DECISION

Regarding the composition and tasks, powers of theSteering Committee for Popularizing and Promoting Legal Education

__________

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on Popularizing and Educating about Laws dated June 20, 2012;

At the proposal of the Minister of Justice;

The Prime Minister issues this Decision to stipulate the composition and tasks, powers of the Steering Committee for Popularizing and Promoting Legal Education.

Article 1. Composition of the Steering Committee for Popularizing and Promoting Legal Education

1. The central Steering Committee for Popularizing and Promoting Legal Education, established by the Prime Minister, shall consist of the following components:

a) Chairman of the Committee: Deputy Prime Minister.

b) Vice Chairman in charge of the Committee: Minister of Justice.

c) Other Vice Chairmen of the Committee:

- Deputy Minister of Justice;

- Deputy Director of the Government Office;

- Invite the Vice Chairman of the Vietnam Fatherland Front Central Committee to be a Vice Chairman of the Committee.

d) Members of the Committee are representatives from the following agencies and organizations: Ministry of National Defense, Ministry of Public Security, Ministry of Home Affairs, Government Inspectorate, Ministry of Information and Communications, Ministry of Education and Training, Ministry of Labor, Invalids and Social Affairs, Ministry of Culture, Sports and Tourism, Ministry of Transport, Ministry of Agriculture and Rural Development, Ministry of Natural Resources and Environment, Ministry of Health, Ministry of Finance, Ministry of Industry and Trade, Ministry of Planning and Investment, Ministry of Construction, Ministry of Foreign Affairs, Committee for Ethnic Minorities, Vietnam News Agency, Vietnam Television, Voice of Vietnam Radio.

Invite representatives from the Central Commission for Party Inspection, Central Propaganda Department, Central Mass Mobilization Department, Supreme People's Court, Supreme People's Procuracy, Vietnam Veterans Association Central Committee, Vietnam General Confederation of Labor, Vietnam Farmers' Union Central Committee, Vietnam Women's Union Central Committee, Communist Youth Union Central Committee, Vietnam Bar Federation, Vietnam Chamber of Commerce and Industry (VCCI) to be members of the Committee.

2. Based on the composition of the central Steering Committee for Popularizing and Promoting Legal Education and the practical requirements of localities, the Chairman of the People's Committee of provinces and centrally governed cities (hereinafter referred to as provincial level), the Chairman of the People's Committee of districts, towns, urban districts, and cities under provinces and centrally governed cities (hereinafter referred to as district level) shall decide on the composition and number of members of the provincial and district Steering Committees for Popularizing and Promoting Legal Education, with the leaders of the provincial People's Committee and the district People's Committee serving as the Chairmen of the respective provincial and district Steering Committees for Popularizing and Promoting Legal Education.

Article 2. Tasks and Powers of the Steering Committee for Popularizing and Promoting Legal Education

1. The central Steering Committee for Popularizing and Promoting Legal Education shall advise the Government and the Prime Minister on directing and coordinating the implementation of the following tasks:

a) Developing and implementing measures to strengthen the leadership of the Party in legal education work;

b) Improving the legal framework for legal education work; developing, promulgating, and supervising the implementation of programs and plans for legal education by the Government;

c) Communicating policies and laws to create social consensus and mobilize citizens to participate effectively in building and perfecting laws and implementing them;

d) Implementing legal education work in various fields, areas, and target groups that require inter-sectoral cooperation to achieve economic and social development goals and ensure national defense and security; promoting digital transformation in legal education nationwide;

đ) Implementing measures to promote socialization policies and mobilize organizations and individuals to participate in legal education and policy communication activities;

e) Performing other tasks assigned by the Government and the Prime Minister.

2. The provincial Steering Committee for Popularizing and Promoting Legal Education and the district Steering Committee for Popularizing and Promoting Legal Education shall advise the People's Committee and the Chairman of the People's Committee at their respective levels on the implementation of the following tasks:

a) Developing and implementing measures to strengthen the leadership of the Party committee at their respective levels in legal education work;

b) Proposing the Party committee and local authorities to issue documents on mechanisms and solutions to enhance the effectiveness of legal education work;

c) Developing programs, projects, and plans of the People's Committee and the Chairman of the People's Committee at their respective levels on legal education and policy communication in their locality;

d) Implementing legal education work in various fields, areas, and target groups that require inter-sectoral cooperation to achieve economic and social development goals and ensure national defense and security in their locality;

đ) Guiding the organization of responses to Law Day in their locality; promoting digital transformation in legal education in their area;

e) Implementing measures to promote socialization policies and mobilize organizations and individuals to participate in legal education and policy communication activities;

g) Performing other tasks assigned by the People's Committee and the Chairman of the People's Committee at their respective levels.

Article 3. Tasks, Authorities, and Responsibilities of the Chairman of the Steering Committee for Popularizing and Legal Education

1. Organize the implementation of the tasks of the Steering Committee for Popularizing and Legal Education; be responsible before the competent authority deciding to establish the Steering Committee for Popularizing and Legal Education and before the law regarding the activities of the Steering Committee.

2. Issue the List of Steering Committee members, the Operational Regulations of the Steering Committee; approve the program, plan of activities of the Steering Committee, conclusions and other documents of the Steering Committee upon the proposal of the Vice Chairman in charge of the Steering Committee.

3. Provide general direction for the activities of the Steering Committee; manage, assign tasks to the Vice Chairman in charge of the Steering Committee, Vice Chairmen of the Steering Committee, and Steering Committee members to perform tasks according to the activity plan and field of work; urge and inspect the implementation of assigned tasks.

4. Convene and chair sessions of the Steering Committee.

5. Mobilize experts, scientists, practical activists, enterprises, and related organizations to participate in implementing the tasks of the Steering Committee when necessary.

6. Implement the reporting system on the organization and activities of the Steering Committee.

Article 4. Tasks, Authorities, and Responsibilities of the Vice Chairman in Charge and Vice Chairmen of the Steering Committee for Popularizing and Legal Education

1. The Vice Chairman in charge of the Steering Committee for Popularizing and Legal Education handles regular matters of the Steering Committee and performs the following tasks:

a) Perform tasks assigned by the Chairman of the Steering Committee; be responsible before the Steering Committee, the Chairman of the Steering Committee, and before the law for the performance of assigned tasks;

b) Assist the Chairman of the Steering Committee in managing the overall activities of the Steering Committee, directing, monitoring, urging the organization of activities of the Steering Committee according to the plan and program of work directed, approved by the Chairman of the Steering Committee, or directives from the Government, Prime Minister; People's Council, Chairman of the People's Council at the same level;

c) Urge Steering Committee members to organize the implementation of popularization and legal education work within their management scope according to the Steering Committee’s activity plan and program;

d) Propose and submit to the Chairman of the Steering Committee for issuance of the Operational Regulations of the Steering Committee, the program, plan of activities, and other documents of the Steering Committee;

d) Perform the tasks, authorities, and responsibilities stipulated in Article 5 of this Decision;

e) Perform other tasks assigned by the Chairman of the Steering Committee.

2. The Vice Chairmen of the Steering Committee for Popularizing and Legal Education have the following tasks, authorities, and responsibilities:

a) Perform tasks assigned by the Chairman of the Steering Committee, the Vice Chairman in charge of the Steering Committee, or authorized by them;

b) Perform the tasks, authorities, and responsibilities stipulated in point a, Clause 1 of this Article and Article 5 of this Decision.

Article 5. Tasks, Authorities, and Responsibilities of Members of the Steering Committee for Popularizing and Legal Education

1. Fully participate in the activities of the Steering Committee; perform tasks assigned by the Chairman of the Steering Committee and be responsible before the Steering Committee, the Chairman of the Steering Committee, and before the law for the performance of these tasks. Members of the Steering Committee are the official representatives of the agencies or organizations where they work during the process of performing functions, tasks, and other activities of the Steering Committee.

2. Advise and propose to the Chairman of the Steering Committee and the Steering Committee solutions and key tasks concerning specialized popularization and legal education work within their management scope and cooperation with other Steering Committee members to organize implementation.

3. Assist the heads of agencies or organizations they represent as members of the Steering Committee in directing, guiding, or directly directing, guiding the implementation of popularization and legal education work within their management scope; digital transformation of popularization and legal education work in their sector or field; periodically report to the Steering Committee (every six months, annually) and propose solutions to resolve issues arising from popularization and legal education work within their management scope.

4. Be provided with information and materials related to the activities of the Steering Committee.

Article 6. The Standing Office of the Steering Committee for Popularizing and Educating Law and the Secretariat

1. The Ministry of Justice shall perform the duties of the Central Standing Office of the Steering Committee for Popularizing and Educating Law; the Department of Justice and the Justice Office shall perform the duties of the Provincial and District Standing Office of the Steering Committee for Popularizing and Educating Law.

2. The Standing Office of the Steering Committee for Popularizing and Educating Law shall have the following tasks and powers:

a) Serve as the focal point to assist the Committee, the Chairman of the Committee, and the Vice-Chairman in charge of the Committee in implementing the tasks and powers stipulated in Articles 2 and 3, Clause 1 of Article 4 of this Decision;

b) Take the lead in drafting programs, plans of activities, conclusions, and other documents of the Committee; monitor and compile information on the implementation of these documents;

c) Advise the Committee on providing opinions on draft programs, plans, and proposals on popularizing and educating law within the authority to issue such documents by the Government, Prime Minister, People's Committees, and Chairmen of People's Committees at the same level;

d) Ensure the conditions for the operation of the Committee, assign functional units under its jurisdiction to carry out the Committee’s tasks;

đ) Manage the budget, material infrastructure, and working equipment of the Committee in accordance with the provisions of the law;

e) Decide on the establishment, composition, and tasks and powers of the Secretariat assisting the Steering Committee for Popularizing and Educating Law;

g) Perform other tasks assigned by the Chairman of the Committee, the Vice-Chairman in charge of the Committee, and the Vice-Chairman of the Committee.

3. The Secretariat assisting the Steering Committee for Popularizing and Educating Law operates on a part-time basis.

Article 7. Working regime and reporting of the Steering Committee for Popularizing and Educating Law

1. Members of the Steering Committee for Popularizing and Educating Law work on a part-time basis.

2. The Chairman of the Central Steering Committee for Popularizing and Educating Law shall use the seal of the Prime Minister; the Chairman of the Provincial and District Steering Committee for Popularizing and Educating Law shall use the seal of the People's Committee at the same level; the Vice-Chairman in charge of the Committee, the Vice-Chairman of the Committee, and members of the Committee shall use the seal of their respective agencies or organizations where they work.

3. The Committee shall be responsible for regularly and urgently reporting to the competent authority on the situation of the Committee's operations as required.

Article 8. Budget for the Operation of the Steering Committee for Popularizing and Educating Law and the Secretariat

The budget for the operation of the Steering Committee for Popularizing and Educating Law and the Secretariat assisting the Committee shall be guaranteed by the state budget; it shall be allocated in the regular expenditure budget of the Standing Office of the Steering Committee for Popularizing and Educating Law at all levels and mobilized from various sources of support and lawful funds according to the provisions of the law.

Article 9. Effective Date and Transitional Provisions

1. This Decision shall take effect from August 8, 2021, and replace Decision No. 27/2013/QĐ-TTg dated May 19, 2013, of the Prime Minister on the composition and tasks and powers of the Steering Committee for Popularizing and Educating Law (hereinafter referred to as Decision No. 27/2013/QĐ-TTg) and Decision No. 42/2017/QĐ-TTg dated September 20, 2017, of the Prime Minister amending and supplementing certain articles of Decision No. 27/2013/QĐ-TTg (hereinafter referred to as Decision No. 42/2017/QĐ-TTg).

Within three months from the date this Decision takes effect, the Steering Committees for Popularizing and Educating Law at all levels established pursuant to Decision No. 27/2013/QĐ-TTg and Decision No. 42/2017/QĐ-TTg must be reorganized in accordance with this Decision.

2. Based on the requirements of guidance and coordination in implementing the work of popularizing and educating law within their sectors and fields of management, the Ministers, Heads of ministerial-level agencies shall decide and bear responsibility for establishing or continuing the operation of the Steering Committee for Popularizing and Educating Law of their ministries and agencies.

Article 10. Responsibility for Implementation

The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairmen of provincial and centrally-run city People's Committees, and heads of related agencies and organizations shall be responsible for implementing this Decision.
