AMENDMENTS AND SUPPLEMENTS TO SOME ARTICLES OF CIRCULAR NO. 08/2017/TT-LDTBXH DATED MARCH 10, 2017 ISSUED BY THE MINISTER OF LABOR - INVALIDS AND SOCIAL AFFAIRS ON STANDARDS FOR PROFESSIONAL QUALIFICATIONS OF VOCATIONAL EDUCATION TEACHERS

Pursuant to the Law on Vocational Education dated November 27, 2014;

Pursuant to Decree No. 14/2017/ND-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - Invalids and Social Affairs;

Pursuant to Decree No. 15/2019/NĐ-CP dated February 1, 2019 of the Government detailing a number of articles and measures for the implementation of the Law on Vocational Education;

Based on the proposal of the Director General of the General Department of Vocational Education;

The Minister of Labor - Invalids and Social Affairs hereby issues this Circular amending and supplementing some articles of Circular No. 08/2017/TT-LDTBXH dated March 10, 2017 issued by the Minister of Labor - Invalids and Social Affairs on standards for professional qualifications of vocational education teachers.

Article 1. Amending and supplementing certain Articles of Circular No.Circular No. 08/2017/TT-LDTBXH dated March 10, 2017 issued by the Minister of Labor - Invalids and Social Affairs on standards for professional qualifications of vocational education teachers

1. Amend and supplement Clause 2 and Clause 4 of Article 1 as follows:

a) Amending and supplementing Clause 2 as follows:

“2. This Circular applies to vocational education teachers currently teaching at colleges, technical schools, vocational training centers, vocational training centers - general education centers that are public, private, foreign-invested, and enterprises registered for vocational education activities (hereinafter referred to as vocational education activity institutions); relevant agencies, organizations, and individuals.”

b) Amend and supplement Clause 4 as follows:

“4. This Circular does not apply to teachers teaching teacher training programs under the management of the Ministry of Education and Training; teachers teaching at colleges and technical schools under the management of the Ministry of Public Security.”

2. Amend Article 4 as follows:

“Article 4. Standard 2 on Foreign Language Proficiency

Possess the ability to use a foreign language in performing the duties of a vocational education teacher at the basic level according to the job position requirements specified by the head of the vocational education activity institution.”

3. Amend Article 5 as follows:

“Article 5. Standard 3 on Information Technology Proficiency

Possess the ability to apply information technology in performing the duties of a vocational education teacher at the basic level according to the job position requirements specified by the head of the vocational education activity institution.”

4. Amend and supplement some clauses of Article 17 as follows:

a) Amend and supplement Point a Clause 1 as follows:

“a) Hold a bachelor's degree or equivalent qualification, appropriate to the field or trade being taught;”

b) Amend and supplement Point a Clause 3 as follows:

“a) Hold a bachelor's degree or equivalent qualification, appropriate to the field or trade being taught, and possess one of the following certificates in practical skills suitable for the field or trade being taught to teach intermediate-level practical courses: National Vocational Skill Certificate Level 2 or Craftsmanship Certification Level 4/7, 3/6 or Excellent Artisan, Excellent Artist, Excellent Medical Practitioner Certification or Higher Diploma in Vocational College or Advanced Vocational Skills Certificate or Equivalent;”

5. Amend Article 18 as follows:

“Article 18. Standard 2 on Foreign Language Proficiency

Possess the ability to use a foreign language in performing the duties of a vocational education teacher at the intermediate level according to the job position requirements specified by the head of the vocational education activity institution.”

6. Amend Article 19 as follows:

“Article 19. Standard 3 on Information Technology Proficiency

Possess the ability to apply information technology in performing the duties of a vocational education teacher at the intermediate level according to the job position requirements specified by the head of the vocational education activity institution.”

7. Amend and supplement some clauses of Article 32 as follows:

a) Amend and supplement Point a of Clause 1 as follows:

“a) Hold a bachelor's degree or equivalent qualification, appropriate to the field or trade being taught;”

b) Amend and supplement Point a Clause 2 as follows:

“a) Possess one of the following certificates in practical skills suitable for the field or trade being taught to teach advanced-level practical courses: National Vocational Skill Certificate Level 3 or Craftsmanship Certification Level 5/7, 4/6 or Higher or Excellent Artisan, Excellent Artist, Excellent Medical Practitioner Certification or Diploma in Vocational College or Advanced Vocational Skills Certificate or Equivalent;”

c) Amend and supplement Point a Clause 3 as follows:

“a) Hold a bachelor's degree or equivalent qualification, appropriate to the field or trade being taught, and possess one of the following certificates in practical skills suitable for the field or trade being taught to teach advanced-level practical courses: National Vocational Skill Certificate Level 3 or Craftsmanship Certification Level 5/7, 4/6 or Higher or Excellent Artisan, Excellent Artist, Excellent Medical Practitioner Certification or Diploma in Vocational College or Advanced Vocational Skills Certificate or Equivalent;”

8. Amend Article 33 as follows:

“Article 33. Standard 2 on Foreign Language Proficiency

Possess the ability to use a foreign language in performing the duties of a vocational education teacher at the advanced level according to the job position requirements specified by the head of the vocational education activity institution.”

9. Amend Article 34 as follows:

“Article 34. Standard 3 on Information Technology Proficiency

Possess the ability to apply information technology in performing the duties of a vocational education teacher at the advanced level according to the job position requirements specified by the head of the vocational education activity institution.”

10. Amend and supplement Article 47 as follows:

“Article 47. Criteria for Evaluating and Classifying Teachers

1. For teachers teaching at the basic level: There are three criteria, fourteen standards, and thirty-five indicators. The indicators are expressed through Articles 4, 5; Clauses of Article 3; and Clauses of Articles from Article 6 to Article 16 of this Circular.

2. For teachers teaching theoretical and practical courses at the intermediate and advanced levels: There are three criteria, fifteen standards, and forty-one indicators. The indicators are expressed through Articles 18, 19, 33, 34; Points of Clauses 1 and 2 of Article 17; Points of Clauses 1 and 2 of Article 32; Clauses of Articles from Article 20 to Article 31; and Clauses of Articles from Article 35 to Article 46 of this Circular.”

3. For vocational teachers at the intermediate and college levels who teach integrated subjects: There are three criteria, fifteen standards, and forty-three indicators. The indicators are set forth in Article 18, Article 19, Article 33, Article 34; Point 3 of Article 17; Point 3 of Article 32; Clauses of Articles from Article 20 to Article 31; Clauses of Articles from Article 35 to Article 46 of this Circular.

11. Amend and supplement Clause 3 of Article 48 as follows:

“3. The total maximum score for evaluating a teacher is the sum of the maximum scores for each standard applicable to that teacher. The total maximum evaluation score for a teacher teaching at the primary level is seventy points; for a teacher teaching theory or practice at the intermediate and college levels, it is eighty-two points; for a teacher teaching integrated subjects at the intermediate and college levels, it is eighty-six points.”

12. Supplement Clause 3 of Article 51 as follows:

“3. Guide vocational education institutions to implement professional standardization work for vocational education teachers based on actual conditions, in accordance with the provisions of this Circular.”

13. Amend and supplement Clause 1 and Clause 2 of Article 54 as follows:

“1. Conduct annual evaluations and classifications of teachers at the end of each academic year according to the provisions of this Circular, ensuring honesty, objectivity, comprehensiveness, scientific rigor, democracy, and fairness; reflecting the professional and vocational capabilities of teachers under specific conditions of vocational education institutions through appropriate evidence consistent with the criteria and standards stipulated in Chapter II of this Circular.

2. Confirm the professional training qualifications of teachers according to job position requirements, aligning with assigned fields and trades, and their ability to use foreign languages and apply information technology in performing their duties.”

14. Amend Article 55 as follows:

"Article 55. Transitional Provisions

1. For fields and trades that have established examination, testing, and assessment criteria for national skill certificates or practical skill certificates for vocational education teachers before the effective date of this Circular, such teachers must complete the requirements to meet the standards for national skill certificates or practical skill certificates specified in this Circular within twelve months from the effective date of this Circular.

2. For fields and trades that establish examination, testing, and assessment criteria for national skill certificates or practical skill certificates for vocational education teachers after the effective date of this Circular, such teachers must complete the requirements to meet the standards for national skill certificates or practical skill certificates specified in this Circular within twelve months from the date these examination, testing, and assessment criteria are issued.”

Article 2. Effective Date

1. This Circular takes effect from March 10, 2021.

2. During implementation, if there are any difficulties, please report to the Ministry of Labor - Invalids and Social Affairs for guidance.
