Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decree No. 25/CP dated May 23, 1993 of the Government providing temporarily the new salary system for civil servants, administrative and public service officials, and armed forces personnel;
Pursuant to Decree No. 34/CP dated June 1, 1996 of the Government guiding the implementation of the Ordinance on Prevention and Control of Infection with Human Immunodeficiency Virus (HIV/AIDS);
At the proposal of the Minister of Public Security.
DECISION:
Article 1. Medical staff, warders, educational and vocational training officers, sub-camp chiefs, sub-sector chiefs, investigators, security guards at prisons, detention centers, educational facilities, and reformatory schools; class teachers in reformatory schools under the People's Public Security force who regularly come into direct contact with individuals infected with HIV/AIDS at these units shall be entitled to receive allowances according to one of the following two levels:
- Level 1: VND 120,000 per person per month, applicable to prisons, detention centers, educational facilities, and reformatory schools where the proportion of prisoners, detainees, and students infected with HIV/AIDS reaches 10% or more of the total number of individuals.
- Level 2: VND 100,000 per person per month, applicable to prisons, detention centers, educational facilities, and reformatory schools where the proportion of prisoners, detainees, and students infected with HIV/AIDS is less than 10% of the total number of individuals.
Article 2. Officers and soldiers of the People's Public Security force who become infected with HIV/AIDS while performing their duties and are attacked by criminals shall be entitled to medical examination and treatment according to regulations; they shall enjoy veteran benefits; upon death, they may be recognized as martyrs according to the conditions, criteria, and procedures stipulated in Decree No. 28/CP dated April 29, 1995 of the Government detailing and guiding the implementation of certain provisions of the Ordinance on Preferential Treatment for Revolutionary Activists, Martyrs and Families of Martyrs, War Invalids, War Veterans, and Individuals Who Have Contributed to the Revolution.
Article 3. The funds for the implementation of the provisions set forth in Article 1 and Article 2 of this Decision shall be provided from the State budget within the annual regular expenditure budget of the Ministry of Public Security.
Article 4. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.
Article 5. The Minister of Public Security shall take the lead and coordinate with the Ministers of Finance, Labor, Invalids and Social Affairs, and Interior to guide the implementation of this Decision.
Article 6. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, and Chairpersons of provincial People's Committees and municipal People's Committees directly under the Central Government are responsible for enforcing this Decision./.
