Decree No. 22/2010/NĐ-CP amends and supplements Article 3 of Decree No. 188/2007/NĐ-CP dated December 27, 2007 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Health.

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Considering the proposal of the Minister of Health,

DECREE:

Article 1. Amending and supplementing Article 3 of Decree No. 188/2007/NĐ-CP dated December 27, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health as follows:

"Article 3. Organizational Structure:
1. The Health Insurance Department.
2. Department of Science and Training.
3. Department of Maternal and Child Health.
4. Department of Traditional Medicine.
5. Department of Medical Equipment and Infrastructure.
6. Department of Planning and Finance.
7. Cadre and Civil Servant Organization Department.
8. Legal Affairs Department.
9. Department of International Cooperation.
10. Ministry's Office.
11. Ministry Inspectorate.
12. Preventive Medicine Agency.
13. Environmental Health Management Agency.
14. Medical Examination and Treatment Management Agency.
16. Food Safety Bureau;
16. Food Safety and Control Agency.
17. HIV/AIDS Prevention and Control Agency.
18. General Department of Population and Family Planning.
19. Representative Office of the Ministry of Health in Ho Chi Minh City.
20. Institute of Strategy and Health Policy.
The organizations specified from Clause 1 to Clause 18 of this Article assist the Minister in performing state management functions; the organizations specified from Clause 19 to Clause 21 of this Article are subordinate public service units serving the Ministry of Health's state management functions;
22. Journal of Practical Medicine.
23. Journal of Pharmacy.

The Departments: Cadre and Civil Service Organization, Planning and Finance, International Cooperation, Inspectorate of the Ministry, and the Office of the Ministry shall be organized into divisions.

Organizations from Clause 1 to Clause 19 of this Article are organizations assisting the Minister in performing state management functions, and organizations from Clause 20 to Clause 23 of this Article are subordinate public service units under the Ministry of Health.

The Minister of Health shall submit to the Prime Minister for approval: regulations on the functions, tasks, powers, and organizational structure of the General Department of Population and Family Planning; promulgating a list of other subordinate public service units under the Ministry of Health".

Article 2. This Decree takes effect from May 1, 2010.

Article 3. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the Central Government shall be responsible for implementing this Decree.
