Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 25/CP dated May 23, 1993 of the Government providing temporarily the new salary system for civil servants, administrative and public service officials, and armed forces personnel;

Pursuant to Decree No. 34/CP dated June 1, 1996 of the Government guiding the implementation of the Ordinance on Prevention and Control of Infection with Human Immunodeficiency Virus (HIV/AIDS);

At the proposal of the Minister of National Defense,

DECISION:

Article 1. Wardens, Deputy wardens, detention assistants, correctional officers, health staff, and guards working at detention centers under the military forces who regularly come into direct contact with individuals infected with HIV/AIDS shall be entitled to receive allowances at one of the following two levels:

- Level 1: VND 120,000 per person per month, applicable to detention centers where the proportion of inmates infected with HIV/AIDS is 10% or more of the total number of individuals.

- Level 2: VND 100,000 per person per month, applicable to detention centers where the proportion of inmates infected with HIV/AIDS is less than 10% of the total number of individuals.

Article 2. Military personnel and defense workers who become infected with HIV/AIDS as a result of being attacked by criminals while performing their duties shall be entitled to medical examination and treatment according to regulations; they shall also enjoy the policy for disabled veterans; if they die, they may be recognized as martyrs according to the conditions, criteria, and procedures stipulated in Decree No. 28/CP dated April 29, 1995 of the Government detailing and guiding the implementation of certain provisions of the Ordinance on Preferential Treatment for Revolutionary Activists, Martyrs, and Families of Martyrs, War Invalids, War Veterans, and Individuals Who Have Contributed to the Revolution.

Article 3. The funds for the regimes prescribed in Article 1 and Article 2 of this Decision shall be provided from the state budget within the annual regular expenditure budget of the Ministry of National Defense.

Article 4. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 5. The Ministry of National Defense shall take the lead and coordinate with the Ministry of Labor, Invalids and Social Affairs, the Ministry of Home Affairs, and the Ministry of Finance to guide the implementation of this Decision.

Article 6. The Ministers, Heads of ministerial-level agencies, Heads of agencies attached to the Government, Chairpersons of People's Committees of provinces and centrally governed cities, and Heads of related agencies are responsible for implementing this Decision.
