On the basis of the Investment Law dated November 26, 2014;
on InvestmentDecree No. 82/2018/NĐ-CPdated May 22, 2018 of the Government on management of industrial parks and economic zones;
At the proposal of the Minister of Planning and Investment and the People's Committee of Kiên Giang Province;
The Prime Minister promulgates this Decision on the establishment of Ha Tien Border Gate Economic Zone, Kiên Giang Province.
Article 1. Establishment of Ha Tien Border Gate Economic Zone, Kiên Giang Province
1. Ha Tien Border Gate Economic Zone, Kiên Giang Province is a defined geographic area within the national territory and sovereignty, having a separate economic space.
Ha Tien Border Gate Economic Zone has an area of 1,600 hectares, including five wards: Phao Dai, Dong Ho, To Chau, Binh San, My Duc. The geographic boundaries are defined as follows:
a) North bordering Kampot Province, Kingdom of Cambodia;
b) South bordering Thuan Yen Commune, Ha Tien City;
c) East and Southeast bordering Phu My Commune, Giang Thanh District;
d) West and Southwest bordering Rach Gia Bay, Rach Gia City.
2. Ha Tien Border Gate Economic Zone shall be organized into functional areas including duty-free zone, international border gate zone, industrial zone, tourism zone, administrative zone, residential zone, and other functional zones. The scale and location of each functional area shall be determined in the general planning for construction and detailed planning of Ha Tien Border Gate Economic Zone.
Article 2. Activities and mechanisms, policies for Ha Tien Border Gate Economic Zone, Kiên Giang Province shall be implemented in accordance with laws on investment, laws on enterprises, Decree No.82/2018/NĐ-CPdated May 22, 2018 of the Government on management of industrial parks and economic zones and other related legal documents.
Article 3. Implementation Provisions
1. This Decision takes effect from October 1, 2020.
Repeal Decision No. 158/1998/QĐ-TTg dated September 3, 1998 of the Prime Minister on the trial application of certain policies in the Ha Tien Border Gate area, Kiên Giang Province.
2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, and Chairman of the People's Committee of Kiên Giang Province are responsible for implementing this Decision./.
