Article 24Regulations on administrative procedures in the field of ensuring air traffic operations

Pursuant to Decree No. 51/2008/NĐ-CP dated April 28, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 94/2007/NĐ-CP dated June 4, 2007 of the Government on Air Traffic Management;

The Minister of Transport shall stipulate administrative procedures in the field of ensuring air traffic operations as follows:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular prescribes the sequence, method, conditions, and deadlines for implementing the following matters:

1. Issuing operating licenses for facilities providing air traffic service (including: air navigation services, information services, guidance services, surveillance services, meteorological services, aviation news reporting services, civil aviation search and rescue services), operating licenses for technical systems and equipment ensuring air traffic operations;

2. Assigning codes and technical addresses for technical systems and equipment for information, guidance, and surveillance;

3. Issuing certificates for technical systems, equipment, and installations ensuring air traffic operations produced or improved in Vietnam;

4. Issuing licenses and qualifications for air traffic personnel;

5. Issuing certificates for organizations training air traffic personnel;

6. Approving operational manuals for facilities providing air traffic services;

7. Approving civil aviation flight procedures;

8. Approving search and rescue plans, emergency airport plans, and search and rescue drill plans of enterprises providing air traffic services.

Article 2: Scope of Application

This Circular applies to organizations and individuals related to the management and provision of air traffic service.

Article 3. Responsibilities of Organizations and Individuals Requesting Licenses, Certificates, and Approval Decisions

1. Shall be responsible for the accuracy of the information in the application dossier.

2. Pay fees and charges as prescribed by law.

3. Submit one set of the dossier directly at the Civil Aviation Administration of Vietnam or send it via postal service to the Civil Aviation Administration of Vietnam.

Article 4. Responsibilities of the Civil Aviation Administration of Vietnam

1. Issue licenses according to the form prescribed in Appendix 10, issue certificates according to the form prescribed in Appendix 11, and approve according to the form prescribed in Appendix 12 issued together with this Circular.

2. Collect, manage, and use fees and charges in accordance with the provisions of the law.

3. Fully implement archival regulations in accordance with the law on archives.

4. Inspect and supervise the activities of organizations and individuals who have been granted licenses, certificates, or approval decisions.

Article 5. Revocation of Licenses, Certificates, and Approval Decisions Related to Operating Air Traffic Service Facilities

Organizations and individuals whose licenses, certificates, or approval decisions related to operating air traffic service facilities are revoked in the following cases:

1. No longer meeting the required conditions for operation as prescribed by law;

2. Violating legal provisions regarding compliance with requirements and conditions in the operation of air traffic service facilities.

Chapter II

ISSUANCE AND RENEWAL OF OPERATING LICENSES FOR FACILITIES PROVIDING AIR TRAFFIC SERVICES

Article 6. Conditions for Issuing Operating Licenses for Facilities Providing Air Traffic Services

1. Have an organizational structure suitable for the air traffic service provided by the organization applying for the license.

2. Possess sufficient technical systems, equipment, and installations that have been granted operating licenses by the Civil Aviation Administration of Vietnam as prescribed.

3. The air traffic personnel team holds valid licenses and certificates appropriate to their positions.

Article 7. Documents for Application to Obtain an Operating Permit for a Facility Providing Air Traffic Service Assurance

1. An application form for obtaining an operating permit for a facility providing air traffic service assurance according to the model prescribed in Appendix 1 issued together with this Circular.

2. A list of equipment, devices, and technical systems of the facility providing air traffic service assurance that have been permitted.

3. A list of employees who have been granted permits to work at the facility providing air traffic service assurance, consistent with the number of employees specified in the operational guidance documents.

4. A copy of the approval document for the operational guidance documents of the facility providing air traffic service assurance.

Article 8. Reissuing an Operating Permit for a Facility Providing Air Traffic Service Assurance

1. In the following cases, enterprises must go through the procedures to reissue an operating permit for a facility providing air traffic service assurance with the Civil Aviation Authority of Vietnam:

a) The operating permit for a facility providing air traffic service assurance is lost, torn, or destroyed;

b) Change in the enterprise name or main office address of the service assurance provider;

c) Change in the facility name or address in the issued permit;

d) Change in the purpose, scope, method of service provision, operation mode, organizational structure of the facility providing air traffic service assurance;

đ) Restoration and full compliance with conditions stipulated in the operating permit for a facility providing air traffic service assurance (applicable in cases where the permit has been revoked according to Article 5 of this Circular);

2. Documents for reissuing an operating permit for a facility providing air traffic service assurance in the case prescribed in point a, Clause 1 of this Article include:

a) An application form for reissuing the permit according to the model prescribed in Appendix 1 issued together with this Circular;

b) Original of the operating permit for a facility providing air traffic service assurance (if available).

3. Documents for reissuing an operating permit for a facility providing air traffic service assurance in the cases prescribed in points b, c, d, Clause 1 of this Article include:

a) An application form for reissuing the permit according to the model prescribed in Appendix 1 issued together with this Circular;

b) Certified copies of relevant documents concerning the contents prescribed in points b, c, d, Clause 1 of this Article.

4. Documents for reissuing an operating permit for a facility providing air traffic service assurance in the case prescribed in point đ, Clause 1 of this Article shall be carried out according to the provisions of Article 7 of this Circular. Notably, organizations or individuals whose permits were revoked according to Clause 2, Article 5 of this Circular must wait five years from the revocation date before they can apply for reissuance of the permit.

Article 9. Documents for Application to Approve Operational Guidance Documents of a Facility Providing Air Traffic Service Assurance

1. Initial approval documents, including:

a) An application form for approving operational guidance documents of a facility providing air traffic service assurance according to the model prescribed in Appendix 7 issued together with this Circular;

b) Draft of operational guidance documents of a facility providing air traffic service assurance according to the model prescribed in Appendix 13 issued together with this Circular.

2. For amendments and supplements to operational guidance documents that have already been approved by the Civil Aviation Authority of Vietnam, the applicant must prepare documents for applying to approve such amendments and supplements. The application documents include:

a) An application form for approving amendments and supplements to operational guidance documents of a facility providing air traffic service assurance according to the model prescribed in Appendix 7 issued together with this Circular;

b) Operational guidance documents of a facility providing air traffic service assurance for the parts proposed for amendment and supplement.

Article 10. Term for Issuing, Reissuing Exploitation Licenses for Air Traffic Service Facilities and Approving Amendments to Operating Guidance Documents

1. Within thirty days from the date of receiving complete files as prescribed, the Civil Aviation Administration shall be responsible for examining the files, conducting inspections and evaluations, and deciding on issuing exploitation licenses for air traffic service facilities to the requesting organizations.

2. In case of refusal, within seven working days, the Civil Aviation Administration shall notify the organization in writing and specify the reasons.

3. The exploitation license for air traffic service facilities becomes effective from the date of signature and terminates in case of violation of provisions stipulated in Article 5 of this Circular.

4. The term for handling procedures for reissuing exploitation licenses for air traffic service facilities is regulated as follows:

a) Within ten days from the date of receiving complete files as prescribed by the requesting party under Clause 2, Article 8 of this Circular;

b) Within fifteen days from the date of receiving complete files as prescribed under Clause 3, Article 8 of this Circular;

c) Within thirty days from the date of receiving complete files as prescribed under Clause 4, Article 8 of this Circular, the Civil Aviation Administration shall be responsible for reissuing the exploitation license for air traffic service facilities.

5. Within fifteen days from the date of receiving the file directly or the postmark date, the Civil Aviation Administration shall examine the file, conduct inspections and evaluations, and issue decisions to approve new or amended operating guidance documents for civil aviation air traffic service facilities. If the file is incomplete according to regulations, within five working days from the date of receiving the file directly or the postmark date, the Civil Aviation Administration shall request the applicant to complete the file, and the handling period will be calculated from when the file is complete according to regulations.

6. During the inspection and examination process, the Civil Aviation Administration may require the applicant to provide information or documents to clarify related issues.

Chapter III

ISSUING AND REISSUING EXPLOITATION LICENSES FOR AIR TRAFFIC CONTROL SYSTEMS AND EQUIPMENT

Article 11. List of air traffic control systems and equipment that must be issued an exploitation license by the Civil Aviation Administration before operation

1. Information, navigation, surveillance systems and equipment include:

a) Very high frequency (VHF) voice or data transceivers, or both;

b) High frequency (HF) voice or data transceivers;

c) Automatic telegraph switching system for fixed telecommunications networks;

d) Telecommunications network automatic message switching system;

đ) Voice switching system;

e) Recording equipment;

g) Non-directional beacon;

h) VHF omnidirectional range (VOR);

i) Distance measuring equipment (DME);

k) Instrument landing system (ILS);

l) Ground-based augmentation system (GBAS);

m) Primary radar surveillance system;

n) Secondary radar surveillance system;

o) Radar data processing system; Flight data processing system;

p) Lighting and signage systems at airports;

q) Automatic terminal information service (ATIS) systems.

2. Automatic air traffic management systems.

3. Automatic aeronautical information service systems.

4. Meteorological systems and equipment, including:

a) Meteorological observation systems;

b) Wind shear detection and warning systems;

c) Weather radar systems;

d) Satellite weather imagery reception systems;

đ) Basic meteorological data acquisition and processing systems;

e) Global weather forecast product reception systems;

g) Meteorological database systems;

h) Equipment at meteorological observation stations.

Article 12. Conditions for Issuing Exploitation Licenses for Technical Systems and Equipment Ensuring Air Traffic Operations

1. Technical systems, information, navigation, surveillance equipment shall be issued exploitation licenses when meeting the following conditions:

a) Meeting the standards prescribed by the Civil Aviation Administration of Vietnam or recognized as conforming to the standards of the International Civil Aviation Organization;

b) Having frequency usage permits and radio wave emission equipment permits issued by the Radio Frequency Management Agency under the Ministry of Information and Communications for radio wave emission equipment;

c) Having operational and maintenance documentation for technical systems, information, navigation, and surveillance equipment in Vietnamese or English (if in English, it must ensure that staff can understand and operate the documentation);

d) Having backup equipment and power supply complying with the provisions of Articles 17 and 18 of Decision No. 14/2007/QĐ-BGTVT dated March 26, 2007, issued by the Ministry of Transport on civil aviation communication, navigation, and surveillance regulations;

đ) Having completion acceptance certificates for works put into use; for airport signal system, final drawings and plans;

e) Having address and technical codes for technical systems, equipment, information, navigation, and surveillance equipment (if applicable), issued by the Civil Aviation Administration of Vietnam;

g) Having flight procedures approved by the Civil Aviation Administration of Vietnam for navigation systems and equipment;

h) Having recording and storage devices in accordance with Article 16 of Decision No. 14/2007/QĐ-BGTVT dated March 26, 2007, issued by the Ministry of Transport on civil aviation communication, navigation, and surveillance regulations;

i) For newly installed air traffic navigation and surveillance assistance equipment, there must be flight test results, calibration acceptance reports, and meet the operational standards recognized by the Civil Aviation Administration of Vietnam; in cases where non-directional beacon equipment is relocated to another position, commercial aircraft flight test results may be used to consider operational approval;

k) Having transmission lines, remote control equipment, and related equipment suitable for the requirements of operating the equipment;

2. Automatic information service systems shall be issued exploitation licenses when meeting the following conditions:

a) Technical standards conforming to the general standards of the International Civil Aviation Organization;

b) Having technical handover and acceptance certificates;

c) Having operational and maintenance documentation for automatic information service systems in Vietnamese or English (if in English, it must ensure that staff can understand and operate the documentation);

3. The above-mentioned technical systems, equipment, and meteorological aviation equipment shall only be issued exploitation licenses when meeting the following conditions:

a) Meeting the technical standards stipulated in Articles 34, 35, and 36 of Circular No. 19/TT-BGTVT dated September 8, 2009, issued by the Ministry of Transport on civil aviation meteorology;

b) Having technical handover and acceptance certificates;

c) Backup equipment;

d) Having frequency usage permits and radio wave emission equipment permits issued by the Radio Frequency Management Agency under the Ministry of Information and Communications for radio wave emission equipment;

đ) Having technical certificates issued by the Civil Aviation Administration of Vietnam for technical systems and meteorological aviation equipment produced or improved in Vietnam (if applicable);

e) Having operational and maintenance documentation for technical systems and meteorological aviation equipment in Vietnamese or English (if in English, it must ensure that staff can understand and operate the documentation).

Article 13. Documents for Application to Obtain and Reissue Exploitation Licenses for Technical Systems, Equipment Ensuring Flight Operations

1. Documents for Application to Obtain an Exploitation License for Technical Systems, Equipment Ensuring Flight Operations include:

a) An application form for obtaining an exploitation license for technical systems, equipment in accordance with the model prescribed in Appendix 3 attached hereto;

b) A report explaining the suitability of the technical systems and equipment with the flight operation assurance services provided by the organization;

c) A report explaining the capacity for exploiting, maintaining, and repairing the technical systems and equipment;

d) A copy of the frequency usage permit and radio wave transmission equipment permit issued by the Radio Frequency Administration under the Ministry of Information and Communications for radio wave transmission equipment.

2. Enterprises must apply to the Civil Aviation Authority of Vietnam to reissue exploitation licenses for technical systems and equipment ensuring flight operations in the following cases:

a) When there is a change in the content of the already issued permit;

b) When enterprises carry out renovations and upgrades of technical systems and equipment ensuring flight operations that have been licensed by the Civil Aviation Authority of Vietnam;

c) To restore and fully meet the conditions stipulated in the exploitation license for technical systems and equipment ensuring flight operations (applicable in cases where the license has been revoked according to Article 5 of this Circular);

d) The license has expired.

3. Documents for Application to Reissue an Exploitation License for Technical Systems and Equipment Ensuring Flight Operations include:

a) An application form for reissuing an exploitation license for technical systems and equipment in accordance with the model prescribed in Appendix 4 attached hereto;

b) A report explaining the renovation and upgrade of technical systems and equipment ensuring flight operations;

c) A copy of the flight test calibration result record and the latest inspection results of the technical systems and equipment (applicable to systems and equipment requiring flight test calibration and inspection, including system and equipment renovations and upgrades);

4. Documents for Application to Reissue an Exploitation License for Technical Systems and Equipment Ensuring Flight Operations in the case specified in point c, Clause 2 of this Article shall be carried out in accordance with the provisions of Clause 1 of this Article.

Article 14. Time Limit for Issuance and Reissuance of Exploitation Licenses for Technical Systems and Equipment Ensuring Flight Operations

1. Within twenty days from the date of receipt of complete documents as prescribed, the Civil Aviation Authority of Vietnam shall be responsible for reviewing the documents, conducting inspections and evaluations, and deciding on the issuance of exploitation licenses for technical systems and equipment ensuring flight operations for the requesting organizations.

During the inspection and evaluation process, the Civil Aviation Authority of Vietnam may request the organization to provide additional information or documents to clarify related issues.

2. In case of refusal, within seven working days, the Civil Aviation Administration shall notify the organization in writing and specify the reasons.

3. The exploitation license for technical systems and equipment ensuring flight operations is valid for two years and ceases to be effective in cases of violation of the provisions set forth in Article 5 of this Circular.

4. Within twenty days from the date of receipt of complete documents as prescribed in Clause 3 of Article 13 of this Circular, the Civil Aviation Authority of Vietnam shall reissue the exploitation license for technical systems and equipment ensuring flight operations.

5. Within thirty days from the date of receipt of complete documents as prescribed in Clause 4 of Article 13 of this Circular, the Civil Aviation Authority of Vietnam shall be responsible for reissuing the exploitation license for technical systems and equipment ensuring flight operations.

Chapter IV

ISSUANCE AND EXTENSION OF LICENSES, DETERMINATION OF STAFF FOR FLIGHT OPERATIONS MANAGEMENT

Article 15. Titles of air traffic management personnel

The titles of air traffic management personnel (hereinafter referred to as personnel) include:

1. Air traffic controller;

2. Air traffic controller trainer;

3. Air traffic information officer;

4. Air traffic information, guidance, surveillance officer;

5. Aviation meteorological officer;

6. Flight dispatch and operation officer;

7. Civil aviation flight procedure design officer;

8. Aviation search and rescue officer.

Article 16. Conditions for issuing licenses and ratings to personnel

Individuals meeting the following conditions shall be issued personnel licenses:

1. Being a Vietnamese citizen aged 21 years or older, without criminal records or currently serving a criminal sentence or being pursued for criminal responsibility;

2. Having a relevant professional certificate in air traffic management (for flight procedure design officers, they must have a graduation certificate from a flight procedure design training course) issued by the organization providing air traffic personnel training services certified by the Civil Aviation Administration of Vietnam;

3. Having an English language proficiency certificate at the minimum level appropriate to the assigned air traffic service support field. Specifically, air traffic controllers using radio communication and shortwave radio communication officers must have an English level 4, while air traffic information officers must have an English level 3, both certified or recognized by the Civil Aviation Administration of Vietnam according to Annex 1 of the Convention on International Civil Aviation;

4. Completing a minimum of 12 months of training and internship for air traffic controllers; 9 months for air traffic information officers and aviation meteorological officers; 3 months for air traffic information, guidance, surveillance officers and flight dispatch and operation officers. For flight procedure design officers, they must have a minimum of 5 years of experience as air traffic information and guidance officers, aircraft pilots, or air traffic controllers, and have participated in the design internship of two flight procedures using equipment;

5. Having a health certificate from a medical facility approved by the Civil Aviation Administration of Vietnam for air traffic controllers, air traffic information, guidance, and surveillance officers performing calibration flight tasks;

6. Participating in and passing the examination for issuing air traffic management personnel licenses and ratings.

Article 17. Application dossier for issuing and extending personnel licenses and ratings

1. The application dossier for issuing personnel licenses and ratings includes:

a) A request for issuance of a personnel license from the organization providing air traffic service support (with a list attached) according to the model prescribed in Appendix 14 issued together with this Circular;

b) A personnel license application form according to the model prescribed in Appendix 8 issued together with this Circular;

c) Certified copies or copies accompanied by original certificates and diplomas for verification;

d) Copies of appropriate training results;

đ) Original health certificate still valid issued by a medical facility certified by the Civil Aviation Administration of Vietnam (applicable to air traffic controllers, air traffic information, guidance, and surveillance officers performing calibration flight tasks);

e) Two 3x4 inch photos taken within six months prior to submitting the dossier.

2. The application dossier for reissuing personnel licenses when the license has expired, including:

a) A request for reissuance of a personnel license from the organization providing air traffic service support (with a list attached) according to the model prescribed in Appendix 14 issued together with this Circular;

b) A personnel license reissue application form according to the model prescribed in Appendix 8 issued together with this Circular;

c) Copies of appropriate training results;

d) Original health certificate still valid issued by a medical facility certified by the Civil Aviation Administration of Vietnam (applicable to air traffic controllers and calibration flight officers);

đ) Two 3x4 inch photos taken within six months prior to submitting the dossier.

3. The application dossier for reissuing personnel licenses when the license is lost, torn, or damaged, including:

b) A personnel license reissue application form according to the model prescribed in Appendix 8 issued together with this Circular;

c) Original or copy of the personnel license (if available);

d) Two 3x4 inch photos taken within six months prior to submitting the dossier.

4. The application dossier for extending personnel ratings, including:

a) A request for extension of personnel ratings from the organization providing air traffic service support (with a list attached) according to the model prescribed in Appendix 14 issued together with this Circular;

b) A personnel rating extension application form according to the model prescribed in Appendix 8 issued together with this Circular;

c) Copies of the most recent training results;

Article 18. Term for Issuance, Extension of License and Qualification Determination for Personnel

1. Personnel must submit applications for reissuance of licenses and extension of qualification determinations at least 30 days before the expiration date of the license or qualification determination.

2. Within 30 days from the date of receiving complete application files in accordance with regulations, the Civil Aviation Authority of Vietnam shall be responsible for reviewing the application files, organizing inspections, and issuing licenses and qualification determinations to personnel.

3. The personnel license shall be valid for seven years from the date of issuance and shall become void in the following cases:

a) Violation of the provisions set forth in Article 5 of this Circular;

b) The qualification determination included in the personnel license has expired its validity period.

4. The term of validity of the qualification determination for personnel:

a) Twenty-four months for air traffic controllers, flight operations personnel; non-radar air traffic control training instructors; information, guidance, and surveillance personnel (except those performing shortwave radio communication tasks and those conducting calibration flight checks);

b) Twelve months for other aviation personnel.

5. Time limit for processing applications for reissuance of licenses and qualification determinations for personnel

a) Within ten days from the date of receipt of complete application files in accordance with the provisions of Clause 3, Article 17 of this Circular;

b) Within twenty days from the date of receipt of complete application files in accordance with Clauses 2 and 4, Article 17 of this Circular.

Chapter V

ISSUANCE OF CERTIFICATES FOR ORGANIZATIONS PROVIDING AVIATION TRAINING IN THE FIELD OF AIR TRAFFIC SERVICES

Article 19. Conditions for Issuing Certificates for Organizations Providing Aviation Training in the Field of Air Traffic Services

The Civil Aviation Authority of Vietnam shall issue certificates for organizations providing aviation training in the field of air traffic services that meet the following conditions:

1. Physical facilities and equipment:

a) Classrooms equipped with adequate lighting, ventilation suitable for local climate, hygiene, and health protection;

b) Training equipment and materials necessary to conduct approved training courses.

2. Training equipment must meet the following requirements:

a) For air traffic controllers and flight information officers: simulation training systems and software for approach control, surface control, radar and non-radar long-range control; English listening room meeting specified standards;

b) For training technical information, guidance, and surveillance personnel, maintenance and repair equipment personnel: practical training equipment for electrical and electronic technology; practical training equipment for digital and microprocessor technology; specialized telecommunications practical training equipment; electronic data transmission practical training equipment; system operation practical training equipment;

c) For training aviation information dissemination personnel: models of automatic information dissemination equipment systems and automatic telegraph information management and operation systems; automatic telegraph transmission and reception equipment; terminal equipment performing fixed air telecommunications network functions and server functions;

d) For training aviation meteorological personnel: weather radar model, wind shear measuring equipment, automatic meteorological observation systems serving aviation, satellite cloud image receiving systems, global forecast product receiving systems, plotting machine systems, meteorological database systems, fixed air telecommunications network terminal equipment;

e) For training flight dispatch and operations personnel: aircraft structure system model, flight operations management software; automatic information dissemination equipment system model; automatic telegraph transmission and reception equipment, other necessary documents consistent with International Civil Aviation Organization requirements;

f) For training air route design personnel: practical training room for building air routes, other necessary documents consistent with International Civil Aviation Organization requirements.

3. Content of the training program:

a) Program content for each training course;

b) Minimum equipment requirements corresponding to each approved teaching syllabus;

c) Minimum qualifications of trainers;

d) Programs for issuing professional certificates; familiarization, recovery, conversion, periodic training programs; upgrading, updating, and enhancing knowledge and professional qualifications training programs.

4. Trainers must meet the following conditions:

a) Teaching qualification certificate;

b) Five years of experience in the relevant field;

c) Trainer license in the appropriate specialty.

Article 20. Application Documents for Issuance and Reissuance of Aviation Training Organization Certificate in Air Traffic Services Field

1. The aviation training organization certificate with validity of 36 months shall be reissued when:

a) The certificate expires;

b) There are changes related to ownership of the organization;

c) There are changes in teaching materials, training programs, and equipment at the training facility.

2. Application documents for issuance of new aviation training organization certificate, including:

a) An application form for the certificate according to the model prescribed in Appendix 9 issued together with this Circular;

b) Certified copies of documents proving the legal status of the organization applying for the certificate;

c) Copies of the training program and teaching materials consistent with the application content;

d) Report on physical facilities and equipment serving training activities;

đ) List of aviation-specific instructors accompanied by certified copies of relevant diplomas and certificates;

3. Application documents for reissuance of aviation training organization certificate, including:

a) An application form for the certificate according to the model prescribed in Appendix 9 issued together with this Circular;

b) Report on training activities of the organization during the period covered by the previously issued certificate;

c) Explanation report on changes along with modified and supplemented documents.

Article 21. Time Limit for Issuance and Reissuance of Aviation Training Organization Certificate in Air Traffic Services Field

1. Within thirty days from the date of receipt of complete application documents as prescribed, the Civil Aviation Authority of Vietnam shall complete the review and issue the aviation training organization certificate to the applicant.

In case the application documents are incomplete, within seven working days from the date of direct receipt or the postmark date, the Civil Aviation Authority of Vietnam shall request the applicant to supplement the documents, and the processing time will start from the date of receipt of complete documents.

2. Within ten days from the date of receipt of complete application documents as prescribed, the Civil Aviation Authority of Vietnam shall reissue the certificate due to expiration of validity.

3. Within fifteen days from the date of receipt of complete application documents as prescribed for cases stipulated in points b and c, Clause 1, Article 20 of this Circular.

Chapter VI

APPROVAL OF SEARCH AND RESCUE PLANS, EMERGENCY RESPONSE PLANS AT AIRPORTS, AND DRILL PLANS BY AIR TRAFFIC SERVICES PROVIDERS

Article 22. Application Documents for Approval of Search and Rescue Plans, Emergency Response Plans at Airports, and Drill Plans for Search and Rescue, Emergency Response at Airports by Air Traffic Services Providers

1. Air traffic services providers responsible for search and rescue, emergency response at airports must establish and develop search and rescue plans, emergency response plans at airports, and drill plans to submit to the Civil Aviation Authority of Vietnam for approval in accordance with Clause 4, Article 6 of Decision No. 26/2007/QĐ-BGTVT dated May 23, 2007 of the Minister of Transport on civil aviation search and rescue regulations. Application documents include:

a) A request for approval of search and rescue plans, emergency response plans at airports, and drill plans for search and rescue, emergency response at airports according to the model prescribed in Appendix 14 issued together with this Circular;

b) Draft of search and rescue plans, emergency response plans at airports, and drill plans for search and rescue, emergency response at airports.

2. Application documents for approval of amendments to search and rescue plans, emergency response plans at airports, and drill plans for search and rescue, emergency response at airports for air traffic services providers, including:

a) A request for approval of amendments and supplements to search and rescue plans, emergency response plans at airports, and drill plans for search and rescue, emergency response at airports according to the model prescribed in Appendix 14 issued together with this Circular;

b) Amended and supplemented documents for search and rescue plans, emergency response plans at airports, and drill plans for search and rescue, emergency response at airports.

Article 23. Time limit for approving search and rescue plans, airport emergency plans, and drill plans of search and rescue service providers

1. Within fifteen days from the date of receiving complete files as prescribed, the Civil Aviation Administration of Vietnam shall be responsible for examining the files, conducting inspections, evaluations, and deciding on the approval or amendment approval of search and rescue plans, airport emergency plans, training and drill plans for search and rescue service providers.

2. The Civil Aviation Administration of Vietnam shall check the completeness of the files according to regulations within five working days from the date of receipt of the files. If the files are not complete as prescribed, the Civil Aviation Administration of Vietnam shall notify the organization directly or in writing and the approval time will be calculated from when the files are complete as prescribed.

In case the files are accepted, within ten days from the date of receiving the files, the Civil Aviation Administration of Vietnam shall organize meetings with relevant organizations and enterprises to review the files. Based on the results of the review, the Civil Aviation Administration of Vietnam shall decide on the initial approval or amendment approval of search and rescue plans, airport emergency plans, and drill plans for search and rescue service providers.

During the inspection and evaluation of the files, the Civil Aviation Administration of Vietnam may request the enterprise to provide information or documents to clarify related issues.

Chapter VII

PROCEDURES FOR APPROVING FLIGHT PROCEDURES, AIR TRAFFIC INFORMATION NOTAM FORMATS, ISSUANCE OF CERTIFICATES OF AERONAUTICAL NUMBER AND TECHNICAL ADDRESS OF AIRPORT SYSTEMS

Article 24. Documents for requesting approval of civil aviation flight procedures

1. Documents for requesting approval of civil aviation flight procedures include:

a) Application form for approval of civil aviation flight procedures as prescribed in Appendix 6 issued together with this Circular;

b) Statistical report of obstacles within a radius of 55 kilometers from the navigation aid equipment used to establish the procedure;

c) Report on data about airports and navigation aids;

d) Copy of documents detailing the minimum safe altitude in each zone, detailed stages of the flight procedure shown on aeronautical maps at a scale of 1:250,000; detailed final approach and missed approach stages of the approach procedure shown on aeronautical maps at a scale of 1:100,000;

đ) For precision approach procedures, in addition to the documents prescribed in point d of Clause 1 of this Article, must also include: copy of detailed final approach and missed approach stages shown on aeronautical maps at a scale of 1:100,000 or 1:50,000; copy of statistical and evaluation reports of obstacles during the precision approach stage according to the obstacle identification surface, risk assessment model, and basic surfaces of the landing system;

e) Overall diagram of the flight procedure at a scale of 1:250,000;

g) Parameters used for calculation and calculation steps during the establishment of the flight procedure;

h) Description of the process of establishing civil aviation flight procedures;

i) Summary of opinions of air traffic service providers and air traffic information service providers regarding the application for approval of flight procedures (attached with the request for opinions of the organization or individual applying);

2. Documents for requesting approval of amendments and supplements to civil aviation flight procedures include:

a) Application form for approval of amendments and supplements to flight procedures as prescribed in Appendix 6 issued together with this Circular;

b) Copies of documents related to the application for amendments and supplements to flight procedures;

c) Safety assessment report for the application for amendments and supplements to civil aviation flight procedures.

3. Within fifteen days from the date of receiving complete files as prescribed, the Civil Aviation Administration of Vietnam shall be responsible for examining the files, conducting inspections, evaluations, and approving new or amending and supplementing civil aviation flight procedures.

The Civil Aviation Administration of Vietnam shall check the completeness of the files according to regulations within five working days from the date of receipt of the files. If the files are not complete as prescribed, the Civil Aviation Administration of Vietnam shall notify the organization directly or in writing and the approval time will be calculated from when the files are complete as prescribed.

In case the files are accepted, within ten days from the date of receiving the files, the Civil Aviation Administration of Vietnam shall organize meetings with relevant organizations to review the files. Based on the results of the review, the Civil Aviation Administration of Vietnam shall issue decisions on new approval or amending and supplementing civil aviation flight procedures. During the inspection and review process, the Civil Aviation Administration of Vietnam may request the organization to provide information or documents to clarify related issues.

Article 25. Documents for Requesting Approval to Issue Aviation News Publications

1. Organizations participating in providing aviation news services and facilities providing aviation news services shall be responsible for drafting and submitting to the Vietnam Civil Aviation Authority for approval aviation news publications, including: aviation news collections, amendments to aviation news collections, additions to aviation news collections, aviation notices, and aviation telegrams in accordance with Chapters III, IV, and V of Decision No. 21/2007/QĐ-BGTVT dated April 6, 2007, issued by the Ministry of Transport on the regulations for aviation news dissemination. The request documents include:

a) A request document for approval and issuance of aviation news publications according to the model prescribed in Appendix 14 attached hereto;

b) Drafts of aviation news publications.

2. The time limit for results is stipulated as follows:

a) Within seven working days from the date of receipt of complete documents in accordance with the provisions, the Vietnam Civil Aviation Authority shall approve aviation news collections, amendments to aviation news collections, additions to aviation news collections, airway diagrams, and aviation maps;

b) Within three working days from the date of receipt of complete documents in accordance with the provisions, the Vietnam Civil Aviation Authority shall approve amendments to aviation news collections, additions to aviation news collections during the periodic control and adjustment of aviation news;

c) Within two working days from the date of receipt of complete documents in accordance with the provisions, the Vietnam Civil Aviation Authority shall approve aviation notices;

d) On the same day, the Vietnam Civil Aviation Authority shall approve aviation telegrams.

3. In cases of force majeure, enterprises participating in providing aviation news services shall follow the following procedures:

a) Send an aviation telegram;

b) Report briefly to the Vietnam Civil Aviation Authority via telephone;

c) Submit a detailed report in writing according to the model prescribed in Appendix 14 attached hereto to the Vietnam Civil Aviation Authority as soon as possible.

Article 26. Documents for Requesting Assignment of Identification Numbers and Technical Addresses of Technical Systems, Equipment, Information, Navigation, and Surveillance

1. The Vietnam Civil Aviation Authority is the agency managing and assigning identification numbers and technical addresses of technical systems, equipment, information, navigation, and surveillance according to the list specified in Clause 1 of Article 10 of Decision No. 14/2007/QĐ-BGTVT dated March 26, 2007, issued by the Minister of Transport on civil aviation information, navigation, and surveillance regulations. The request documents include: a request document for assignment of identification numbers and technical addresses of technical systems, equipment, information, navigation, and surveillance according to the model prescribed in Appendix 14 attached hereto.

2. Within five working days from the date of receipt of complete documents in accordance with the provisions, the Vietnam Civil Aviation Authority will issue a certificate of identification numbers and technical addresses of technical systems, equipment, information, navigation, and surveillance.

Article 27. Documents for Requesting Issuance of Operation Certificates for Equipment Ensuring Flight Operations Produced or Improved in Vietnam

1. The request documents include:

a) An application form for issuance of operation certificates for equipment ensuring flight operations produced or improved in Vietnam according to the model prescribed in Appendix 5 attached hereto;

b) Certified copies of design documentation, including: product description; applicable standards; design drawings;

c) Certified copies of testing and inspection reports at approved testing facilities;

d) Certified copies of installation instructions, production procedures, technical characteristics descriptions, and product descriptions;

đ) Certified copies of test records of products installed and tested over a period of twelve months, with satisfactory test results.

2. Within ten days from the date of receipt of complete documents in accordance with the provisions, the Vietnam Civil Aviation Authority will review the documents, conduct inspections, evaluations, and decide on issuing operation certificates for equipment ensuring flight operations produced or improved in Vietnam for the requesting organization.

During the inspection and evaluation process, the Civil Aviation Authority of Vietnam may request the organization to provide additional information or documents to clarify related issues.

3. In case of rejection of the application, within three working days, the Vietnam Civil Aviation Authority shall notify the organization in writing and specify the reasons.

Chapter VIII

IMPLEMENTING PROVISIONS

Article 28. Implementation Organization

Vietnam Civil Aviation Authority:

1. Shall be responsible for implementing this Circular.

2. Shall compile and report to the Ministry of Transport issues arising and difficulties encountered during implementation for timely research and resolution.

Article 29. Effectiveness and Responsibility for Implementation

1. This Circular takes effect 45 days from the date of signature.

2. Attached hereto are the following 14 Appendices:

a) Appendix 1: Model Application Form for Issuing Exploitation Licenses for Air Traffic Service Facilities;

b) Appendix 2: Model Application Form for Reissuing Exploitation Licenses for Air Traffic Service Facilities;

c) Appendix 3: Model Application Form for Issuing Exploitation Licenses for Technical Systems and Equipment Ensuring Air Traffic Services;

d) Appendix 4: Model Application Form for Reissuing Exploitation Licenses for Technical Systems and Equipment Ensuring Air Traffic Services;

đ) Appendix 5: Model Application Form for Issuing Certificates for Technical Systems, Equipment Ensuring Air Traffic Services Produced or Improved in Vietnam;

e) Appendix 6: Model Application Form for Approving Civil Aviation Flight Procedures;

g) Appendix 7: Model Application Form for Approving Operating Instructions of Air Traffic Service Facilities;

h) Appendix 8: Model Application Form for Issuing/Certifying/Reissuing/Renewing Certificates for Air Traffic Controllers;

i) Appendix 9: Model Application Form for Issuing/Reissuing Training Organization Certificates in the Field of Air Traffic Services;

k) Appendix 10: Model Individual License; Model Exploitation License for Technical Systems and Equipment Ensuring Air Traffic Services; Model Exploitation License for Air Traffic Service Facilities;

l) Appendix 11: Model Certificate;

m) Appendix 12: Model Approval;

n) Appendix 13: Model Operating Instructions of Air Traffic Service Facilities;

o) Appendix 14: Model Organizational Document.

3. Repeal Articles 21, Article 28, and Article 37 of Decision No. 14/2007/QĐ-BGTVT dated March 26, 2007, issued by the Minister of Transport on the Civil Aviation Information, Guidance, and Supervision Regulations; Articles 17, Article 61, and Article 62 of Decision No. 21/2007/QĐ-BGTVT dated April 6, 2007, issued by the Minister of Transport on the Civil Aviation News Reporting Regulations; Articles 12 and Article 67 of Decision No. 32/2007/QĐ-BGTVT dated July 5, 2007, issued by the Minister of Transport on the Civil Aviation Air Traffic Control Regulations; Articles 41, Article 42, Article 46, and Article 47 of Circular No. 19/2009/TT-BGTVT dated September 8, 2009, issued by the Minister of Transport on Civil Aviation Meteorological Regulations; and Article 6 of Circular No. 28/2009/TT-BGTVT dated November 10, 2009, issued by the Minister of Transport on Civil Aviation Flight Procedures.

4. The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, the Director of the Civil Aviation Administration of Vietnam, Heads of agencies, organizations, and individuals concerned shall be responsible for implementing this Circular./.
