CIRCULAR

HGUIDELINES ON REPORTING TO THE PLACE OF RESIDENCE OR WORKPLACE, SCHOOL OF PERSONS WHO VIOLATE ADMINISTRATIVE REGULATIONS ON TRAFFIC ORDER AND SAFETY

To implement Resolution No. 32/2007/NQ-CP dated June 29, 2007 of the Government on implementing urgent measures to curb traffic accidents and congestion, the Ministry of Public Security issues guidelines on reporting to the place of residence or workplace, school of persons who violate administrative regulations on traffic order and safety as follows:

1. SCOPE AND APPLICABLE SUBJECTS

a) This Circular guides the principles, methods, authority for reporting and the work of monitoring and directing the reporting to the place of residence or workplace, school of persons who violate administrative regulations on traffic order and safety on roads, railways, inland waterways.

b) This Circular applies to:

- Vietnamese citizens who violate administrative regulations on traffic order and safety;

- Authorities, organizations, and individuals issuing and receiving reports.

2. PRINCIPLES OF REPORTING

a) Persons who violate administrative regulations on traffic order and safety must be reported about their violations; if one person commits multiple violations, they shall be reported once; if multiple persons commit the same violation, each violator shall be reported about that violation.

b) Reports on persons who violate administrative regulations on traffic order and safety shall be sent to their place of residence or workplace, school. In cases where a violator has both a registered permanent residence and temporary residence, and is also an officer, civil servant, student, pupil, or trainee, the report shall be sent to the office where the officer or civil servant works or the educational institution where the student, pupil, or trainee studies.

c) The authority issuing the decision to impose administrative sanctions for violations of administrative regulations on traffic order and safety shall have the authority to issue reports on such violations.

d) Authorities, organizations, and individuals receiving reports shall be responsible for organizing reviews, education, and handling of persons who violate administrative regulations on traffic order and safety, and sending the results of these reviews, education, and handling back to the authority issuing the report for monitoring and consolidation.

3. METHODS OF REPORTING

a) Reporting on persons who violate administrative regulations on traffic order and safety shall be carried out in writing according to the model attached to this Circular.

b) Reporting and sending the report to the place of residence or workplace, school of the violator shall be carried out immediately after the decision to impose administrative sanctions is issued.

4. AUTHORITY FOR REPORTING

The following persons have the authority to issue reports on persons who violate administrative regulations on traffic order and safety:

a) Chairpersons of People's Committees at all levels;

b) Chiefs of Police Departments of counties, districts, towns, cities under provinces;

c) Chiefs of Traffic Police Departments, Chiefs of Public Order Police Departments, Chiefs of Administrative Management Police Departments under Provincial Police Departments, Central City Police Departments;

d) Heads of Transport Inspection Departments at provincial level or higher.

The person issuing the decision to report shall be responsible for the report issued by them.

5. MONITORING AND DIRECTING REPORTING

a) Every three months, six months, and annually, the authority issuing the report shall be responsible for consolidating the results of education, review, and handling of persons who violate administrative regulations on traffic order and safety, and submitting them to the Provincial Traffic Safety Committee for reporting to the National Traffic Safety Committee.

b) The Traffic Police Departments of Provinces and Central City Police Departments shall be responsible for monitoring, urging, consolidating, and reporting to the Provincial Traffic Safety Committee for reporting to the National Traffic Safety Committee.

6. IMPLEMENTATION AND EFFECTIVE DATE

a) Heads of authorities with the authority to issue reports and organizations, institutions, and individuals receiving reports shall be responsible for implementing this Circular.

b) This Circular takes effect fifteen days from the date of publication in the Official Gazette. During implementation, if any difficulties or obstacles arise, they should be promptly reflected to the Ministry of Public Security (through the General Police Department) for timely guidance.
