CIRCULAR
Regulations on code number, occupational title standards, appointment and salary grading for equipment and laboratory staff in general education institutions and public specialized schools

Pursuant to the Education Law dated June 14, 2019;
Pursuant to the Civil Servant Law dated November 15, 2010; and the Law Amending and Supplementing Certain Provisions of the Civil Servants and Public Officials Law and the Civil Servant Law dated November 25, 2019;
Pursuant to Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of civil servants;

PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
Article 1. This Circular stipulates the code number, occupational title standards, appointment and salary grading for equipment and laboratory staff in general education institutions and public specialized schools, including: secondary schools; middle school boarding schools for ethnic minorities; high schools; specialized high schools; residential high schools for ethnic minorities; multi-grade high schools; preparatory universities and schools for persons with disabilities having middle school and high school levels (hereinafter referred to collectively as high schools).
Article 2. This Circular applies to equipment and laboratory staff in high schools.

Chapter II
STANDARDS FOR OCCUPATIONAL TITLES, APPOINTMENT AND SALARY GRADING BY OCCUPATIONAL TITLES
SALARY BASED ON OCCUPATIONAL TITLES
Article 3. Standards for occupational titles of equipment and laboratory staff
1. Tasks
a) Managing, preserving, using equipment; keeping records of equipment files; repairing simple equipment;
b) Preparing plans for the use, purchase, and repair of equipment for the school; reporting and proposing to the school principal plans for the disposal and destruction of faulty or expired equipment and chemicals;
c) Preparing regular reports on equipment and laboratory work;
d) Leading specialized activities related to equipment and laboratories at the school;
đ) Leading the implementation of software applications for equipment management;
e) Leading the organization of making teaching aids and simple equipment with locally available materials;
g) Cooperating with teachers to prepare necessary equipment, chemicals, and materials for practical and experimental lessons; ensuring safety conditions and fire prevention during practical and experimental activities;
h) Organizing and evaluating science and technology competitions for students related to experiments from school level upwards;
i) Completing training programs; self-study and self-improvement to enhance professional skills;
k) Performing other tasks assigned by the school principal.
2. Professional ethics standards
a) Adhere to the Party's guidelines and policies, state laws, and regulations of the sector;
b) Being honest, objective, and conscientious about moral improvement; upholding the dignity, reputation, and credibility of civil servants; fostering unity and mutual assistance among colleagues and students;
c) Fulfilling duties in accordance with regulations, technical procedures, and other legal provisions.
3. Educational and Training Standards
a) Having a college degree or higher in School Equipment Technology (or a college degree or higher in relevant fields suitable for the position of equipment and laboratory staff in high schools);
b) Completing the training program according to the occupational title standards for equipment and laboratory staff as prescribed.
Article 4. Professional Competence Standards
a) Understanding and applying Party policies, State laws, and industry requirements to their work;
b) Effectively implementing the school's educational plan;
c) Possessing the ability to manage, use, and preserve equipment; preventing and extinguishing fires during practical and experimental activities;
d) Possessing the ability to repair, make, and cooperate with teachers, students, and parents to create teaching aids and simple equipment;
đ) Possessing the ability to flexibly apply and support teachers in effectively using equipment and laboratories in teaching practice;
e) Possessing the ability to apply information technology in professional activities.
Article 4. Principles for appointment and salary grading according to occupational titles for equipment and laboratory staff
1. The appointment to occupational titles for equipment and laboratory staff must be based on the provisions of this Circular and the job position, duties, and professional qualifications of the staff.
2. When appointing from civil servant ranks or occupational titles of other staff members to the occupational title of equipment and laboratory staff as stipulated in this Circular, there shall be no combination with salary grade promotion.
Article 5. Appointment of occupational titles for equipment and laboratory staff
Appointment to the occupational title of equipment and laboratory staff with code V.07.07.20 applies to:
1. Staff currently engaged in equipment and laboratory work but not yet appointed according to Circular No. 08/2019/TT-BGDĐT dated May 2, 2019, issued by the Minister of Education and Training, specifying occupational titles and salary grading for equipment and laboratory staff in public secondary schools (hereinafter referred to as Circular No. 08/2019/TT-BGDĐT), when they meet the criteria for the occupational title of equipment and laboratory staff as specified in this Circular.
2. Cases where recruitment into the position of equipment and laboratory staff occurs after the effective date of this Circular and meets the probationary period requirements as prescribed.
Article 6. Salary Classification
1. Staff appointed to the occupational title of equipment and laboratory staff with code V.07.07.20 as specified in this Circular shall apply the salary table for type A0 staff at Table 3 (salary table for professional and technical positions for cadres and staff in state-run units) issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004, of the Government on salary systems for cadres, civil servants, staff, and armed forces personnel (hereinafter referred to as Decree No. 204/2004/NĐ-CP).
2. The process of salary adjustment for cases where recruitment and appointment to the occupational title of equipment and laboratory staff are currently civil servants or staff in other specialized fields shall be carried out as follows:
a) In cases where they are currently graded under type A0 civil servants or staff according to Table 2 (salary table for professional and technical positions for cadres and civil servants in state agencies) or Table 3 (salary table for professional and technical positions for cadres and staff in state-run units) issued together with Decree No. 204/2004/NĐ-CP, they shall be graded under type A0 staff.
b) In cases where they are currently graded under type A1 or higher or type B civil servants or staff, their salaries shall be reassigned according to the guidelines set forth in Clause 1, Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007, issued by the Minister of Home Affairs on salary grading when upgrading, transferring, or changing types of civil servants or staff.
Chapter III
IMPLEMENTING PROVISIONS
Article 7. Implementation Organization
1. This Circular serves as the basis for implementing recruitment, utilization, and management of equipment and laboratory staff in secondary schools.
2. Non-public educational institutions at the same level may apply the provisions of this Circular.
3. Heads of secondary schools directly managing and utilizing staff have the responsibility to:
a) Review job position plans, develop appointment plans for occupational titles and salary grading for equipment and laboratory staff within their jurisdiction, submit them to competent authorities for examination and decision-making or decide according to delegated authority;
b) Report to competent management authorities the results of appointments and salary grading for equipment and laboratory staff as required.
4. Heads of agencies with management authority over secondary schools have the responsibility to:
a) Approve plans for appointments to occupational titles and salary grading for equipment and laboratory staff in secondary schools under their management; resolve issues within their authority during the process of appointing occupational titles and salary grading for equipment and laboratory staff in secondary schools under their management;
b) Decide according to their authority or delegate authority for decisions on appointments to occupational titles and salary grading for equipment and laboratory staff in secondary schools according to their authority;
c) Report the results of appointments to occupational titles and salary grading for equipment and laboratory staff in secondary schools under their management to competent authorities as required;
d) Develop training plans according to occupational title standards for equipment and laboratory staff and ensure benefits and policies when participating in training as prescribed by law.
Article 8. Application Provisions
1. In cases where staff currently engaged in equipment and laboratory work do not meet the criteria specified in Clause 3, Article 3 of this Circular, if they continue to be assigned such work, they will continue to receive their current salary until they transfer jobs, stop working, or retire as prescribed.
2. There is no requirement to reappoint the occupational title of equipment and laboratory staff as stipulated in this Circular for those who have already been appointed according to Circular No. 08/2019/TT-BGDĐT.
Article 9. Effective Date
1. This Circular takes effect from February 12, 2023.
2. In cases where referenced documents in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new documents.
3. This Circular replaces Circular No. 08/2019/TT-BGDĐT.
Article 10. Responsibility for Implementation
Heads of relevant units under the Ministry of Education and Training; Chairpersons of People's Committees of provinces and centrally-administered cities; Directors of provincial Departments of Education and Training, Directors of Departments of Education, Science, and Technology in Bac Lieu Province; related agencies, organizations, and individuals are responsible for implementing this Circular./.
