JOINT CIRCULAR
Amending and supplementing Circular Jointly Issued No. 144/2008/TTLT-BQP-BLDTBXH-BTC dated November 27, 2008 of the Ministry of National Defense, the Ministry of Labor - Invalids and Social Affairs, and the Ministry of Finance guiding the implementation of Decision No. 142/2008/QD-TTg dated October 27, 2008 of the Prime Minister on the regime for military personnel participating in the resistance war against America to save the country who have less than 20 years of service in the military and have been demobilized and discharged back to their home provinces.
On the basis of Decision No. 142/2008/QD-TTg dated October 27, 2008 of the Prime Minister on the regime for military personnel participating in the resistance war against America to save the country who have less than 20 years of service in the military and have been demobilized and discharged back to their home provinces (hereinafter referred to as Decision No. 142/2008/QD-TTg); On the basis of Official Letter No. 2403/TTg-KGVX dated December 3, 2009 of the Prime Minister regarding the adjustment of the monthly allowance for beneficiaries under the provisions of Decision No. 142/2008/QD-TTg;
The Joint Ministries of National Defense, Labor - Invalids and Social Affairs, and Finance hereby guide as follows:
Article 1. Adjusting the amount of the monthly allowance at Clause 2 Section II of Circular Jointly Issued No. 144/2008/TTLT-BQP-BLDTBXH-BTC dated November 27, 2008 of the Ministry of National Defense, the Ministry of Labor - Invalids and Social Affairs, and the Ministry of Finance guiding the implementation of Decision No. 142/2008/QD-TTg (hereinafter referred to as Circular Jointly Issued No. 144/2008/TTLT-BQP-BLDTBXH-BTC). 1. From January 1, 2009 to April 30, 2009, the subjects specified in Clause 1 Section I of Circular Jointly Issued No. 144/2008/TTLT-BQP-BLDTBXH-BTC shall be adjusted to increase their monthly allowance by 15%.

3. For beneficiaries receiving monthly allowances, if they pass away according to Clause 2 Article 2 of Decision No. 142/2008/QD-TTg, the following shall apply:
a) If they pass away during the period from January 1, 2009 to April 30, 2009, the relatives of the deceased shall receive a one-time allowance equal to three months' worth of the monthly allowance currently being received by the deceased according to Clause 1 of this Article.
b) If they pass away from May 1, 2009 onwards, the relatives of the deceased shall receive a one-time allowance equal to three months' worth of the monthly allowance currently being received by the deceased according to Clause 2 of this Article.
This Circular takes effect 45 days after its date of issuance. The adjustment of monthly allowances guided by this Circular shall be implemented from January 1, 2009.
1. The Ministry of National Defense shall take the lead and coordinate with the Ministry of Labor - Invalids and Social Affairs and the Ministry of Finance to direct, guide, and inspect agencies, units, and localities in implementing the regime guided by this Circular.
2. Provincial People's Committees and Municipal People's Committees directly under the Central Government shall direct competent authorities in localities to implement the adjustment of monthly allowances guided by this Circular.
3. For pending cases under review for benefit entitlement, the level conducting the review shall implement the adjustment of the monthly allowance according to the guidance provided in this Circular. For beneficiaries who have already received decisions on monthly allowance benefits before this Circular takes effect, the competent labor and social affairs authority shall be responsible for adjusting the corresponding levels of benefit. During the process of implementation, if there are any difficulties, agencies, units, and localities shall report to the Ministry of National Defense for coordination with the joint ministries to examine and resolve them.

3. For pending cases under review for benefit entitlement, the level conducting the review shall implement the adjustment of the allowance levels according to the guidance provided in this Circular. For individuals who have already received decisions on monthly allowance benefits before the effective date of this Circular, the competent Labor, Invalids and Social Affairs authorities shall be responsible for adjusting the corresponding benefit levels. During the implementation process, if there are any difficulties, agencies, units, and localities shall report to the Ministry of National Defense for coordination with the relevant ministries to examine and resolve them.
