Regarding uniforms for staff and officials of the prosecution sector and

identification cards for prosecutors

SOCIALIST REPUBLIC OF VIET NAM

Based on the Constitution of the Socialist Republic of Vietnam in 1992, amended and supplemented by Resolution No. 51/2001/QH10 dated December 25, 2001 of the Tenth National Assembly, tenth session;

BASED ON THE LAW ON THE ORGANIZATION OF THE PEOPLE'S PROSECUTOR’S OFFICE;

Pursuant to the Ordinance on Prosecutors of the People's Procuracy;

CONSIDERING THE PROPOSAL OF THE CHIEF PROSECUTOR OF THE SUPREME PEOPLE'S PROSECUTOR’S OFFICE;

RESOLUTION:

Article 1

Staff and officials at all levels of the People's Procuracy shall be provided with uniforms according to their tenure, including:

1. Winter-spring clothing: one set every two and a half years, initially two sets;

2. Cold-resistant coat: one coat every five years;

3. Spring-summer clothing: one set every year, initially two sets;

4. Long-sleeved shirt: one shirt every year, initially two shirts;

5. Belt: one belt every two years;

6. Leather shoes: one pair every two years, initially two pairs;

7. Socks: two pairs every year;

8. Backstrap sandals: one pair every year;

9. Tie: two ties every five years;

10. Soft cap: one cap every three years;

11. Raincoat: one coat every two years. Prosecutors and specialists shall also be provided with a file bag: one bag every three years.

Article 2

Prosecutors, staff, and officials at all levels of the People's Procuracy shall be provided with uniforms once: the prosecution insignia; prosecutors shall also be provided with a beret and prosecutor badge.

Article 3

The form and color of the clothing for prosecutors, staff, and officials at all levels of the People's Procuracy shall be prescribed by the President of the Supreme People's Procuracy.

Uniforms for prosecutors, military personnel, and defense workers working at military procuracies at all levels shall be implemented according to regulations on uniforms for the Vietnam People's Army.

Article 4

The prosecution insignia is circular, red background, diameter 30 mm, thickness 1.5 mm made of metal; around it are rice stalks, in the center is a golden five-pointed star with a diameter of 20 mm, below is a half gear wheel with a diameter of 4 mm in dark blue, within the arc of the gear wheel are the letters "KS" in platinum.

Article 5

1. The prosecutor badge is rectangular, red background, surrounded by a border, long side 56 mm, short side 32 mm, sharp angle 60 degrees.

2. The badges of the President, Deputy Presidents, and Prosecutors of the Supreme People's Procuracy are defined as follows:

a) The badge of the President of the Supreme People's Procuracy has a yellow border with a width of 3 mm, on a red background with the National Emblem of the Socialist Republic of Vietnam in the center with a diameter of 20 mm;

b) The badge of the Deputy President of the Supreme People's Procuracy has a yellow border with a width of 3 mm, on a red background with a golden sword and shield emblem and two golden stars with a diameter of 14 mm;

c) The badge of the Prosecutor of the Supreme People's Procuracy has a yellow border with a width of 3 mm, on a red background with a golden sword and shield emblem and one golden star with a diameter of 14 mm.

3. The badges of the President, Deputy Presidents, and Prosecutors of the provincial-level People's Procuracy are defined as follows:

a) The badge of the President of the provincial-level People's Procuracy has a white border with a width of 2 mm, with two white stripes each 2 mm wide running parallel to the length of the badge, on a red background with a platinum sword and shield emblem, above the two white stripes are three platinum stars each with a diameter of 12 mm;

b) The badge of the Deputy President of the provincial-level People's Procuracy has a white border with a width of 2 mm, with two white stripes each 2 mm wide running parallel to the length of the badge, on a red background with a platinum sword and shield emblem, above the two white stripes are two platinum stars each with a diameter of 12 mm;

c) The badge of the Prosecutor of the provincial-level People's Procuracy has a white border with a width of 2 mm, with two white stripes each 2 mm wide running parallel to the length of the badge, on a red background with a platinum sword and shield emblem, above the two white stripes is one platinum star with a diameter of 12 mm.

4. The badges of the President, Deputy Presidents, and Prosecutors of the district-level People's Procuracy are defined as follows:

a) The badge of the President of the district-level People's Procuracy has a white border with a width of 2 mm, with one white stripe 2 mm wide running parallel to the length of the badge, on a red background with a platinum sword and shield emblem, above the white stripe are three platinum stars each with a diameter of 12 mm;

b) The badge of the Deputy President of the district-level People's Procuracy has a white border with a width of 2 mm, with one white stripe 2 mm wide running parallel to the length of the badge, on a red background with a platinum sword and shield emblem, above the white stripe are two platinum stars each with a diameter of 12 mm;

c) The badge of the Prosecutor of the district-level People's Procuracy has a white border with a width of 2 mm, with one white stripe 2 mm wide running parallel to the length of the badge, on a red background with a platinum sword and shield emblem, above the white stripe is one platinum star with a diameter of 12 mm.

Article 6

The prosecutor identification card is issued by the President of the Supreme People's Procuracy.

The prosecutor identification card measures 95 mm in length and 62 mm in width, consisting of two pages presented as follows:

Page one: red background, at the top is the gold-colored text "Socialist Republic of Vietnam", in the middle is the National Emblem of the Socialist Republic of Vietnam, below the National Emblem is the gold-colored text "Prosecutor Identification Card", according to Model No. 1.

Page two: white background, with embossed pink patterns, a diagonal red line 8 mm wide running from the lower left corner to the upper right corner, in the center is a golden five-pointed star, according to Model No. 2.

Article 8

During working hours and when performing tasks, prosecutors, staff, and officials in the prosecution sector must wear the uniforms provided according to regulations; prosecutors must wear the prosecutor identification card.

Upon completion of their term, prosecutors must return the prosecutor identification card; if reappointed as a prosecutor, they will be provided with a new prosecutor identification card.

Article 9

The Prosecutor shall not use insignia, rank badge, and Prosecutor's Identification Card for personal gain or private matters; shall not use the Prosecutor's Identification Card instead of an introduction letter, citizen identification card, or other personal documents; upon losing the insignia, rank badge, or Prosecutor's Identification Card, they must immediately report to the nearest police agency and the Chief Prosecutor of their working People's Procuracy.

Article 10

When a Prosecutor is relieved of duty or dismissed, the Chief Prosecutor of the Supreme People's Procuracy shall recover the insignia, rank badge, and Prosecutor's Identification Card of that person.

When a Prosecutor is transferred from a local People's Procuracy to another local People's Procuracy at the same level or from a military procuratorate to another military procuratorate at the same level, they shall be issued a new Prosecutor's Identification Card.

Article 11

A Prosecutor who violates regulations on the use of uniform, Prosecutor's Identification Card shall be subject to disciplinary action or criminal responsibility depending on the nature and severity of the violation according to the provisions of the law.

Article 12

A person who is not a Prosecutor but uses insignia, rank badge, or Prosecutor's Identification Card to perform acts contrary to the law shall be subject to disciplinary action, administrative handling, or criminal responsibility depending on the nature and severity of the violation according to the provisions of the law.

Article 13

The system of issuance and use of uniform, insignia, and rank badge for Investigators of the Supreme People's Procuracy shall be implemented similarly to that for Prosecutors of local People's Procuracies.

The system of issuance and use of uniform for Investigators of the Central Military Procuracy shall be carried out according to the regulations for officers of the Vietnam People's Army.

Article 14

This Resolution replaces Resolution No. 34a-NQ/UBTVQH9 dated May 12, 1993 of the Standing Committee of the National Assembly regarding uniforms for the Procuracy sector and Prosecutor's Identification Cards.

The Government and the Chief Prosecutor of the Supreme People's Procuracy within their respective duties and authorities shall be responsible for implementing this Resolution.
