Pursuant to the Law on Physical Culture and Sports dated November 29, 2006;
Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012, of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 76/2013/NĐ-CP dated July 16, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;
At the proposal of the Minister of Culture, Sports and Tourism,
The Prime Minister issues a Decision stipulating the functions, tasks, powers, and organizational structure of the General Department of Physical Culture and Sports under the Ministry of Culture, Sports and Tourism.
Article 1. Position and Functions
1. The General Department of Physical Culture and Sports is an organization under the Ministry of Culture, Sports and Tourism, performing the function of advising and assisting the Minister of Culture, Sports and Tourism in managing state administration and enforcing laws on physical culture and sports throughout the country, managing public services related to physical culture and sports in accordance with the provisions of the law.
2. The General Department of Physical Culture and Sports has legal personality, uses a seal with the National Emblem, maintains a separate account at the State Treasury, and is headquartered in Hanoi city.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Submit to the Minister of Culture, Sports and Tourism for submission to the Government and the Prime Minister for decision:
a) Draft laws, ordinances; draft resolutions of the National Assembly and the Standing Committee of the National Assembly; draft resolutions and decrees of the Government on physical culture and sports; other projects and programs assigned by the Minister of Culture, Sports and Tourism;
b) Strategies, overall plans, national programs for developing physical culture and sports; important national projects and works on physical culture and sports; draft decisions and directives of the Prime Minister on physical culture and sports;
c) Negotiations, signing, joining international treaties on sports;
d) Organizing national sports meetings, regional, continental and world sports meetings.
2. Submit to the Minister of Culture, Sports and Tourism for approval and issuance:
a) Long-term, five-year and annual plans for the development of sports and projects and programs on sports;
b) Circulars, decisions, and directives on managing mass physical culture and sports activities, sports for persons with disabilities, recreational sports, high-performance sports, professional sports, and other activities in the field of physical culture and sports;
c) Decisions organizing regional, continental, and world championships in each sport discipline held in Vietnam; general regulations for the National Physical Culture and Sports Games;
d) National standards and technical regulations for sports facilities, training and competition equipment of sports establishments and sports disciplines;
đ) Plans for coordinating activities among ministries, ministerial-level agencies, government agencies, provincial people's committees, centrally governed cities, and central political-social organizations and social organizations in implementing tasks related to physical culture and sports;
e) Policies and measures for managing public services related to physical culture and sports in accordance with the law; criteria for classifying public institutions in the field of physical culture and sports;
3. Assist the Minister of Culture, Sports and Tourism in directing, guiding, and inspecting the implementation of regulatory legal documents, strategies, plans, programs, and projects and programs on physical culture and sports;
4. Regarding international cooperation:
Implement international treaties, participate in international organizations on physical culture and sports; international cooperation programs and plans on physical culture and sports; implement international cooperation and integration in the field of physical culture and sports according to the classification of the Minister of Culture, Sports and Tourism and the provisions of the law;
5. Regarding physical culture and sports for all:
a) Propagate and mobilize the people to participate in physical culture and sports activities; guide methods of physical exercise suitable for age, gender, occupation, health status, and disability conditions;
b) Guide sectors and localities in training and building teams of physical culture and sports instructors and volunteers; coordinate in organizing professional training and vocational training for grassroots physical culture and sports volunteers;
b) Guiding sectors and localities in training and building a team of sports instructors and volunteers; coordinating in organizing professional training for grassroots sports volunteers;
c) Taking the lead in exploiting and popularizing traditional sports and health improvement methods both domestically and internationally;
d) Directing and organizing national mass sports competitions;
đ) Guiding and organizing inspections and evaluations of the development of mass sports movements;
6. Regarding physical education and sports in schools:
Assist the Minister of Culture, Sports and Tourism in coordinating with the Ministry of Education and Training in carrying out tasks:
Regarding physical education and school sports activities:
Assist the Minister of Culture, Sports and Tourism in cooperating with the Ministry of Education and Training in performing the following tasks:
c) Train and guide the implementation of policies and systems for physical education and sports teachers and lecturers;
b) Specifying physical fitness standards and evaluating physical fitness results of students;
c) Organizing training and guiding the implementation of policies for physical education teachers and lecturers;
d) Specifying the system of school sports competitions.
b) Advise and assist the Minister of Culture, Sports and Tourism in coordinating with the Ministry of Defense and the Ministry of Public Security to issue standards for physical training in the People's Army and the People's Public Security Force; organize training and professional development for coaches, athletes, and regulations for sports competitions within armed forces;
Regarding high-performance sports and professional sports:
a) Assist the Minister of Culture, Sports and Tourism in advising on the implementation of policies and measures for athletes, coaches, and referees in sports;
b) Organize or coordinate in organizing regional, continental, and world sports games held in Vietnam, and the National Physical Culture and Sports Games after being approved by competent authorities;
c) Submit to the Minister of Culture, Sports and Tourism for issuance of regulations on standards, procedures, and processes for awarding ranks to athletes, coaches, and referees;
d) Submit to the Minister of Culture, Sports and Tourism for issuance of regulations on procedures and processes for establishing national sports teams and national teams in each sport discipline;
đ) Guide the development of training and coaching programs for athletes, coaches, and referees;
e) Guide the registration of activities for professional sports clubs;
g) Issue competition rules for each sport discipline; competition regulations for each sport discipline at the National Physical Culture and Sports Games;
9. Organize and implement research, application of science, technology, and medicine in the field of physical education and sports according to the provisions of the law;
10. Assist the Minister of Culture, Sports and Tourism in managing the activities of associations and non-governmental organizations in the field of physical culture and sports in accordance with the law;
11. Implement investment projects under the General Department of Physical Education and Sports according to the classification of the Minister of Culture, Sports and Tourism and the provisions of the law;
12. Implement specialized statistics work in physical culture and sports; build and manage databases on physical culture and sports; organize information, communication, and promotion activities on physical culture and sports in accordance with the law;
13. Implement administrative reform in the field of physical education and sports according to the administrative reform plan of the Ministry of Culture, Sports and Tourism;
14. Implement inspection work, coordinate in auditing, prevent and combat corruption, waste, and negative practices, and handle violations of the law in the field of physical culture and sports in accordance with the law;
15. Manage the organizational structure, civil servant quota, job positions, staff structure by occupational titles, and the number of personnel working in public institutions under the General Department of Physical Culture and Sports; decide on rotation, transfer, appointment, dismissal, removal from office, retirement, resignation, commendation, and disciplinary actions; implement policies and systems, coordinate in training and professional development for civil servants, staff members, and those engaged in physical culture and sports according to the classification of the Minister of Culture, Sports and Tourism and the provisions of the law;
16. Manage finances, assets assigned, and implement budgets allocated according to the provisions of the law;
17. Perform other tasks and powers delegated by the Minister of Culture, Sports and Tourism and according to the provisions of the law;

The units prescribed from Clause 1 to Clause 7 of this Article are organizations assisting the Director General in performing state management functions; the units prescribed from Clause 8 to Clause 18 of this Article are affiliated public service units under the Sports Administration.
The Director of the General Department of Physical Education and Sports shall stipulate the functions, tasks, powers, and organizational structures of the subordinate organizations and units of the General Department of Physical Education and Sports;
Article 4. Leadership of the Sports Administration
1. The Sports Administration has a Director General and not more than three Deputy Directors General.
2. The Director General and the Deputy Directors General are appointed, relieved, rotated, or transferred by the Minister of Culture, Sports and Tourism in accordance with the provisions of law.
3. The Director General of the Sports Administration is responsible to the Minister of Culture, Sports and Tourism and to the law for all activities of the Sports Administration. The Deputy Director General of the Sports Administration is responsible to the Director General of the Sports Administration and to the law for the areas of work assigned to them.
Article 5. Effectiveness and Responsibility for Implementation
1. This Decision takes effect from May 2, 2014, and replaces Decision No. 66/2008/QD-TTg dated May 23, 2008, of the Prime Minister stipulating the functions, tasks, authorities, and organizational structure of the Sports Administration under the Ministry of Culture, Sports and Tourism.
2. The Minister of Culture, Sports and Tourism, the Ministers, Heads of ministerial-level agencies, Heads of central government agencies, Chairpersons of provincial People's Committees directly under the Central Government, and the Director General of the Sports Administration are responsible for implementing this Decision./.
