Regarding the supplementation and amendment of certain Articles of the Regulations on the Transport of Overdimensional and Overweight Cargo by Road

Upon consideration of the proposal by the Director of the Vietnam Highway Administration, the Head of the Science and Technology Department, the Head of the Legal Affairs Department, and the Head of the Transport Department,

The supplementation and amendment of certain Articles of the Regulations on the Transport of Overdimensional and Overweight Cargo by Road are as follows:

THE MINISTER OF TRANSPORTATION

WHEREAS, the Road Traffic Law dated June 29, 2001;

Pursuant to Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

1. Supplement Clause 5 to Article 4 as follows:

Pursuant to …;

Article 1. "5. Actual dimensions are the dimensions measured when cargo is loaded onto the transport vehicle, including:

- Length;

- Width;

- Height from the ground."

2. Article 5 is amended as follows:

"Article 5. Overdimensional and Overweight Cargo

1. Overdimensional cargo is indivisible cargo that, when loaded onto a transport vehicle, has one of the following actual dimensions:

- Length greater than 20 meters;

- Width greater than 2.5 meters;

- Height greater than 4.2 meters.

2. Overweight cargo is indivisible cargo with a weight exceeding 32 tons."

3. Amend Clause 1 of Article 6 as follows:

"1. Vehicles transporting overdimensional and overweight cargo must have a carrying capacity and dimensions suitable for the cargo being transported."

The Chief of the Ministry's Office, the Heads of the Legal Affairs Department, the Science and Technology Department, the Transport Department, the Director of the Vietnam Highway Administration, the Director of the Vietnam Vehicle Inspection Agency, the Directors of Provincial and Central City Departments of Transport, the Directors of Provincial and Central City Departments of Transport and Public Works, the Heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Decision.

"1. Means of transport for oversized and overweight cargo must have a carrying capacity and dimensions suitable for the goods being transported."

Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 3. The Head of the Office of the Ministry, the Director of the Legal Department, the Director of the Science and Technology Department, the Director of the Transport Department, the Director of the Vietnam Highway Administration, the Director of the Vietnam Inspection and Registration Agency, the Directors of Provincial Departments of Transportation, the Directors of Provincial Departments of Transport and Engineering under centrally governed cities, the Heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Decision.
