CIRCULAR
Regulations on criteria for identifying invasive alien species and issuance of the List of Invasive Alien Species

MINISTER OF NATURAL RESOURCES AND ENVIRONMENT
Pursuant to Section 3, Chapter IV, Law on Biodiversity dated November 13, 2008;
Pursuant to Decree No. 25/2008/NĐ-CP dated March 4, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;
At the proposal of the General Director of the Environment Administration, the Head of the Legal Department,
c) Enterprises may be granted permission for no more than one block out of the total three dual-frequency blocks (FDD) B
Article 1. Criteria for identifying invasive alien species
1. Known invasive alien species meet the following criteria:
a) Have established populations in Vietnam, encroaching upon habitats or causing harm to native species, showing tendencies or currently causing ecological imbalance at their sites of occurrence or demonstrating potential harmfulness through field trials;
b) Have been recorded as causing serious harm in many countries with similar ecological conditions to Vietnam;
c) Have been evaluated and unanimously identified as invasive alien species by the Scientific Advisory Council established by the Ministry of Natural Resources and Environment.
2. Potentially invasive alien species meet the following criteria:
a) Not yet introduced into Vietnam or have appeared in Vietnam but have not established natural populations;
b) Have been recorded as causing harm in many countries with similar ecological conditions to Vietnam;
c) Have been evaluated and unanimously identified as potentially invasive alien species by the Scientific Advisory Council established by the Ministry of Natural Resources and Environment.
Article 2. Annexed to this Circular is the List of Invasive Alien Species, including:
1. Known invasive alien species;
2. Potentially invasive alien species.
Article 3. Implementation provisions
1. This Circular takes effect from August 15, 2011.
2. Annually, the General Director of the Environment Administration shall be responsible for organizing surveys, identifying, and evaluating invasive alien species according to the criteria stipulated in Article 1 of this Circular, and submitting proposals to the Minister for amending and supplementing the List of Invasive Alien Species.
3. Ministries, ministerial-level agencies, government-affiliated agencies, People's Committees at all levels, the General Director of the Environment Administration, heads of units under the Ministry, and related organizations and individuals are responsible for implementing this Circular./.
