DECREE OF THE GOVERNMENT
Regulations on the functions, tasks, powers, and organizational structure of the Sports Committee

THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Resolution No. 02/2002/QH11 dated August 5, 2002 of the National Assembly of the Socialist Republic of Vietnam, Session I, Term XI, which defines the list of ministries and ministerial-level agencies of the Government;
Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government, which stipulates the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
At the proposal of the Minister and Chairman of the Sports Committee and the Minister of Home Affairs,
DECREE:
Article 1. Position and Functions
The Sports Committee is a ministerial-level agency of the Government, performing state management functions over sports throughout the country; managing state services and representing state ownership interests in state-owned enterprises within the sports sector as prescribed by law.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The Sports Committee is responsible for implementing the tasks and powers prescribed in Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government regarding the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies, and the following specific tasks and powers:
1. Submit draft laws, ordinances, and other legislative documents concerning sports to the Government and the Prime Minister; strategies, plans for development, long-term, five-year, and annual plans, national target programs, action programs, and important projects on sports;
2. Issue decisions, directives, and circulars within the scope of state management of the Sports Committee;
3. Organize, direct, inspect, and be responsible for implementing regulatory documents, strategies, plans, and national target programs after approval; disseminate, popularize, educate on laws, and provide information on sports;
4. Regarding mass sports:
a) Organize and direct the establishment of a coaching cadre for mass sports; promote and guide methods of physical exercise;
b) Take the lead and coordinate with the Ministry of Defense and the Ministry of Public Security to establish standards and regimes for physical training in the People's Army and the People's Police;
c) Take the lead and coordinate with relevant sectors and localities to conduct surveys on the physical condition of the population, exploit and develop traditional ethnic sports and traditional health improvement methods;
d) Approve competition regulations for nationwide mass sports events;
5. Regarding school sports:
a) Submit to the Government and the Prime Minister for the establishment of policies and benefits for physical education teachers;
b) Coordinate with the Ministry of Education and Training in the implementation of the following tasks:
Develop, direct, and organize the implementation of physical education curricula in schools;
Establish standards for physical training and evaluate the results of physical training for students;
Train and enhance physical education teachers and lecturers;
Establish a system for school sports competitions;
6. Regarding high-performance sports:
a) Submit to the Government and the Prime Minister for detailed regulations on professional sports, rights and obligations of athletes, coaches, and referees;
b) Propose to the Prime Minister for permission to organize national sports congresses and regional, continental, and world sports events held in Vietnam;
c) Approve plans and regulations for organizing annual national and international sports competitions of various disciplines and national sports federations;
d) Issue standards and decisions on awarding athlete, coach, and referee ranks; recognize international sports organizations' rankings for Vietnamese athletes, coaches, and referees;
đ) Issue regulations on selecting athletes for national sports teams; decide on the establishment and directly manage national sports teams;
e) Submit to the Prime Minister for regulations on conferring honors on outstanding athletes, coaches;
g) Direct and organize the compilation of framework programs for training athletes, coaches, and referees; organize, guide, and inspect the implementation of these training programs, contents, and plans;
7. Specify conditions and technical standards for sports facilities, training and competition equipment of sports establishments and sports disciplines;
8. Develop plans for coordinating activities between ministries, ministerial-level agencies, government-affiliated agencies, provincial people's committees, and central-level political-social and social organizations in implementing sports-related tasks;
9. Implement international cooperation in the field of sports as prescribed by law;
10. Organize and direct the implementation of scientific research plans and the application of advanced science and technology in the field of sports;
11. Decide on specific policies and measures and direct the operation mechanisms of public service organizations in the sports sector as prescribed by law; manage and direct the activities of affiliated organizations of the Sports Committee;
12. Perform specific tasks and powers within the scope of representing state ownership at state-owned enterprises under the management of the Sports Committee as prescribed by law;
13. Manage state activities of associations and non-governmental organizations in the sports sector as prescribed by law;
14. Guide, inspect sports federations, national sports teams, and organizing committees of national and international sports competitions in fundraising and utilizing sponsorships;
15. Review and inspect the implementation of investment projects in the sports sector as prescribed by law;
16. Inspect, investigate complaints, denunciations, anti-corruption, waste, and handle violations of sports laws within the jurisdiction of the Sports Committee.
17. Decide and direct the implementation of the administrative reform program of the Sports Committee in accordance with the objectives and contents of the State administrative reform program approved by the Prime Minister;
18. Manage organizational structure and staffing; direct the implementation of salary systems and incentive policies, rewards, and disciplinary measures for civil servants and public officials under the management of the Sports Committee; train and develop professional skills for civil servants, public officials, and individuals involved in sports activities;
19. Manage financial resources and assets assigned, and organize the implementation of the budget allocated according to the provisions of the law;
Article 3. Organizational Structure of the Committee
a. Organizations assisting the Minister and Chairman of the Committee in performing state management functions:
1. Mass Sports Department;
2. High Achievement Sports Department I;
3. High Achievement Sports Department II;
4. Planning and Finance Department;
5. Cadre and Civil Servant Organization Department;
6. International Cooperation Department;
7. Legal Affairs Department;
8. Office;
9. Inspectorate;
b. Affiliated public service organizations:
1. University of Sports I;
2. University of Sports II;
3. Institute of Sports Science;
4. National Sports Complex;
5. Vietnam Sports Newspaper;
6. Sports Magazine;
Article 4. Concurrent Members of the Committee
The concurrent members of the Sports Committee shall be appointed by the Minister and Chairman of the Sports Committee upon approval by the Prime Minister;
Article 5. Effective Date
This Decree takes effect fifteen days from the date of publication in the Official Gazette and replaces Decree No. 03/1998/NĐ-CP dated November 6, 1998 of the Government on the functions, tasks, powers, and organizational structure of the Sports Committee;
Article 6. Responsibility for Implementation
The Minister and Chairman of the Sports Committee, Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, and Chairpersons of provincial People's Committees directly under the Central Government are responsible for implementing this Decree./.
