DECISION

Regulations on functions, tasks, powers

and the organizational structure of the International Cooperation Department

THE MINISTER OF FINANCE

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Considering the proposal of the Head of the International Cooperation Department and the Head of the Organization and Cadres Department,

DECISION:

Article 1. Position and Functions

The International Cooperation Department is a unit under the Ministry of Finance, having the function of advising and assisting the Minister of Finance in implementing tasks related to international economic integration and international financial cooperation within the scope of the Ministry of Finance's administrative management; managing programs and projects with foreign sponsorship for the Ministry of Finance; organizing the implementation of the Ministry of Finance’s external affairs work.

Article 2. Task

1. Submit to the Minister of Finance:

a) Projects and draft normative legal documents on international cooperation in fields within the scope of the Ministry of Finance's administrative management;

b) Strategies, action programs, long-term, medium-term, and annual plans on international cooperation of the Ministry of Finance;

c) Documents specifying responsibilities and coordination relationships between organizations and units of the Ministry of Finance in performing assigned international cooperation tasks.

2. Organize the implementation and guide, inspect organizations and units under the Ministry in carrying out normative legal documents, policies, strategies, action programs, and plans on international cooperation that have been approved.

3. Participate in drafting strategies, projects, and draft normative legal documents related to fields within the functions and tasks of the Department.

4. Regarding international economic integration:

a) Take the lead in coordinating with organizations and units inside and outside the Ministry to develop negotiation plans for the Ministry of Finance's international economic integration; participate in providing opinions with other ministries and sectors during the process of developing negotiation plans according to the assignment of the Minister of Finance;

b) Take the lead or participate in negotiation teams, or officially represent the Ministry of Finance in government negotiation teams or other agencies' negotiation teams with foreign partners based on approved negotiation plans on international economic integration and according to the assignment of the Minister of Finance;

c) Coordinate with organizations and units under the Ministry to implement international commitments within the scope of the Ministry of Finance's international integration and supervise the organization of their implementation;

d) Manage members of the Ministry of Finance at representative offices of Vietnam at the World Trade Organization and other international organizations according to the assignment of the Minister of Finance.

5. Regarding international financial cooperation:

a) Take the lead in coordinating with relevant organizations and units to prepare content proposals, agreements, and commitments on international financial cooperation of the Ministry of Finance;

b) Serve as the focal point for implementing macroeconomic surveillance mechanisms to serve regional and international financial cooperation tasks;

c) Represent the Ministry of Finance in organizing or participating in international financial cooperation activities based on approved content proposals, agreements, and commitments and according to the assignment of the Minister of Finance;

d) Take the lead in coordinating with relevant organizations and units to plan, coordinate, monitor, and report on the implementation of international financial cooperation agreements and commitments that have been approved by competent authorities.

6. Regarding program and project management:

a) Take the lead in preparing and submitting to the Ministry for approval comprehensive and annual plans on funding needs in various fields of the Ministry of Finance;

b) Organize fundraising efforts or support units in fundraising for programs, projects, and specific areas of cooperation of the Ministry of Finance;

c) Coordinate with related units to support and guide project leaders or units tasked with preparing project documentation; take the lead or coordinate with units to review project documentation;

d) Coordinate with units to negotiate and sign programs and projects with foreign partners according to the assignment of the Minister of Finance;

đ) Coordinate with the Organization and Cadres Department (Ministry of Finance) to determine the organizational structure and personnel to implement programs and projects for submission to the Minister of Finance for approval;

e) Take the lead in coordinating with related units to monitor and evaluate the implementation of programs and projects; propose measures to resolve difficulties and obstacles during implementation; advise the Minister of Finance on improving the management of programs and projects of the Ministry of Finance;

g) Take the lead in preparing comprehensive reports on the implementation of programs and projects of the Ministry of Finance, submit to the Minister of Finance for approval to report to competent authorities and relevant agencies as prescribed by law.

7. Regarding external affairs work:

a) Develop regulations, guidelines, and inspect organizations and units under the Ministry, and international cooperation program management boards in implementing state and Ministry of Finance regulations on external affairs work;

b) Coordinate with units to prepare necessary documents, texts, and related issues to serve leadership of the Ministry or heads of organizations and units in exchanging and working with foreign partners on international cooperation and international integration contents of the Ministry of Finance;

c) Aggregate and develop annual plans on outbound and inbound delegations of the Ministry of Finance;

d) Organize the implementation of translation, interpretation work, and external reception and protocol work as prescribed;

đ) Directly carry out or assist staff and civil servants of units and organizations under the Ministry (excluding organizations authorized to manage cadres) and foreign experts of technical assistance projects in handling procedures for passports and visa issuance for entry and exit;

e) Handle, manage, and store incoming and outgoing documents related to the Ministry's external activities.

8. Take the lead or coordinate with organizations and units inside and outside the Ministry to organize publicity, dissemination, and provision of information on international cooperation activities within the scope of the Ministry of Finance's administrative management as prescribed by law.

9. Organize the implementation of information reporting systems on the performance of assigned tasks as prescribed by the Ministry.

10. To carry out scientific research or cooperate in scientific research with units inside and outside the sector according to plans and contents approved by competent authorities.

11. To perform other tasks and powers assigned by the Minister of Finance and as prescribed by law.

Article 3. Organizational Structure

The International Cooperation Department has a Director and several Deputy Directors.

The Director of the International Cooperation Department is responsible to the Minister of Finance for all activities of the Department; manages civil servants and assets allocated in accordance with regulations.

The Deputy Director of the International Cooperation Department is responsible to the Director for the assigned tasks.

The International Cooperation Department has the following divisions:

1. Division of International Economic Integration.

2. Division of International Financial Cooperation.

3. Division of Program and Project Management.

4. Division of External Relations.

Specific tasks of the divisions are stipulated by the Director of the International Cooperation Department.

The International Cooperation Department operates under a divisional structure combined with a specialist system. For tasks carried out under the specialist system, the Director assigns duties to staff and civil servants in accordance with their positions, standards, and professional capabilities to ensure the completion of assigned tasks.

The staffing of the International Cooperation Department is decided by the Minister of Finance.

Article 4. Responsibilities and Powers of The Director of the International Cooperation Department

1. Organizes, directs, and implements tasks as prescribed in Article 2 of this Decision.

2. Requests organizations and units under the Ministry to provide information and documents to serve the implementation of tasks related to international economic integration, international financial cooperation, program and project management, and external affairs of the Ministry of Finance.

3. Directly transacts or signs transaction letters with foreign partners to implement assigned tasks as prescribed.

5. Signs guiding documents, explanations, and responses to issues arising from the implementation of legal regulatory documents on international cooperation of the Ministry of Finance and documents signed upon delegation or authorization of the Minister of Finance in accordance with the Ministry's working regulations.

Article 5. Effectiveness and Responsibility for Implementation

This Decision takes effect from the date of signing and replaces Decision No. 164/2003/QĐ-BTC dated September 25, 2003 of the Minister of Finance on the functions, tasks, powers, and organizational structure of the International Cooperation Department.

The Director of the International Cooperation Department, the Director of the Cadre and Civil Servant Organization Department, the Head of the Ministry of Finance’s Office, and the Heads of organizations and units under the Ministry of Finance are responsible for implementing this Decision./.
