DECISION

On the functions, tasks, organization, and operational regulations of the Prime Minister's Research Board

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

To enhance the quality and effectiveness of the Research Board's operations to meet the requirements of the Prime Minister;

At the proposal of the Head of the Prime Minister's Research Board, the Minister of Home Affairs, the Minister, Chairman of the Government Office,

Article 1. The Prime Minister's Research Board, established pursuant to Decision No. 473/QĐ-TTg dated May 30, 1998 of the Prime Minister (hereinafter referred to as the Research Board), is an advisory body for the Prime Minister on institutional reform, economic, social policies, and administrative state affairs.

Article 2. The Research Board has the following tasks:

1. Assist the Prime Minister in researching and proposing directions and contents for continued institutional and economic, social policy reforms, and administrative matters, selecting breakthroughs in each period.

2. Assist the Prime Minister in providing guidance opinions on the planning of programs to draft regulatory legal documents; propose thoughts, policies, and contents that need to be reformed when drafting important documents mainly concerning economic institutions at the request of the Prime Minister; participate in drafting, reviewing, and amending documents assigned by the Prime Minister.

3. Organize research, editing, or amending reports, projects, and other documents according to the Prime Minister's requests.

4. Perform other tasks assigned by the Prime Minister.

Article 3. To fulfill the tasks set out in Article 2, the Research Board is entitled to:

1. Directly receive assignments and report and propose opinions to the Prime Minister and Deputy Prime Ministers.

2. Be invited to attend meetings of the Government, meetings chaired by the Prime Minister or Deputy Prime Ministers, and meetings of ministries, sectors, and local authorities regarding issues related to the Research Board's tasks.

3. Work with central ministries, local authorities, and grassroots levels, requesting the provision of materials necessary for the implementation of the Research Board's tasks.

4. The Government Office provides documents and materials to meet the Research Board's research needs.

5. Cooperate with domestic experts and research agencies, foreign experts and agencies in research work; accept international sponsorship projects in accordance with current government regulations.

Article 4. The organization of the Research Board includes:

1. The specialized unit of the Board:

- The Head, Deputy Heads, and Members of the Board,

- Experts, specialists, researchers,

- Civil servants and staff engaged in information, documentation, administrative, and management work of the Board.

The total staffing of the specialized unit of the Research Board is approved by the Prime Minister based on the proposal of the Board Head. In the near term, it shall not exceed thirty people (excluding drivers, security guards, and service personnel at the Board's office).

The Head, Deputy Heads, and Members of the Research Board are appointed and transferred by decision of the Prime Minister.

2. Advisory experts and collaborating members of the Board are scientists, managers, and researchers both domestically and some overseas Vietnamese experts working in other agencies or retired, not part of the Board's formal establishment.

Advisory experts are reviewed and decided upon by the Prime Minister for their list and invitation to participate in research and advisory work assisting the Prime Minister, with working conditions and allowances (regular). Some advisory experts have regular working conditions at the Board (advisory experts here refer to those with high expertise in management, science, and specialization, invited by the Prime Minister for advisory roles).

Collaborating members are invited by the Board Head to join research teams in specific fields or temporary research groups and receive remuneration according to current regulations. Some collaborating members have regular working conditions at the Board and receive allowances (regular).

Advisory experts and collaborating members are provided with necessary information and invited to attend conferences, seminars, and surveys organized by the Board both domestically and internationally.

Inviting advisory experts and collaborating members who are overseas Vietnamese residents must comply with current state regulations and be reported to the Prime Minister for approval. The Board Head determines appropriate participation methods suitable for the conditions of overseas advisory experts and collaborating members.

3. The Board Head decides on the organizational structure of the specialized unit of the Board, establishes permanent research teams (when necessary, subcommittees can be formed) organized stably in each research field and forms special topic research groups during each period, dissolving them after completing research tasks.

Article 5. General provisions on the operational regulations of the Board:

1. The Research Board operates under an expert system. Deputy Heads, Board Members, advisory experts, and collaborating members are responsible for accepting assignments from the Head and collectively discussing to report to the Prime Minister, while they may also directly receive instructions from the Prime Minister, report and make proposals to the Prime Minister, including opinions differing from the Board Head.

2. Weekly, the Board Head reports the Board's work and proposals to the Prime Minister. Once a year, the Prime Minister meets with the Board and advisory experts to directly hear opinions and proposals on the Government's and Prime Minister's common work.

3. Based on the tasks outlined in this Decision and specific requirements of the Prime Minister, the Board Head decides on the Board's work program, research requirements for research teams, organizes domestic surveys, and seminars.

Within the framework of international funding projects or requests for research cooperation with foreign countries approved by the Prime Minister, the Director of the Research Board decides on organizing surveys and seminars abroad and proposes to the Minister, Head of the Government Office to decide on dispatching staff within the Research Board's dedicated establishment, consultants, or collaborators to work abroad.

4. Based on the dedicated establishment of the Research Board (as stipulated in Article 4), annually, the Director of the Research Board determines the number of positions to be aggregated into the overall establishment of the Government Office.

5. Based on the proposal of the Director of the Research Board and current regulations of the Party and State, the Minister, Head of the Government Office decides on recruitment, training, appointment, termination of employment, and implementation of policies for staff, civil servants, and employees; stipulates allowances for collaborators of the Research Board.

6. The annual operating budget of the Research Board is separately allocated and consolidated into the budget of the Government Office. Within the approved budget, the Director decides and is responsible for the use of funds in accordance with the financial regulations of the State.

7. Documents of the Research Board are signed by the Director or Deputy Director, and when necessary, the seal of the Government Office with the national emblem may be used.

8. The Government Office arranges workplaces and ensures necessary means and conditions according to current regulations for the activities of the Research Board.

Article 6. Based on the general provisions set out in this Decision, the Director of the Research Board agrees with the Minister, Head of the Government Office specific regulations regarding the relationship between the Research Board and the leadership of the Government Office and other units under the Government Office in coordinating research work, providing information, personnel matters, budget, and ensuring working conditions for the Research Board.

, Clause 1, Clause 2 Article 7a of this Regulation.This Decision takes effect fifteen days from the date of publication in the Official Gazette and replaces Articles 2, 3, 4, 5, 6, and 7 of Decision No. 473/QĐ-TTg dated May 30, 1998 of the Prime Minister and the Operational Regulations of the Research Board issued together with Decision No. 473/QĐ-TTg.

Article 8. The Director of the Research Board of the Prime Minister, the Minister, Head of the Government Office, Ministers, Heads of ministerial-level agencies, and Chairmen of provincial and centrally-administered city People's Committees are responsible for implementing this Decision./.
