Guidelines for Implementing Decision No. 269/2005/QD-TTg dated October 31, 2005
of the Prime Minister on the allowance for service
Pursuant to Decision No. 269/2005/QD-TTg dated October 31, 2005 of the Prime Minister on the allowance for service, the Ministry of National Defense guides implementation as follows:
I. SCOPE OF APPLICATION
1. Scope of application:
Officers holding the rank of Lieutenant General and officers occupying positions from Commander of Military Region and equivalent positions or higher.
2. Non-applicable Subjects:
Officers belonging to the aforementioned category who have been enjoying the allowance for service as prescribed in Decision No. 205/2004/QD-TTg dated December 10, 2004 of the Prime Minister on the implementation of certain policies and allowances for senior officials.
II. AMOUNT OF ALLOWANCE AND METHOD OF PAYMENT
1. Amount of allowance:
a) The group receiving an allowance of 400,000 VND/month.
- Officers holding the rank of Major General, Admiral.
- Officers occupying the position of Commander of Military Region, Service Branch and equivalent positions with leadership position allowance coefficient currently at 1.20 or higher as stipulated in Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government.
b) The group receiving an allowance of 200,000 VND/month.
- Officers holding the rank of Lieutenant General, Vice Admiral, Major General, Rear Admiral.
- Officers occupying the position of Commander of Military Corps and equivalent positions with leadership position allowance coefficient currently at 1.10 as stipulated in Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government.
2. Method of payment:
a) Officers appointed to a position or promoted to a rank from a given month shall enjoy the allowance for service from that month. If an individual holds multiple positions or different levels of allowance for service based on rank and position, they shall enjoy the highest level of allowance for service.
b) In cases where officers specified in Clause 1, Section I of this Circular are transferred from a position with a higher level of allowance for service to a position with a lower level of allowance for service, they shall retain the higher level of allowance for service for a period of six months.
c) In cases where officers specified in Clause 1, Section I of this Circular have a decision to cease holding a position, retire, or pass away, they shall cease to enjoy the allowance for service from the following month.
d) The allowance for service shall be paid concurrently with monthly salary and recorded under Item 102, Sub-item 08, Article 80, Category 00 in the State budget classification system applicable in the military.
III. EFFECTIVE DATE OF IMPLEMENTATION
This Circular takes effect fifteen days after its publication in the Official Gazette. The allowance for service provisions set forth in this Circular shall apply from the date Decision No. 269/2005/QD-TTg dated October 31, 2005 of the Prime Minister comes into force (November 2005); all previous regulations contrary to this Circular are hereby abolished.
Any issues arising during implementation should be reported to the Ministry of National Defense (through the Policy Department) for consideration and resolution./.
