Considering the proposal of the Director of the General Political Department3. Amend Clause 3 Article 2 as follows:The Ministry of National Defense guides the work of searching for and collecting the remains of烈士as follows:

Scope of application: This Circular guides the work of searching for and collecting the remains of烈士both within and outside the country, including: Propaganda; providing, receiving, reviewing, improving files, building integrated databases on烈士and烈士tombs; organizing forces, ensuring and conducting search and collection activities of烈士remains; international cooperation; summarizing and concluding the work of searching for and collecting烈士remains.;

The Minister of National Defense issues this Circular regulating the awarding of military ranks to graduates of commissioned officer training programs serving in active duty; criteria and standards for promoting commissioned officers to majors and captains beyond grades and before term; increasing pay for commissioned officers to major generals, lieutenant generals, majors, and captains before term.No.Applicability: Agencies, units, localities directly implementing the work of searching for and collecting; organizations and individuals related to the work of searching for and collecting烈士remains.

Chapter I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

2. Organizations, mass organizations, forces assigned tasks by competent authorities to search for and collect烈士remains shall be responsible for searching for and collecting烈士remains that were martyred in wars, and burying them in烈士cemeteries.

Encouragement is given to organizations and individuals providing information about烈士and烈士tombs; participating in searching for and collecting烈士remains; supporting funds, equipment, means, materials, and technical services for the work of searching for and collecting烈士remains.

6. Article 4. Hierarchical management of the work of searching for and collecting烈士remains

7. The Ministry of National Defense assists the Government in state management; uniformly directs the implementation of the work of searching for and collecting烈士remains both within and outside the country.

Ministries and sectors have the responsibility to manage, direct, and guide the organization to implement the contents of searching for and collecting烈士remains according to the decision of the Prime Minister.

1. Military regions have the responsibility to assist the Ministry of National Defense in managing and directing the work of searching for and collecting烈士remains in their military region and outside the country according to the division of labor of the Special Task Committee, the Government's Special Responsibility Committee.

2. Provincial People's Committees (referred to as provincial-level People's Committees) have the responsibility to manage and direct the work of searching for and collecting烈士remains in their locality; manage and direct the work of searching for and collecting烈士remains outside the country according to the division of labor of the Special Task Committee, the Government's Special Responsibility Committee.

3. Military units at regiment level and equivalent and above have the responsibility to guide and organize the implementation of the work of searching for and collecting烈士remains within their scope of responsibility.

4. Professional forces and temporary forces established by competent authorities are the main forces to carry out the mission of searching for and collecting烈士remains.

5. MANAGEMENT AND HANDLING OF INFORMATION ON烈士AND烈士TOMBS

The work of decoding unit symbols and designations in the national liberation war, defense of the homeland, and international duty is carried out in accordance with Directive No. 07/CT-BQP dated March 22, 2010 of the Minister of National Defense.No.The database of decoded unit symbols and designations approved and issued by competent authorities serves as a legal basis for the work of searching for and collecting烈士remains; resolving outstanding policies after the war.ệMartyrs.

Chapter II

SEARCHING FOR AND COLLECTING THE REMAINS OF WAR MARTYRS

PART 1

MANAGEMENT AND HANDLING OF INFORMATION ON MARTYRS AND MARTYRS' GRAVES

Article 5. Decoding unit symbols and designations during wartime

1. The decoding of military unit symbols and designations during the national liberation war, national defense, and international duties shall be carried out in accordance with Directive No. 07/CT-BQP dated March 22, 2010, issued by the Minister of National Defense.

2. The database of decoded symbols and designations of military units approved and promulgated by the competent authority serves as a legal basis for the search and collection of martyrs' remains; resolving outstanding policies after the war.

Article 6. Collection, Review, and Completion of Martyrs' Files and Graves

1. Ministries, sectors, units, and localities have the responsibility to collect, review, and complete martyrs' files and graves under their management.

2. Contents of Collection, Review, and Completion of Martyrs' Files and Graves

a) Review, tally, supplement, determine the quantity, and complete the list of martyrs; identify the initial burial location of martyrs;

b) Constructiony Establish and perfect the database on martyrs and graves; integrate databases to serve the work of searching for and collecting martyrs' remains;

c) HComplete the layout of graves currently managed.

3. Methods of Collection, Review, and Completion of Martyrs' Files and Graves

a) Ministries, sectors, and localities direct subordinate units to review, tally, and complete martyrs' files and lists, and related information on martyrs and graves within their ministries, sectors, and localities; provide such information to military units when requested for unified management and organization of searching for and collecting martyrs' remains;

b) Military units from battalion level and above, and localities from commune level and above receive information about martyrs and graves; review, tally, and supplement missing information; compare, verify, and complete the list of martyrs, identify the initial burial location, and complete the layout of graves;

c) The Policy Department and the General Political Department build an integrated database on martyrs and graves; transfer and guide the use of the database system for agencies, units, and localities; receive, edit, and perfect the integrated database on martyrs and graves.

Article 7. Provision, Reception, and Processing of Information on Martyrs and Graves

1. Organizations and individuals with information on martyrs and graves have the responsibility to provide such information to agencies, units, localities, specialized forces searching for and collecting martyrs' remains, and news agencies and press services to serve the work of searching for and collecting martyrs' remains.

2. Contents of Provision, Reception, and Processing of Information on Martyrs and Graves include: Source of information; location, number of graves, list of martyrs, layout of grave markers, and other relevant characteristics (if any). kAgencies, units, and localities receiving information have the responsibility to check, verify, and process information on martyrs and graves provided by organizations and individuals. When necessary factors are identified and verified, they shall provide such information to search and collection forces.

3. The Office of the National Steering Committee, the permanent agency, simultaneously serves as the central agency assisting the Steering Committees at all levels in receiving, processing, managing, and providing information on martyrs and graves.

4. Article 8. Establishment of Maps and Geographic Information Systems for Searching and Collecting Martyrs' Remains

The map for searching and collecting martyrs' remains is a specialized document reflecting the results of the work of searching for and collecting martyrs' remains: Areas where martyrs have been buried and searched for and collected; areas with information but not fully searched and collected, requiring further search and collection; areas with information on martyrs' burials but unclear specific locations; areas yet to be searched and collected.ệMartyrs

1. The map for searching and collecting martyrs' remains is established according to administrative boundaries at three levels: Commune, district, and provincial levels.hBasis for establishing maps and contents of maps

2. Administrative boundaries as prescribed by competent authorities;

a) Results of reviews and verifications regarding martyrs, graves, and martyrs' cemeteries;

- Information on graves provided by units, localities, organizations, and individuals;

- Practical experiences in searching for and collecting martyrs' remains in localities.

- Contents of maps

- The map for searching and collecting martyrs' remains fully reflects elements related to the task of searching for and collecting martyrs' remains:

b) Number of martyrs who died in the area;

Areas with martyrs' graves that have been searched for and collected;

- Areas that have been searched and collected but still require continued search and collection of remains; estimated number of graves needing continued search and collection;

- Areas with martyrs' graves that have not been searched and collected;

- Areas with information on martyrs' burials but unclear specific locations;

- Organization of forces and means for searching and collecting martyrs' remains;

- Other relevant elements.

- Procedures and responsibilities for establishing maps for searching and collecting martyrs' remains

- Local military agencies at all levels take the lead, assist People's Committees in receiving and processing information; survey, verify, and conclude on the contents as stipulated in Point b, Clause 2 of this Article;

3. Organize inter-sectoral meetings at each level, chaired by the Chairman of the People's Committee, including members from Military Affairs, Public Security, Veterans, Labor - Invalids and Social Affairs, Elderly People, and other components as specified by the Chairman of the People's Committee, to conclude on the contents of the map;

a) Based on conclusions on the contents of the map, local military agencies at all levels take the lead, assist People's Committees in compiling and establishing the map for searching and collecting martyrs' remains in their locality;

b) Annually, the Chairmen of People's Committees at all levels direct reviews, adjustments, and supplements to the contents of the map for searching and collecting martyrs' remains based on implementation results;

c) d) The Policy Department of the General Political Department takes the lead, coordinating with the Mapping Department of the General Staff to guide the procedures for establishing maps for searching and collecting martyrs' remains. Based on the map for searching and collecting martyrs' remains and information on martyrs and graves provided by organizations, individuals, and localities, review, verify, classify, and compile to establish a geographic information system serving management, searching for, and collecting martyrs' remains nationwide.

d) ORGANIZATION OF FORCES AND GUARANTEES FOR THE WORK OF SEARCHING FOR AND COLLECTING MARTYRS' REMAINS

d) The Policy Department of the General Political Directorate shall take the lead and coordinate with the Map Department of the||| General Staff to provide guidance on the procedures for creating maps for searching and collecting martyrs' remains. Based on these maps and information about martyrs and their graves provided by organizations, individuals, and localities, review, compare, classify, and compile to build a Geographic Information System serving the management, search, and collection of martyrs' remains nationwide.No.geographic information for management, search, and collection of烈士遗骸 throughout the country.

PART 2

ORGANIZATION OF FORCES AND GUARANTEES FOR THE SEARCH AND COLLECTION OF MARTYRS' REMAINS

Article 9. National Steering Committee for Searching and Collecting Remains of Martyrs

1. The National Steering Committee for Searching and Collecting Remains of Martyrs (referred to as the National Steering Committee 1237) was established pursuant to Decision No. 1753/QĐ-TTg dated September 30, 2013 of the Prime Minister on the establishment of the National Steering Committee for Searching and Collecting Remains of Martyrs from now until 2020 and subsequent years.

2. The tasks and powers of the National Steering Committee 1237 are stipulated in Article 2 of Decision No. 1753/QĐ-TTg dated September 30, 2013 of the Prime Minister.

3. The Office of the National Steering Committee 1237 is the assisting agency of the Committee, operating under the Regulation issued pursuant to Decision No. 249/QĐ-BCĐQG 1237 dated November 7, 2013 of the Chairman of the Committee. The organization, staffing, functions, tasks, and powers of the Office of the National Steering Committee 1237 are reviewed and decided by the Deputy Chairman in charge of the National Steering Committee.

Article 10. Military Region Steering Committee for Searching and Collecting Remains of Martyrs

1. The Military Region Steering Committee for Searching and Collecting Remains of Martyrs is established by the Commander of the Military Region, including:

a) Chairman of the Steering Committee; Deputy Political Commissar of the Military Region khu;

b) Deputy Chairmen of the Steering Committee:无效 Command:

- Deputy Chairman in Charge: Head of the Political Department of the Military Region;

- Deputy Chairman: Head of the General Staff Department of the Military Region.

c) Various The Members of the Steering Committee include: Representatives of Heads of Departments: Politics, Logistics, Engineering; Heads of Offices: Policy, Cadres, Propaganda, Military Forces, Training, Maps, and Finance within the Military Region.

2. Tasks and Powers of the Steering Committee

The Military Region Steering Committee is responsible for assisting the Commander and Political Commissar of the Military Region in implementing, managing, directing, and guiding the work of searching and collecting remains of martyrs in the assigned area, with the following tasks:

a) Directing and coordinating the cooperation among agencies, units, and localities in organizing 3. The Department of Finance is responsible for advising the provincial People's Committee to issue the list of members of the Land Price Table Review Council, the Land Price Review Council, and the assisting team of the Council (if any) in accordance with the law. the implementation of the work of searching and collecting remains of martyrs in the area; directing the work of searching and collecting remains of martyrs outside the country according to the division of labor of the Special Task Force and the Government's Special Commission;

b) Inspecting, urging, evaluating the results of the work of searching and collecting remains of martyrs, resolvingpoliciesissues arising in the implementation and periodically reporting, summarizing the results of the work of searching and collecting remains of martyrs in the area to the Ministry of Defense and the National Steering Committee 1237.policiesSummarizing and concluding experiences in the work of searching and collecting; proposing

c) commendations for sector of individuals with outstanding achievements in implementing,developmentthe work of searching and collecting remains of martyrs. a) Report to the Ministry of Natural Resources and Environment on the results of training and upgrading, including listing the teaching staff participating in teaching, evaluating the participation of trainees in the training process, the results of organizing examinations for completing the training and upgrading program on land valuation business, the issuance of Certificates and the use of Certificate codes, summarizing the feedback from trainees on the quality of the training and upgrading program on land valuation business, and other relevant matters. Activities of the Steering Committee

3. The Chairman of the Steering Committee promulgates the Regulation on the organization and operation of the Military Region Steering Committee; assigns specific tasks to members of the Steering Committee;

a) The Military Region Steering Committee operates under a responsibility system;

b) Military Region Steering Committeetooperates under a rotational duty system;êresponsibility;

c) The Chairman and Deputy Chairmen of the Steering Committee use the seal of the Military Region Command and their own agencies.

4. Permanent Office of the Steering Committee

The Political Department is the permanent office of the Military Region Steering Committee. Assisting the Permanent Office is the Military Region Policy Office and some part-time staff, with the following tasks:

a) Building plans, guiding, and serving the Military Region Steering Committee; inspecting and guiding units and localities in implementing; summarizing reports on results and preparing plans, contents for summarizing and concluding experiences in the work of searching and collecting remains of martyrs in the Military Region;hMonitoring, grasping situations, proactively coordinating with relevant agencies, units, and localities to handle issues arising in the implementation; guiding implementation and inspecting tasks that have been approved or proposed to be implemented;

b) Preparing budget estimates and plans to ensure funding for the task of searching and collecting remains of martyrs and ensuring the operation of the Military Region Steering Committee; implementing reporting procedures as prescribed.

c) Prepare budget estimates and plans to ensure the search and collection of martyrs' remains and the activities of the Military Region Steering Committee; implement reporting procedures as prescribed.

Article 11. Steering Committee for Searching and Collecting Remains of Martyrs in Provinces and Central Cities

1. The Steering Committee for Searching and Collecting Remains of Martyrs in provinces and central cities (referred to as the Provincial Steering Committee 1237) shall be established by the Chairman of the People's Committee at the provincial level.

2. Members of the Steering Committee include:

a) Chairperson of the Steering Committee: Deputy Chairman of the Provincial People's Committee.

b) Deputy Chairpersons of the Steering Committee:

- Permanent Deputy Chairperson: Political Commissar of the Military Command of the province.

- Deputy Chairperson: Representative leader of the Department of Labor, Invalids and Social Affairs.

c) Various The Members of the Steering Committee include representatives from the leaders of departments and sectors: Public Security, Finance, People's Committee Office, Propaganda Department, Vietnam Fatherland Front, Association of Former Combatants; Heads of Border Guard Command, Military Command, and other Staff and Political Departments of the Military Command.||| Provincial Military Command.

For provinces and cities where the number of remains of martyrs that need to be searched for, exhumed, and collected on the territory is still large, additional members of the Steering Committee may be added, but the total number shall not exceed fifteen people. The Duties and responsibilities of the Steering Committee

3. The provincial Steering Committee is responsible for assisting the Chairman of the People's Committee at the provincial level in implementing, managing, and carrying out the work of searching for and collecting remains of martyrs within their territory, with the following tasks:onDirecting and managing agencies, units, and localities to organize the implementation of the work of searching for and collecting remains of martyrs within their territory; directing the work of searching for and collecting remains of martyrs outside the country according to the division of labor of the Special Task Force Board and the Government Special Responsibility Board;

Regularly inspecting, urging, evaluating the results of the work of searching for and collecting remains of martyrs, resolving any difficulties arising locally, and periodically reporting the results of the implementation of the work of searching for and collecting remains of martyrs to the Military Region Steering Committee for consolidation; reporting to the Ministry of National Defense and the National Steering Committee 1237.

a) Summarizing experiences, proposing commendations for collectives and individuals who have achieved success in implementing the work of searching for and collecting remains of martyrs.ograms andThe Chairperson of the Steering Committee promulgates the Rules on the organization and operation of the provincial Steering Committee; assigns specific tasks to members of the Steering Committee;

b) The provincial Steering Committee operates under a concurrent position system; the office assisting the provincial Steering Committee is located at the Military Command of the province;

c) The Chairperson of the Steering Committee uses the seal of the People's Committee at the provincial level; Deputy Chairpersons and members of the Steering Committee use the seals of their respective agencies and units;

4. The Chairman of the Steering Committee promulgates the Regulation on the organization and operation of the Military Region Steering Committee; assigns specific tasks to members of the Steering Committee;

a) The provincial Steering Committee coordinates in directing, together with the Special Task Force Board and the Provincial Special Responsibility Board, to implement the task of searching for and collecting remains of martyrs in Laos and Cambodia within the scope and tasks assigned, in accordance with international practices.

b) The permanent office of the provincial Steering Committee

c) The Political Department of the Military Command of the province is the permanent office of the Steering Committee, assisting the permanent office is the Policy Board and some concurrently appointed cadres, with the following tasks:

d) Assisting the Steering Committee in implementing and managing all aspects of the work of searching for and collecting remains of martyrs within their territory;

Drafting plans, providing guidance, serving the provincial Steering Committee in inspecting units and localities in implementing the work of searching for and collecting remains of martyrs; consolidating and reporting results, preparing plans and contents for summarizing experiences in the work of searching for and collecting remains of martyrs within their territory;

Monitoring, grasping situations, proactively guiding the implementation with relevant agencies, units, and localities; handling any difficulties and regularly inspecting implemented work;

a) Preparing budgets to ensure the task of searching for and collecting remains of martyrs and ensuring the activities of the provincial Steering Committee, consolidating and reporting to the Military Region Steering Committee and the Office of the National Steering Committee 1237.

b) Professional forces for searching and collecting remains of martyrs

c) The professional forces for searching and collecting remains of martyrs are the Collection Teams that have been established by the Ministry of National Defense, managed and directed by agencies and units under the Ministry of National Defense; they carry out the work of searching for and collecting remains of martyrs both domestically and internationally.õUnits and localities that need to establish new specialized teams shall report to the Minister of National Defense for consideration and decision. coordinate The organization, staffing, and equipment of the forces for searching and collecting remains of martyrs shall be stipulated by the General Staff.

d) Prepare budget estimates to ensure the search and collection of martyrs' remains and the activities of the Provincial Steering Committee, consolidate and report to the Military Region Steering Committee and the Office of the National Steering Committee 1237.

Article 12. Organization in force specialized forces for searching and collecting martyrs' remains

1. Specialized forces for searching and collecting martyrs' remains consist of Collection Teams established by the Ministry of National Defense, managed and directed by departments and units under the Ministry of National Defense; they carry out the search and collection of martyrs' remains both domestically and abroad.oUnits and localities that need to establish new specialized teams must report to the Minister of National Defense for consideration and decision.

2. The organization, staffing, and equipment of the search and collection forces are regulated by the General Staff.

3. Provincial Steering Committees must develop plans, seek opinions from the Military Region Steering Committee before submitting them for approval by the Chairman of their own Steering Committee;

Article 13. Temporary forces; conscription of supporting forces

1. Temporary forces

a) Based on information about the remains of martyrs that need to be searched for and collected, units and localities establish plans and propose the organization of temporary forces to report to the Ministry of National Defense for consideration and decision.

b) The number of personnel in temporary forces consists of officers, soldiers, and technical staff from various units, as specified by the unit; the temporary force will be disbanded after completing its mission.

2. Conscription of supporting forces

a) Composition of conscripted forces

- Guiding force: These are individuals who have accurate information about the graves of martyrs, are healthy, and directly guide the search and collection of the remains of martyrs.

- Protective force: Organizations and individuals participating in protecting the search and collection forces during the execution of their tasks in areas requiring protection.

- Auxiliary digging and excavation force: This is the People's Militia, Self-Defense Force, and civilians in the locality, mobilized to participate in the collection and under the command of the unit organizing the search and collection.

b) At all levels, the Steering Committee bases on the proposals of the Standing Office or specialized teams searching for and collecting the remains of martyrs; checks, verifies, and decides on the composition of conscripted forces suitable for the requirements of the mission.

c) Conscripted forces are responsible for ensuring accurate information; guaranteeing absolute safety for the search and collection forces of the remains of martyrs; they must cooperate closely and be subject to the command of the unit searching for and collecting the remains of martyrs.

d) Conscripted forces enjoy benefits according to regulations.

Article 14. Ensuring equipment and means

1. The content of ensuring equipment and means is implemented according to the Prime Minister's regulations on the system, policies, and mechanisms to ensure the work of searching for and collecting the remains of martyrs and the guidance of the Ministry of National Defense and the National Steering Committee 1237.

2. Annually, based on the requirements of the search and collection tasks of each locality and unit, at all levels, the Steering Committee establishes plans for ensuring and reports them to the Military Region Steering Committee for consolidation, reporting to the National Steering Committee 1237 and the Ministry of National Defense.

Article 15. International relations regarding the search and collection of the remains of martyrs

1. Content of international cooperation in the search and collection of the remains of martyrs

a) Collecting and processing information about martyrs and their graves;

b) Sharing experiences in searching for military personnel killed, missing, or missing in action during wars;

c) Exchanging and receiving material foundations and equipment serving the work of searching for and collecting the remains of martyrs;

d) Coordinating to organize activities for searching for and collecting the remains of martyrs;

d) Other activities according to cooperative requirements serving the work of searching for and collecting the remains of martyrs.

2. Partners in cooperative relations for searching and collecting the remains of martyrs

a) Countries with the remains of martyrs of Vietnam;

b) Countries with direct participation in the war in Vietnam;

c) Countries with large numbers of military personnel killed in wars; countries with experience in the work of searching for and collecting the remains of military personnel killed after wars;

d) Relevant organizations and individuals.

PART 3

ACTIVITIES FOR SEARCHING AND COLLECTING THE REMAINS OF MARTYRS

Article 16. Building plans for searching and collecting the remains of martyrs

1. Responsibilities for establishing and approving plans

a) Based on the search and collection tasks of the remains of martyrs of each locality and unit, annually, the Provincial Military Command (and equivalent) assists the Provincial Steering Committee in building plans to seek opinions from the Military Region Steering Committee before submitting to the Chairman of their own Steering Committee for approval..The provincial plan is consolidated into the plan of the Military Region Steering Committee.无效 resources; budget estimates and other aspects of support.
