CIRCULAR
Announcing the Port Waters Area within the jurisdiction of Quang Binh Province and the management area of the Quang Binh Maritime Port Office

Pursuant to the Maritime Code of Vietnam dated June 14, 2005;
Pursuant to Decree No. 51/2008/NĐ-CP dated April 22, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to Decree No. 71/2006/NĐ-CP dated July 25, 2006 of the Government on port management and maritime channels;
Based on the opinions of the People's Committee of Quang Binh Province at Official Document No. 2474/UBND dated October 22, 2009;
The Minister of Transport hereby announces the port waters areas within the jurisdiction of Quang Binh Province and the management area of the Quang Binh Maritime Port Office as follows:
Article 1. Announcing the Port Waters Areas within the Jurisdiction of Quang Binh Province
1. The port waters areas within the jurisdiction of Quang Binh Province include:
a) The port waters areas before the wharves and berths of the following ports:
- Quang Binh Port: Gianh Wharf and Oil Wharf on Gianh River;
- Hon La Port: Berth No. 1.
b) The port channel waters, branch channel waters, pilot reception areas, quarantine zones, anchorage areas, transshipment areas, and typhoon shelters of the ports specified in point a of this Clause.
2. Other port waters areas before the wharves and berths, anchorage areas, transshipment areas, and typhoon shelters shall be announced in accordance with the provisions of the law.
Article 2. Scope of the Port Waters Areas within the Jurisdiction of Quang Binh Province
The scope of the port waters areas within the jurisdiction of Quang Binh Province is measured according to the highest tidal level and is specifically defined as follows:
1. Quang Binh Port:
a) Seaward boundary: delimited by straight lines connecting points CG1, CG2, CG3, and CG4 with the following coordinates:
CG1: 17042’40”N, 106029’00”E;
CG2: 17042’40”N, 106031’00”E;
CG3: 17042’10”N, 106031’00”E;
CG4: 17042’10”N, 106029’00”E.
b) Boundary along Gianh River: delimited from point CG1 and CG4 running along both banks of Gianh River to a straight line crossing the river 200 meters upstream from the edge of the Oil Wharf on Gianh River.
2. Hon La Port
a) Seaward boundary: delimited by straight lines connecting points HL1, HL2, HL3, HL4, and HL5 with the following coordinates:
HL1: 171: 17057’33”3N, 106030’30”7E;
HL1: 172: 17057’33”3N, 1060HL2: 17

Article 3. Pilot reception and delivery areas, quarantine zones, anchorage areas, transshipment areas, and storm shelters

Article 4. Responsibilities of the Quang Binh Maritime Branch
The Quang Binh Maritime Branch shall be responsible for:
1. Performing tasks and exercising powers as prescribed by the Vietnam Maritime Code and related legal normative documents concerning maritime activities within the waters of seaports located within the territory of Quang Binh Province;
2. Based on actual conditions regarding weather, waves, wind, draft, and tonnage of vessels, designating specific locations for vessels to pick up and drop off pilots, undergo quarantine, anchor, transfer cargo, and avoid typhoons within the waters specified in Article 3 of this Circular, ensuring maritime safety, maritime security, and prevention of environmental pollution.
Article 5. State Management Responsibilities for Maritime Affairs in the Sea Area within the Territory of Quang Binh Province
Outside the waters of the seaports specified in Articles 2 and 3 of this Circular, the Quang Binh Maritime Branch shall also be responsible for state management of maritime safety and maritime security in the sea area within the territory of Quang Binh Province.
Article 6. Effectiveness
1. This Circular takes effect from October 15, 2010. Decree No. 25/2007/QĐ-BGTVT dated May 17, 2007 of the Minister of Transport on Announcing the Waters of Seaports within the Territory of Quang Binh Province and the Management Areas of the Quang Binh Maritime Branch, and all previous provisions contrary to this Circular are hereby repealed.
2. The coordinate system stipulated in this Circular shall be applied according to the VN-2000 Coordinate System and converted to corresponding coordinate systems as set forth in the attached Appendix.
Article 7. Responsibility for Implementation
The Head of the Ministry's Office, the Inspector General, Heads of Departments under the Ministry, the Director of the Vietnam Maritime Administration, the Director of the Vietnam Inland Waterways Administration, the Director of the Quang Binh Department of Transport, the Director of the Quang Binh Maritime Branch, Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
