DECREE

NUMBER 210/SL ON AUGUST 20, 1948

 

CHAIRMAN OF THE VIETNAM DEMOCRATIC REPUBLIC GOVERNMENT

Pursuant to Decree No. 63 dated November 22, 1945 organizing people's administration at local levels,

Pursuant to Decree No. 13 dated November 24, 1945 organizing courts,

Pursuant to Decree No. 91/SL dated October 1, 1947 organizing People's Committees for Resistance and Administration at provincial, district, and commune levels, amended by Decree No. 156/SL dated March 25, 1948 and subsequent decrees,

Considering the current situation,

At the proposal of the Council of Ministries,

After consulting the Standing Committee of the National Assembly and after the Government Council has agreed,

ISSUES THE DECREE:

Article 1

In addition to the Chairman and Vice-Chairman elected according to the procedure stipulated in Article 9 of Decree No. 91/SL dated October 1, 1947 (amended by Decree No. 156/SL dated March 25, 1948), the members of the Commune People's Committee for Resistance and Administration will elect one member as Secretary from among the five administrative members.

The approval of the election results for the Secretary shall follow the same procedures as those for approving the election results for the Chairman and Vice-Chairman.

Article 2

The Chairman, Vice-Chairman, and Secretary convene to form the Standing Bureau of the Commune People's Committee for Resistance and Administration.

The tasks of the Standing Bureau are defined as follows:

1- To oversee communal judicial affairs as prescribed in Section 1, Chapter I of Decree No. 13 dated January 24, 1946 organizing courts.

2- To resolve urgent issues. For matters related to resistance, they must discuss with the military commissioner and assist this commissioner in timely implementation.

3- To delegate daily tasks to the commissioners.

4- To draft the budget plan.

Article 3

Any provisions contrary to this decree are abolished.

Article 4

The Ministers of Interior, Finance, Economy, Justice, and Defense shall implement this decree accordingly.
