Article 2. Explanation of terms

2. Non-state budget financial sources for implementing the Project must be confirmed by relevant financial and credit institutions.For coal-fired thermal power plants where the enterprise holds 100% of the registered capital and uses 100% of its own capital to invest in the project approved by the competent authority, E is determined as 100%;State budget financial sources for implementing the Project must have written opinions from the Ministry of Science and Technology, the Ministry of Finance, and the Ministry of Planning and Investment.

a)Support for imported technology, transferred technology, improved technology, decoded technology, exploitation of inventions, and creation of new technology. Implementation details follow current regulations on the use of state budget for scientific research topics using state budget and the provisions of this Circular.

b)Maximum support up to 100% of state budget funds for self-research and high-tech development activities with high economic, social, national defense, security, and environmental benefits.

4. In addition, state budget funds can be used to support the following:

a)Purchasing copyrights and software tools; purchasing ownership rights and usage rights to technology; plant and animal breeds; technical equipment and information intellectual property; importing technology, machinery, and equipment; prototypes for research, mastering, developing, and creating high technology according to signed contracts; searching for technology information and trade secrets; hiring domestic and foreign experts according to the guidance of the Ministry of Science and Technology and related agencies., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPThe funds are allocated from the state budget for scientific and technological affairs.

b)For pilot production activities:

c)Maximum support up to 50% of total investment costs (excluding residual value or depreciation costs of equipment and facilities) for pilot production activities within the Project.

d)For pilot production activities in agriculture in areas with difficult socio-economic conditions as stipulated in Decision No. 30/2007/QĐ-TTg dated March 5, 2007, issued by the Prime Minister to promulgate the list of administrative organizations in difficult regions and subsequent amendments, the maximum support can reach 70%. Implementation details follow Circular No. 22/2011/TTLT-BTC-BKHCN dated February 21, 2011, jointly issued by the Ministry of Finance and the Ministry of Science and Technology guiding the management of financial resources for pilot production projects supported by the state budget and the provisions of this Circular.

2. Based on administrative geography, population density, and administrative management levels across the country.ắThe state supports part or all of the funding for technology transfer activities under the Project for the following subjects:

1Technical secrets;gTechnical knowledge about transferred technology in the form of technological plans, technological processes, technical solutions, formulas, parameters, drawings, technical diagrams, computer programs, and information data;Rationalization of production and technological innovation;Purchase and import of high-tech machinery and equipment not yet produced domestically to implement research, mastery, development, and creation of high technology projects.June 2024;Forms and methods of technology transfer are regulated in Article 12 and Article 18 of the Law on Technology Transfer.

2. The state budget for scientific and technological affairs supports up to 50% of technology transfer activities under the Project. The remaining portion of the funds is raised from various funds and other sources specified in Article 3 of this Circular.

a)For activities investing in the production of high-tech products and providing high-tech services:ể Maximum support up to 50% of the cost for scientific and technical personnel directly implementing research and improving technological processes, scientific and technological solutions, building computer software; testing, analyzing, inspecting, and evaluating product quality until the completion of the first batch of products.118/2025/NĐ-CP dated June 09, 2025 of the Government on implementing administrative procedures under the one-stop shop mechanism at the One-Stop Service Center and the National Public Service Portal;Maximum support up to 30% of the cost for purchasing materials, raw materials, fuel, measuring and analytical equipment during testing and production of products.t T4.
