental and world levels in Vietnam; the framework charter of the National Sports Meeting;
d) National standards and technical regulations for sports facilities, training and competition equipment of sports establishments and sports disciplines;
đ) Plans for coordinating activities between the Ministry of Culture, Sports and Tourism and ministries, ministerial-level agencies, government agencies, provincial people's committees, centrally governed cities and central political-social organizations and social organizations in implementing tasks related to sports;
e) Management policies for public services in sports according to the law; criteria for classifying public institutions in the field of sports.
3. Assist the Minister of Culture, Sports and Tourism in directing, guiding and inspecting the implementation of normative legal documents, strategies, plans, programs and projects and programs on sports.
4. Regarding international cooperation:
Implement international agreements, participate in international organizations on sports; international cooperation programs and plans on sports; implement international cooperation and integration in the field of sports according to the classification of the Minister of Culture, Sports and Tourism and the provisions of the law.
5. Regarding physical culture and sports for all:
Regarding sports for all:
Assist the Minister of Culture, Sports and Tourism in performing the following tasks:
a) Propaganda and mobilization of the people to participate in sports activities; guiding methods of physical exercise suitable for age, gender, occupation, health status and disability conditions;
b) Guiding sectors and localities in training and building a team of sports instructors and volunteers; coordinating in organizing professional training for grassroots sports volunteers;
c) Taking the lead in exploiting and popularizing traditional sports and health improvement methods both domestically and internationally;
d) Directing and organizing national mass sports competitions;
đ) Guiding and organizing inspections and evaluations of the development of mass sports movements;
e) Guiding the registration of activities of sports clubs and grassroots sports establishments and fan clubs.
Assist the Minister of Culture, Sports and Tourism in coordinating with the Ministry of Education and Training in carrying out tasks:
Regarding physical education and school sports activities:
Assist the Minister of Culture, Sports and Tourism in cooperating with the Ministry of Education and Training in performing the following tasks:
a) Building and implementing physical education programs in schools;
b) Specifying physical fitness standards and evaluating physical fitness results of students;
c) Organizing training and guiding the implementation of policies for physical education teachers and lecturers;
d) Specifying the system of school sports competitions.
b) Advise the Minister of Culture, Sports and Tourism in coordinating with the Ministry of Defense and the Ministry of Public Security to issue standards for physical training in the People's Army and the People's Public Security Force; organize the training and development of coaches and athletes, and stipulate sports competitions within the armed forces.
Regarding high-performance sports and professional sports:
a) Assist the Minister of Culture, Sports and Tourism in advising on the implementation of policies and measures for athletes, coaches, and referees in sports;
b) Organizing or coordinating the organization of regional, continental, and world sports meetings held in Vietnam, and the National Sports Meeting after approval by the competent authority;
c) Submit to the Minister of Culture, Sports and Tourism for issuance of regulations governing international sports events organized in Vietnam;
d) Submit to the Minister of Culture, Sports and Tourism for issuance of regulations on standards, procedures, and processes for awarding athletic ranks, coaching ranks, and sports referee ranks;
đ) Submit to the Minister of Culture, Sports and Tourism for issuance of regulations on managing the transfer of athletes, selection of athletes for national sports teams; regulations on procedures and processes for establishing national sports delegations and national sports teams for each discipline;
e) Guide the development of training programs for athletes, coaches, and sports referees;
g) Guide the registration of activities for professional sports facilities;
h) Issue competition laws for various sports disciplines; rules for competitions of each discipline at the National Sports Games;
9. Organize and implement research, application of science, technology, and medicine in the field of physical education and sports according to the provisions of the law;
10. Assist the Minister of Culture, Sports and Tourism in managing the activities of associations and non-governmental organizations in the field of physical education and sports according to the provisions of the law;
11. Implement investment projects under the General Department of Physical Education and Sports according to the classification of the Minister of Culture, Sports and Tourism and the provisions of the law;
12. Implement specialized statistics work in the field of physical education and sports; build and manage databases on physical education and sports; organize information, communication, and promotion activities for physical education and sports according to the provisions of the law;
13. Implement administrative reform in the field of physical education and sports according to the administrative reform plan of the Ministry of Culture, Sports and Tourism;
14. Implement inspection work, cooperate in auditing, implement anti-corruption, anti-waste, anti-negative practices, and handle violations of the law in the field of physical education and sports according to the provisions of the law;
15. Manage organizational structure, civil servants, public officials, and employees according to the provisions of the law and the classification of the Minister of Culture, Sports and Tourism. Implement reward and punishment policies and participate in professional training and development for civil servants, public officials, and employees under the management of the General Department according to the provisions of the law and the classification of the Minister of Culture, Sports and Tourism;
16. Manage finances, assets assigned, and implement budgets allocated according to the provisions of the law;
17. Perform other tasks and powers delegated by the Minister of Culture, Sports and Tourism and according to the provisions of the law;
Article 3. Organizational Structure
1. Mass Sports Department;

8. Institute of Physical Education and Sports Science;

13. National Sports Training Center in Can Tho;
14. Anti-Doping and Sports Medicine Center;

16. Ba Dinh Sports Center;
17. Vietnam Sports Hospital;
18. National Sports Complex;
Units specified from Clause 1 to Clause 7 of this Article are organizations assisting the Director of the General Department of Physical Education and Sports in performing state management functions; units specified from Clause 8 to Clause 18 are subordinate public service units of the General Department of Physical Education and Sports;
The Director of the General Department of Physical Education and Sports shall stipulate the functions, tasks, powers, and organizational structures of the subordinate organizations and units of the General Department of Physical Education and Sports;
The Office has six departments.
Article 4. Leadershipof the General Departmentof Physical Culture and Sports
1. The General Department of Physical Culture and Sports shall have a Director and not more than four Deputy Directors.
2. The Director and Deputy Directors of the General Department of Physical Culture and Sports shall be appointed, relieved, rotated, or transferred by the Minister of Culture, Sports and Tourism in accordance with the provisions of the law.
3. The Director of the General Department of Physical Culture and Sports shall be responsible to the Minister of Culture, Sports and Tourism and to the law for all activities of the General Department of Physical Culture and Sports. The Deputy Directors of the General Department of Physical Culture and Sports shall be responsible to the Director of the General Department of Physical Culture and Sports and to the law for the areas of work assigned to them.
Article 5. Transitional Provisions
The Vietnam Sports Newspaper shall continue to operate according to its charter and purpose as recorded in the press operation permit already issued until the Ministry of Culture, Sports and Tourism implements the reorganization of news agencies according to the content and schedule approved by the competent authority.
Article 6. Lawenforcement and responsibilityc and responsibility for implementation
1. This Decision shall take effect from the date of issuance and replace Decision No. 22/2014/QĐ-TTg dated March 13, 2014 of the Government Chairman on the functions, tasks, powers, and organizational structure of the General Department of Physical Culture and Sports under the Ministry of Culture, Sports and Tourism.
2. The Ministry of Culture, Sports and Tourism shall be responsible for reviewing and organizing public service units directly under the General Department of Physical Culture and Sports in accordance with the approved planning by the competent authority.
3. The Minister of Culture, Sports and Tourism, the Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial People's Committees, and the Director of the General Department of Physical Culture and Sports shall be responsible for implementing this Decision./.
