Pursuant to the Law on Fees and Registration Fees dated November 25, 2015;

Pursuant to the State Budget Law dated June 25, 2015;

Pursuant to Decree No. 120/2016/NĐ-CP dated August 23, 2016 of the Government detailing and guiding the implementation of certain provisions of the Law on Fees and Charges;

Pursuant to Decree No. 215/2013/NĐ-CP dated December 23, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

At the proposal of the Director of the Department of Tax Policy,

The Minister of Finance issues this Circular to stipulate the levels of collection, collection procedures, management, and utilization of fees for assessing security conditions; examination fees for issuing security guard vocational certificates; registration fees for fireworks management permits; registration fees for weapons, explosives, and auxiliary tools management permits.

Article 1. Scope of Regulation and Applicability

1. This Circular stipulates the levels of collection, collection procedures, management, and utilization of fees for assessing security conditions; examination fees for issuing security guard vocational certificates; registration fees for fireworks management permits; registration fees for weapons, explosives, and auxiliary tools management permits.

2. This Circular applies to individuals and organizations that pay fees for assessing security conditions; examination fees for issuing security guard vocational certificates; registration fees for fireworks management permits; registration fees for weapons, explosives, and auxiliary tools management permits, as well as other relevant organizations and individuals involved in the collection, payment, management, and utilization of fees for assessing security conditions; examination fees for issuing security guard vocational certificates; registration fees for fireworks management permits; registration fees for weapons, explosives, and auxiliary tools management permits.

Article 2. Fee and Charge Payers

1. Organizations and individuals who are assessed by authorized public security agencies to obtain certificates confirming their compliance with security and public order conditions for operating certain businesses must pay fees for assessing security conditions; individuals who are examined by authorized state agencies to obtain security guard vocational certificates must pay examination fees for issuing security guard vocational certificates.

2. Agencies and organizations that are granted fireworks import/export permits by authorized public security agencies must pay registration fees for fireworks management permits; those granted permits for using, transporting, purchasing, carrying, and repairing weapons, explosives, and auxiliary tools must pay registration fees for weapons, explosives, and auxiliary tools management permits.

Article 3. Organizations collecting fees and charges

Public security agencies authorized to assess security and public order conditions, conduct examinations for issuing security guard vocational certificates, issue fireworks import/export permits, and issue weapons, explosives, and auxiliary tools management permits are the entities collecting fees and registration fees.

Article 4. Rates of Fees and Charges

The levels of fees for assessing security conditions; examination fees for issuing security guard vocational certificates; registration fees for fireworks management permits; registration fees for weapons, explosives, and auxiliary tools management permits shall be implemented according to the Fee and Registration Fee Collection Table attached to this Circular.

Article 5. Subjects Exempted from Payment of Registration Fees

The subjects exempted from payment of registration fees for managing weapons, explosives, and auxiliary tools include:

1. Organizations and units under the People's Public Security Forces, village police forces, neighborhood watch organizations, and mass organizations maintaining security and public order at the commune level that are equipped and use weapons and auxiliary tools for combat and national security maintenance and social public order;

2. Organizations and individuals under the main force troops, border guards, coast guard, local troops, and self-defense forces;

3. Guards protecting the country's leaders and heads of government, and those designated

Article 6. Declaration, Payment of Fees and Charges

1. By the fifth day of each month, fee collection organizations must deposit the collected fee amount of the previous month into the account for pending budget payments opened at the State Treasury.

2. Entities collecting fees and registration fees shall declare and pay the collected fees and registration fees monthly, and settle accounts annually in accordance with Clause 3, Article 19, and Clause 2, Article 26 of Circular No. 156/2013/TT-BTC dated November 6, 2013, issued by the Minister of Finance guiding the implementation of certain provisions of the Law on Tax Administration; the Law Amending and Supplementing Certain Provisions of the Law on Tax Administration, and Decree No. 83/2013/NĐ-CP dated July 22, 2013 of the Government.

Article 7. Management of Fees and Stamp Duties

1. Entities collecting fees may retain 90% of the collected fees to cover expenses as specified in Article 5 of Decree No. 120/2016/NĐ-CP dated August 23, 2016 of the Government. They shall remit 10% of the collected fees to the State budget according to the chapters and sub-items of the current State Budget Classification.

2. Entities collecting registration fees shall remit 100% of the collected registration fees to the State budget according to the chapters and sub-items of the current State Budget Classification. The costs for implementing tasks and collecting registration fees shall be covered by the State budget within the organization's budget estimates in accordance with the State budget expenditure regulations.

Article 8. Implementation organization

1. This Circular takes effect from January 1, 2017, and replaces Circular No. 193/2010/TT-BTC dated December 2, 2010, issued by the Minister of Finance, which stipulates the collection, payment, management, and utilization of fees for assessing security and public order conditions; examination fees for issuing security guard vocational certificates; registration fees for stamp registration certificates; registration fees for fireworks import/export permits; registration fees for weapons, explosives, and auxiliary tools management permits.

2. Other contents related to the collection, payment, management, utilization, receipt documentation, and publicizing the fee and registration fee collection system not mentioned in this Circular shall be implemented in accordance with the Law on Fees and Registration Fees, Decree No. 120/2016/NĐ-CP dated August 23, 2016 of the Government; Circular No. 156/2013/TT-BTC dated November 6, 2013, issued by the Minister of Finance; Circulars of the Minister of Finance on printing, issuing, managing, and utilizing various types of fee and registration fee receipts under the State budget, and any amendments or replacements thereof (if any).

3. During the implementation process, if there are any difficulties, organizations and individuals are requested to promptly report to the Ministry of Finance for research and supplementary guidance.
