Directive No. 22/1998/CT-TTg On Implementing the Regulation on Promoting Democracy at Commune Level

DIRECTIVE

Regarding the implementation of the Regulation on Promoting Democracy at Communes

Implementing the directives of the Politburo and the Resolution of the Standing Committee of the National Assembly on building and implementing democratic regulations at grassroots levels, on May 11, 1998, the Government issued Decree No. 29/1998/NĐ-CP promulgating the Regulation on Promoting Democracy at Communes.

To implement the above-mentioned Decree of the Government, the Prime Minister issues the following directive:

1. Provincial People's Committees and municipal people's committees directly under the central government shall be responsible for coordinating with mass organizations and directing relevant departments to organize the implementation of the Government's Regulation in their respective localities.

Each province, city, district, commune, ward, town must have a specific implementation program. First, it is necessary to ensure that every cadre, party member, and citizen understands and grasps the spirit and content of Directive No. 30/CT/TW dated February 18, 1998 of the Central Committee of the Party and the content of the Government's Regulation, thereby creating consensus and unity in both understanding and action among cadres and citizens to effectively implement this Regulation in their locality. Cadres and party members must set an example and take the lead in implementing the Party's policy and the Government's regulations on democracy at grassroots levels. The implementation plan must be specific, well-prepared, solid, and serious, without rushing or acting hastily.

The Chairman of the People's Committee must directly direct and bear responsibility to the higher-level People's Committee for the implementation of the Regulation in his/her jurisdiction. Local administrative agencies are the main support for the Chairman of the People's Committee, while also coordinating with mass organizations and other organizations in the locality to assist the Chairman of the People's Committee in effectively guiding the implementation of this Regulation in the locality.

2. Organize pilot guidance to draw lessons.

Each province and district shall select 1-2 communes, each city (including cities under provinces), district, and township shall select 1-2 wards for pilot guidance. The selection of communes and wards as pilots aims to draw lessons for wider dissemination, and simultaneously to examine the need for adjustments and supplements to the contents of the Regulation.

Pilot communes and wards must base their implementation on the provisions of the Regulation and pay attention to examining and drawing out the following points:

a) What contents of the Regulation are not suitable for modification and supplementation, particularly those matters that require direct discussion and decision by the people, those matters where the people participate in providing opinions for the People's Council and People's Committee at the same level or higher levels to decide, those matters that need to be made public to the people, those matters subject to people's supervision and inspection, and those contents related to community building in villages, hamlets, and neighborhoods.

b) Forms and methods of implementing democracy at communes, wards, and towns.

c) Coordination relationships between the administration, the Fatherland Front, mass organizations, and associations in implementing the Regulation.

3. The Government's Regulation provides quite specific guidelines on actions and methods at the grassroots level. Therefore, any issues that are not suitable for the grassroots level and require modification and supplementation should be promptly reported to the Prime Minister for consideration and resolution. Any issues that are obstructed by local regulations at which level, that level must promptly resolve them and report to the higher level about the resolution.

In mid-year and annual reviews, local People's Committees at all levels need to review and evaluate the results of promoting democracy by the people at the grassroots level in their respective localities, promote good practices, correct deviations, and ensure that the legitimate rights of the people are respected, becoming a regular practice in all activities and solving matters at the grassroots level related to the rights and obligations of the people.

4. Ministries, ministerial-level agencies, and governmental agencies need to consider amending, supplementing, or abolishing their own regulations that are inconsistent with the requirements of implementing democracy at the grassroots level, promptly resolve any requests from localities related to implementing democracy at the grassroots level within their authority, and recommend to the Prime Minister any issues within the responsibility of the Government and the National Assembly.

5. The Government's Organization and Cadre Affairs Department shall be responsible before the Government for organizing the implementation of this Regulation nationwide, having the task of guiding, monitoring, urging, and inspecting the implementation of the Regulation, guiding the application of the Regulation to wards and towns, coordinating with relevant sectors to promptly resolve practical issues, and implementing a regular reporting system to the Prime Minister on the implementation of the Regulation.

The Prime Minister requires ministries, ministerial-level agencies, governmental agencies, provincial people's committees, and municipal people's committees directly under the central government to implement this directive effectively.

The Prime Minister requests the Vietnam Fatherland Front and mass organizations at the central level to coordinate with the Government and guide their organizational structures at the local level to cooperate with local People's Committees to effectively implement the Government's Regulation.
