AMENDING AND ENRICHING 26/2025ARTICLE 15 OF DECREE No. 15/2024/TT-NHNN REGULATING THE PROVISION OF NON-CASH PAYMENT SERVICES
Article 1. Amend and Enrich Article 15
"Article 15. Approval and Extension Procedures for Providing Non-cash Payment Services Without Customer's Account of Postal Service Provider Enterprise 1. Approval Procedure a) Within five days from the date of receipt of complete documents in accordance with Circular No. 52/2024/NĐ-CP dated May 15, 2024 of the Government regulating non-cash payments and any amended or supplementary document (if applicable), the Payment Division shall examine and forward the documents to relevant Departments, Bureaus, and Units under the State Bank for their comments;;
b) Within a maximum of twelve days from the date of receipt of the request from the Payment Division: (i) The Information Technology Bureau shall examine, evaluate, and issue a written confirmation to the Payment Division regarding technical conditions, technological solutions, security capabilities, and the team of technical staff ensuring the provision of non-cash payment services without customer's account of postal service provider enterprise in accordance with legal provisions; (ii) The Anti-Money Laundering Bureau shall review and issue a written evaluation to the Payment Division regarding internal regulations on anti-money laundering, financing terrorism, and proliferation of weapons of mass destruction ensuring the provision of non-cash payment services without customer's account of postal service provider enterprise in accordance with legal provisions; c) Within twenty days from the date of receipt of comments from units under the State Bank, the Payment Division shall compile comments from relevant units, examine the documents, and submit a decision to the Governor of the State Bank approving or rejecting the provision of non-cash payment services without customer's account of postal service provider enterprise in writing..
2. Extension Procedure
a) Within five working days from the date of receipt of complete documents in accordance with Circular No. 52/2024/NĐ-CP dated May 15, 2024 of the Government regulating non-cash payments and any amended or supplementary document (if applicable), the Payment Division shall examine and forward the documents to relevant Departments, Bureaus, and Units under the State Bank for their comments;
b) Within six working days from the date of receipt of the request from the Payment Division:
(i) The Information Technology Bureau shall examine, evaluate, and issue a written confirmation to the Payment Division regarding technical conditions, technological solutions, security capabilities, and the team of technical staff ensuring the provision of non-cash payment services without customer's account of postal service provider enterprise in accordance with legal provisions;
(ii) The Anti-Money Laundering Bureau shall review and issue a written evaluation to the Payment Division regarding internal regulations on anti-money laundering, financing terrorism, and proliferation of weapons of mass destruction ensuring the provision of non-cash payment services without customer's account of postal service provider enterprise in accordance with legal provisions;
c) Within nine working days from the date of receipt of comments from units under the State Bank, the Payment Division shall compile comments from relevant units, examine the documents, and submit a decision to the Governor of the State Bank approving or rejecting the extension of provision of non-cash payment services without customer's account of postal service provider enterprise in writing."
(ii) The Anti-Money Laundering Department shall assess and send a written evaluation to the Payment Department regarding the internal regulations on anti-money laundering, financing of terrorism, and financing of weapons of mass destruction to ensure compliance with the legal requirements for providing payment services without customer accounts by the postal service provider.
c) Within 20 days from the date of receipt of comments from units under the State Bank, the Payment Department shall compile opinions from relevant units, conduct an assessment of the file, and submit a decision to the Governor of the State Bank for approval or rejection in writing regarding the operation of providing payment services without customer accounts by the postal service provider.
2. Renewal Procedure
a) Within 5 working days from the date of receipt of a complete set of documents as specified in Circular No. 52/2024/NĐ-CP dated May 15, 2024 by the Government on non-cash payment and any amendments or supplements thereto, the Payment Department shall examine the file and forward it to relevant departments, offices under the State Bank for their comments;
b) Within 6 working days from the date of receipt of the request document from the Payment Department:
(i) The Information Technology Department shall assess and evaluate, and send a written confirmation to the Payment Department regarding technical conditions, technological solutions, security safeguards, and the team of technical staff ensuring compliance with legal requirements for providing payment services without customer accounts by the postal service provider;
(ii) The Anti-Money Laundering Department shall assess and send a written evaluation to the Payment Department regarding internal regulations on anti-money laundering, financing of terrorism, and financing of weapons of mass destruction to ensure compliance with legal requirements for providing payment services without customer accounts by the postal service provider;
c) Within 9 working days from the date of receipt of comments from units under the State Bank, the Payment Department shall compile opinions from relevant units, conduct an assessment of the file, and submit a decision to the Governor of the State Bank for approval or rejection in writing regarding the renewal of operations for providing payment services without customer accounts by the postal service provider.”.
Article 2. Implementation Responsibility
The heads of units under the State Bank, organizations providing payment services, organizations providing intermediary payment services, and related organizations and individuals shall bear the responsibility for organizing the implementation of this Circular.
Article 3. Enforcement Clause
This Circular shall come into force on May 19, 2026.
