CIRCULAR

Regulations on criteria and indicators for evaluating the quality of services
public services related to preparing national environmental status reports

Pursuant to Decree No. 16/2015/NĐ-CP dated February 14, 2015 of the Government stipulating the self-management mechanism of public service units;

On the basis of Decision No. 36/2017/NĐ-CP dated April 4, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

Pursuant to Decision No. 1990/QD-TTg dated December 11, 2017 of the Prime Minister promulgating the list of public services using state budget funds under the management of the Ministry of Natural Resources and Environment;

At the proposal of the Director of the Science and Technology Department and the Director of the Legal Department;

The Minister of Natural Resources and Environment issues this Circular regulating criteria and indicators for evaluating the quality of public services using state budget funds related to preparing national environmental status reports under the responsibility of the Ministry of Natural Resources and Environment (hereinafter referred to as public services related to preparing national environmental status reports), including:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

1. Preparing national environmental status reports;

2. Preparing specialized reports on national environmental status.

1. State administrative agencies managing natural resources and environment to evaluate the quality of public services related to preparing national environmental status reports.

Article 2. Applicability

This Circular applies to:

2. Public service organizations, organizations with appropriate functions and tasks, meeting the requirements for providing services to prepare national environmental status reports.

1. The quality of public services related to preparing national environmental status reports is the result of the evaluation of the satisfaction level of state administrative agencies with such services through assessment criteria.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

2. Assessment criteria for the quality of public services related to preparing national environmental status reports are contents and requirements used to assess the quality of services at each stage of the service.

3. Indicators for assessing the quality of public services related to preparing national environmental status reports are tools for measuring specific aspects of the assessment criteria, expressed in numerical values or ratios.

CRITERIA AND INDICATORS FOR ASSESSING THE QUALITY OF PUBLIC SERVICES

Chapter II

RELATED TO PREPARING NATIONAL ENVIRONMENTAL STATUS REPORTS

Article 4. Assessment Criteria

1. Criterion 1: Functions, tasks, material and technical foundations of organizations providing services to prepare national environmental status reports.

2. Criterion 2: Human resources for preparing national environmental status reports.

3. Criterion 3: Developing the framework and detailed outline of national environmental status reports.

4. Criterion 4: Collecting information and data (including supplementary surveys if necessary).

5. Criterion 5: Processing and summarizing information and data.

6. Criterion 6: Drafting national environmental status reports.

7. Criterion 7: Attitude towards service provision during the preparation of national environmental status reports.

8. Criterion 8: Products of services to prepare national environmental status reports.

Article 5. Indicators and Basis for Evaluating Criterion 1

1. Evaluation Indicators:

a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;

b) Service provision experience: Number of years of experience in preparing national environmental status reports (as the main organizer or collaborator), number of national environmental status reports issued;

c) Models, software, machinery, and equipment serving the preparation of national environmental status reports.

2. Basis for Evaluation:

a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;

b) Decisions approving completion by competent authorities regarding the task of drafting national environmental status reports or specialized environmental status reports;

c) Statistical reports, equipment status reports, model, software, machinery reports of the service provider organization at the time of evaluation.

c) Statistical reports, current status reports of equipment, models, software, and machinery of the service provider organization at the time of assessment.

Article 6. Indicators and Basis for Evaluating Criterion 2

a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;

a) The number of direct human resources for preparing the national environmental status report;

b) The quality of direct human resources for preparing the national environmental status report.

a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;

a) Statistical data, personnel files, and labor contracts, expert hiring contracts of the service provider organization;

b) Organizational and individual capacity (credentials, relevant expertise, technical skills), years of experience in preparing the national environmental status report.

Article 7. Indicators and Basis for Evaluating Criterion 3

a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;

a) Time to complete the framework structure and detailed outline of the national environmental status report;

b) Quality of the framework structure and detailed outline of the national environmental status report.

a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;

a) Written assessment by the managing authority on this work item;

b) Completion time specified in the approved Task Description for preparing the national environmental status report;

c) Content complying with the provisions of Article 8 and Appendices I and II of Circular No. 43/2015/TT-BTNMT dated September 29, 2015, issued by the Ministry of Natural Resources and Environment regarding environmental status reports, environmental indicators, and environmental monitoring data management.

Article 8. Indicators and Basis for Evaluating Criterion 4

a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;

a) Methods of collecting information and data;

b) Sources of input information and data;

c) Timeliness of information and data;

d) Completeness of information and data (including groups of information: drivers, pressures, state, impacts, responses).

a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;

a) List of collected information and data, their sources, and accuracy;

b) Update time of information and data according to the reporting year;

c) Content complying with the provisions at point 2.3, section 2, part II of Circular No. 02/2017/TT-BTNMT dated March 7, 2017, issued by the Ministry of Natural Resources and Environment stipulating technical standards and economic-technical norms for preparing environmental status reports.

Article 9. Indicators and Basis for Evaluating Criterion 5

a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;

a) Checking, analyzing, and processing information and data;

b) Summarizing information and data by group (including groups of information: drivers, pressures, state, impacts, responses).

a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;

a) Collected information and data serving the construction of the national environmental status report, categorized according to the DPSIR model;

b) Content complying with the provisions at point 2.3, section 2, part II of Circular No. 02/2017/TT-BTNMT dated March 7, 2017, issued by the Ministry of Natural Resources and Environment stipulating technical standards and economic-technical norms for preparing environmental status reports.

Article 10. Indicators and Basis for Evaluating Criterion 6

a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;

a) Process for drafting the national environmental status report;

b) Time to complete the draft national environmental status report.

a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;

a) Compliance with the prescribed procedures when drafting the national environmental status report as stipulated in the Task Description and technical regulations;

b) Content complying with the provisions at point 2.4, section 2, part II of Circular No. 02/2017/TT-BTNMT dated March 7, 2017, issued by the Ministry of Natural Resources and Environment stipulating technical standards and economic-technical norms for preparing environmental status reports.

Article 11. Indicators and Basis for Evaluating Criterion 7

a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;

a) Timely reporting of developments during the service implementation process, ready to meet urgent requirements of the ordering agency;

b) Self-inspection and supervision of the investigation and information collection process for preparing the national environmental status report by the service provider organization.

a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;

a) Periodic and urgent reports from the service provider organization;

b) Inspection records periodically or urgently conducted by the ordering agency, annual acceptance documents from the supervisory level, and other related documents concerning urgent requirements of the ordering agency (if any);

c) Self-inspection and supervision plan for investigative activities by the service provider organization; inspection records or documentation, evidence of self-inspection and supervision by the service provider organization.

Article 12. Indicators and Basis for Evaluation Criterion 8

a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;

a) Product quality;

b) Product quantity;

c) Implementation progress.

a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;

a) The approval decision of the competent management agency and the product list of the national environmental status report task;

b) Inspection and acceptance evaluation records of the ordering agency or the competent state management agency;

c) Statistical reports and product submission reports of the service organization providing the national environmental status report that have been confirmed by the competent authority.

Article 13. Quality Assessment of Public Services Related to National Environmental Status Report Preparation

1. The quality assessment of public services related to national environmental status report preparation shall be conducted through scoring. The evaluation scale is 100 points. The specific evaluation scale is determined for each indicator as prescribed in Articles 5, 6, 7, 8, 9, 10, 11, and 12, and detailed in the Appendix attached to this Circular.

2. Service quality is evaluated at four levels:

a) Excellent: When the total score reaches 80 points or more, including a total score of at least 18 points for the indicators specified in Article 12 of this Circular;

b) Good: When the total score ranges from 70 to less than 80 points, including a total score of at least 16 points for the indicators specified in Article 12 of this Circular;

c) Satisfactory: When the total score ranges from 50 to less than 70 points, including a total score of at least 12 points for the indicators specified in Article 12 of this Circular;

d) Unsatisfactory: When the total score is less than 50 points, or the total score for the indicators specified in Article 12 of this Circular is less than 12 points.

Chapter III

IMPLEMENTING PROVISIONS

Article 14. Effective Date

1. This Circular takes effect from the date 05 the 02 IN 2020.

2. In case the legal normative documents referred to and applied in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new provisions.

Article 15. Implementation Organization

1. The Science and Technology Department, Ministry of Natural Resources and Environment is responsible for organizing guidance on implementation and monitoring compliance with this Circular.

2. Units under the Ministry of Natural Resources and Environment and relevant organizations and individuals are responsible for implementing this Circular.

3. During the implementation process, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to promptly reflect them to the Ministry of Natural Resources and Environment for research, consideration, and appropriate amendment./.
