Decision No. 212/2003/QĐ-TTg On the List of State Secrets of Top Secret Level in the Field of Natural Resources and Environment

DECISION OF THE PRIME MINISTER

Regarding the list of State secrets classified as Top Secret in the field of natural resources and environment

PRIME MINISTER 

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Ordinance on Protection of State Secrets dated December 28, 2000;

Pursuant to the Decree No. 33/2002/NĐ-CP dated March 28, 2002 of the Government detailing the implementation of the Ordinance on Protection of State Secrets;

Considering the proposal of the Minister of Natural Resources and Environment and the Minister of Public Security,

DECISION:

Article 1. The list of State secrets classified as Top Secret in the field of natural resources and environment includes information within the following scope:

1. Regarding water resources including:

a) The Party and State's policies on negotiating to establish, maintain, and develop international river basin organizations related to Vietnam; negotiating to protect national interests in activities involving the exploitation, utilization, and protection of international river water resources;

b) Documents serving the demarcation of boundaries on rivers and streams that have not been published or will not be published;

c) Documents on basic surveys of rivers, streams, and border water sources.

2. In the field of geology and minerals: Locations and quantities of precious stones and rare metals.

3. In the field of environment: Information and documents concerning the Party and State's policies related to activities aimed at remedying the consequences of chemical warfare agents used in Vietnam that have not been published or have not yet been published.

4. In the field of meteorology and hydrology:

a) The Party and State's policies on meteorological and hydrological activities serving the protection of national territorial sovereignty;

b) Encrypted forms of communication data, frequencies, and times for exchanging meteorological and hydrological data on specialized communication systems during wartime;

c) Positions and elevation values of key markers at meteorological, hydrological, and marine stations; elevation data and absolute zero levels of marine markers;

d) Topographic materials (horizontal profiles, vertical profiles, river section maps) and actual measured flow velocities at hydrological stations in estuary areas within a range of 50 kilometers from the sea inland.

5. Regarding Surveying and Mapping including:

a) Coordinates of national base points of Class II or higher forming a complete national network along with point annotations;

b) Survey and exploration documents regarding the national border that have not been published.

Article 2. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 3. The Minister of Natural Resources and Environment and the Minister of Public Security are responsible for guiding and supervising the implementation of this Decision.

Article 4. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under the central government are responsible for implementing this Decision./.
