RESOLUTION OF THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY

Regarding attire for courts, judge identification cards and associate judges

 

NATIONAL ASSEMBLY STANDING COMMITTEE

Pursuant to Article 91 of the Constitution of the Socialist Republic of Vietnam in 1992 and Article 42 of the Organization Law of the People's Courts;

At the proposal of the Minister of Justice and the President of the Supreme People's Court.

 

RESOLUTION:

Article 1.

Judges, staff members of people's courts at all levels shall be provided with attire including:

Autumn-winter clothing, spring-summer clothing;

Ao long-sleeved shirt;

tie;
Ao raincoat;

leather shoes, socks, backstrap sandals.

In addition to the above, judges shall also be provided with:

file case.

Article 2.

1. The form and color of the attire for judges; the form and color of the attire for staff members of people's courts at all levels shall be decided by the Minister of Justice in consultation with the President of the Supreme People's Court.

2. Attire for military courts at all levels shall be applied according to the regulations on attire for the Vietnam People's Army.

The trial attire for judges of military courts at all levels shall be in accordance with the ceremonial uniform regulations for officers of the Vietnam People's Army.

Article 3.

The attire shall be issued for use according to the following service periods:

Autumn-winter clothing: every three years;

Spring-summer clothing: every two years, with the first issue being two sets;

Long-sleeved shirt: every two years;

Tie: every five years, two ties;

Leather shoes: every two years;

Socks: every year;

Raincoat: every two years;

Backstrap sandals: every year;

File case: every five years.

Article 4.

Judges and associate judges of the Supreme People's Court, judges and associate judges of the Central Military Court shall be provided with judge identification cards and associate judge identification cards by the President of the Supreme People's Court.

Judges and associate judges of local people's courts, judges and associate judges of military courts at military regions and equivalent units, judges and associate judges of military courts in regions shall be provided with judge identification cards and associate judge identification cards by the Minister of Justice.

Article 5.

The judge identification card has dimensions of 100 mm in length and 70 mm in width, consisting of two pages displayed as follows:

The upper left corner has a raised national emblem, and the lower left corner is the photograph of the judge.

The words "Judge Identification Card" are printed in red, while the rest are printed in black.

If it is an identification card for a judge of the Supreme People's Court, the phrase "Minister of Justice" shall be replaced with "President of the Supreme People's Court."

b) Page 2. White background with embossed floral patterns in light pink, from the bottom left corner to the top right corner is a red stripe 15 mm wide, with a yellow star 12 mm in diameter in the center.

Article 6.

The associate judge identification card has dimensions of 100 mm in length and 70 mm in width, consisting of two pages displayed as follows:

a) Page 1. White background with floral patterns and national emblem in light yellow, stating:

If it is an identification card for a military associate judge, the phrase "Associate Judge Identification Card" shall be replaced with "Military Associate Judge Identification Card."

The upper left corner has a raised national emblem, and the lower left corner is the photograph of the associate judge.

For associate judges of the Supreme People's Court and the Central Military Court, the phrase "Minister of Justice" shall be replaced with "President of the Supreme People's Court."

b) Page 2. White background with floral patterns in light yellow, stating "State agencies, armed forces, economic organizations, social organizations that have elected or appointed associate judges shall create conditions for them to fulfill their duties."

Article 7.

When performing tasks, judges and court staff must wear the prescribed attire; judges and associate judges must carry their judge identification cards and associate judge identification cards.

Article 8.

Judges and associate judges may not use their judge identification cards and associate judge identification cards for personal gain; they may not use these cards instead of introduction letters, identity cards, or for personal matters.

Upon losing their judge identification cards or associate judge identification cards, they must immediately report to the nearest police station and the President of the court where they work.

Article 9.

When a judge is dismissed or relieved of duty, and an associate judge is removed or relieved of duty, the President of the Supreme People's Court or the Minister of Justice shall recall their judge identification cards and associate judge identification cards.

Article 10.

Judges and associate judges who violate the regulations on the use of judge identification cards and associate judge identification cards shall be subject to disciplinary action or criminal responsibility depending on the severity of the violation, as stipulated by law.

Article 11.

Those who are not judges or associate judges but use judge identification cards and associate judge identification cards to perform illegal activities in any form shall be subject to administrative penalties, disciplinary action, or criminal responsibility depending on the severity of the violation, as stipulated by law.

Article 12.

The Government and the Supreme People's Court shall be responsible for implementing this Resolution within their respective powers and responsibilities./.
