The Minister of Transport issues this Circular guiding the implementation of incentive competition and commendation work in the transport industry.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
THIS Circular guides the implementation of encouragement and reward work in the Transport Industry, including: Organization and promotion of competition movements, commendation titles and criteria for competition; classification, forms, and criteria for rewards; authority to decide and present commendation titles and reward forms; procedures and formalities for presenting commendation titles and reward forms; Competition Promotion and Reward Council, Scientific Council, Initiative Council; Competition and Reward Fund; record keeping, report preparation, inspection, handling violations, and resolving complaints and denunciations regarding competition and reward;
Article 2. Applicability
THIS Circular applies to organizations and individuals contributing to the construction and development of the Vietnamese transport industry, including:
1. Collectives and individuals within agencies and units under the Ministry of Transport.
2. Departments of Transport of provinces and centrally governed cities (hereinafter referred to collectively as Departments of Transport).
3. Organizations and individuals operating in the transport sector.
4. Individuals who are Vietnamese or foreigners; Vietnamese and foreign agencies and organizations, and international organizations in Vietnam.
Article 3. Principles of Competition and Reward
c) The granting of competition titles must be based on competition movements; all collectives and individuals participating in these movements must register for competition, set goals, and establish targets; those not registering will not be considered for competition titles.
a) Voluntary, conscientious, public;
b) Unity, cooperation, mutual development;
c) The consideration for awarding commendation titles must be based on the competition movement; all individuals and collectives participating in the competition movement must register for competition, set goals and competition indicators; those not registering for competition will not be considered for recognition of commendation titles.
b) A single form of reward may be given multiple times to the same recipient; multiple forms of reward shall not be given for a single achievement;
a) Accurate, public, fair, timely;
d) Ensure gender equality in competition and reward activities;
c) Ensure consistency between the nature, form, and recipient of commendation.
d) Closely combine spiritual encouragement with material incentives.
e) Achievements made under difficult conditions and with significant impact shall be rewarded at a higher level. Emphasis should be placed on rewarding direct workers and individuals with many innovations in their work and duties;

When there are multiple individuals and collectives meeting the conditions and criteria for rewarding economic and social achievements, preference should be given to selecting female individuals and collectives with a female ratio of seventy percent or more for consideration for reward;
i) The time for proposing the next reward is calculated from the date of the previous reward decision;
k) For individuals, in one year, only one form of state-level reward or title "National Model Worker" can be proposed; one form of ministry-level reward or title "Transport Industry Model Worker" (except for exceptional cases).
Article 4. Responsibilities for organizing and launching competition movements and implementing commendation work
1. The Minister of Transport shall launch and direct competition movements throughout the entire transport industry.
2. The Standing Committee of the Competition and Commendation Council of the Ministry, based on specific tasks and targets set out in the annual and long-term plans of the industry, will collaborate with the Vietnam Transport Workers' Union to advise and propose policies, contents, programs, plans, and measures for competitions; organize and inspect competition movements and commendation work; advise on mid-term and final reviews of competition movements, promote exemplary models; propose commendations and suggest innovations in competition and commendation work within the entire industry and each specialized field.
3. Heads of agencies and units within the transport industry are responsible for leading and coordinating with relevant mass organizations at the same level to organize, launch, and direct competition movements within their management scope; actively identify and select collectives and individuals with outstanding achievements for commendation or recommend higher-level commendations; organize propaganda and promote exemplary models.
4. Heads of information, press, and publishing agencies in the transport industry are responsible for proactively collaborating with the Standing Committee of the Competition and Commendation Council of the Ministry and other mass media outlets to publicize competition and commendation work; disseminate and set examples of exemplary models, good people and deeds, and encourage competition movements and commendation activities.
Article 5. Reward Fund
1. Establish a Competition and Commendation Fund to organize competition movements and commendation work.
2. The Competition and Commendation Fund is formed from state budget, enterprise reward funds, contributions from domestic and foreign individuals and organizations, and other lawful sources of income.
3. Strictly prohibit using the Competition and Commendation Fund for purposes other than its intended use.
Chapter II
ORGANIZING AND LAUNCHING COMPETITION MOVEMENTS,
AWARDS AND STANDARDS FOR COMPETITIONS
Article 6. Forms and Contents of Competitions
1. Competition is organized in the following forms:
a) Regular competitions are organized daily, monthly, quarterly, and annually to achieve the goals, targets, and work programs set by the Ministry or by agencies and units.
b) Periodic competitions (or thematic competitions) are organized to implement key tasks and urgent matters during specific phases and timeframes.
2. Contents of organizing and launching competition movements:
a) Clearly define the objectives, scope, and target groups of the competition, and based on this, establish specific targets and contents of the competition. Determining the content and targets of the competition must ensure scientific accuracy, be consistent with the actual conditions of the agency or unit, and be feasible;
b) Measures to organize, mobilize, and monitor the competition process and direct the competition movement;
c) Mid-term and final reviews of the competition movement; evaluate and draw lessons; select outstanding collectives and individuals in the competition movement for commendation or recommend commendations.
Article 7. Registering for Competitions and Awards
1. Each year, agencies and units under the Ministry and Provincial Departments of Transport shall proactively organize for individuals and collectives to register for competitions with specific contents, targets, and awards; compile and submit these registrations to the Competition and Commendation Council of the Ministry of Transport before March 1st of each year.
2. Periodic competition movements (or thematic competitions):
a) Agencies, units, and Provincial Departments of Transport that organize periodic (thematic) competitions must proactively develop plans and register for competitions, and send details of the commendation forms to the Ministry of Transport.
b) Advisory bodies assisting the Minister, General Bureaus, and Bureaus directly under the Ministry, and Project Management Boards assigned by the Ministry of Transport to oversee periodic (thematic) competitions aimed at implementing large projects, works, programs, or major proposals of the Ministry or responding to large-scale campaigns involving many participants must proactively organize competitions, register for competitions, and send related commendation forms of involved agencies and units to the Ministry of Transport.
c) For construction projects involving multiple participants, Project Management Boards tasked with managing such projects are responsible for organizing and registering for competitions, and leading the compilation of commendation forms to be submitted to the Ministry.
Article 8. Commendation Titles
1. For individuals:
a) The title "Advanced Worker";
b) The title "Outstanding Worker at the Grassroots Level";
c) The title "Outstanding Worker in the Transport Industry";
d) The title "National Outstanding Worker".
2. For groups:
a) The title "Advanced Labor Collective";
b) The title "Excellent Labor Collective";
c) The title "Excellence Flag of the Ministry of Transport";
d) The title "Government Excellence Flag".
Article 9. Criteria for Awards for Individuals
1. Title "Advanced Worker"
a) The title "Advanced Worker" is reviewed annually for individuals meeting the following criteria:
- Successfully completing assigned tasks with high productivity and quality; for workers and employees, effective production labor;
- Adhering well to regulations and rules of the agency or unit and policies and laws of the Party and State; having a spirit of overcoming difficulties to complete tasks; being cooperative and supportive towards colleagues; actively participating in competition movements;
- Actively studying politics, culture, professional knowledge, and vocational skills;
- Having good morals and a healthy lifestyle.
b) Women on maternity leave according to national regulations and those who have performed brave acts of saving lives or property, or those injured in combat or support roles requiring medical treatment as determined by health authorities, will still be considered for the title "Advanced Worker" and can serve as grounds for awarding other commendation titles and forms.
c) Individuals attending short-term training courses under one year, if achieving satisfactory results, complying with training center regulations, may combine their work period with the training period for the review of the title "Advanced Worker". In cases where training lasts one year or more and satisfactory academic results are achieved, the year of training is equivalent to the title "Advanced Worker" for the purpose of awarding other commendation titles and forms.
d) For individuals transferred to a new workplace, the new agency or unit shall be responsible for reviewing and nominating the title "Advanced Worker" based on comments from the previous agency or unit (in cases where the individual has worked at the previous unit for six months or more), and such nomination shall serve as grounds for awarding commendations and other forms of recognition.
The title "Advanced Worker" shall not be awarded to individuals who have not registered for competition; those newly hired for less than ten months; those absent from work for forty working days or more; those penalized for administrative violations; or those disciplined with a reprimand or higher.
2. Title "Model Worker at the Grassroots Level"
The title "Model Worker at the Grassroots Level" shall be awarded to individuals meeting the following criteria:
a) Being a "Pioneering Worker";
b) Having innovative solutions that are technical, management, operational, or applications of advanced technology to increase labor productivity and improve work efficiency, recognized by the Scientific Council (Innovation Council) at the grassroots level; or having research topics that have been accepted and applied; or participating in drafting legal regulations at the Ministry level; completing tasks exceptionally well, recognized by the agency or unit.
The proportion of individuals recognized with the title of "Model Worker at the Grassroots Level" shall not exceed fifteen percent of the total number of individuals achieving the title of "Advanced Worker."
3. Title "Model Worker in the Transportation Industry"
The title "Model Worker in the Transportation Industry" shall be awarded to individuals meeting the following criteria:
a) Demonstrating outstanding achievements among those who have continuously received the title "Model Worker at the Grassroots Level" three times consecutively;
b) Achievements, innovations, work methods, and research topics of the individual must have significant influence on the Ministry and be recognized by the Scientific and Innovation Councils of the Ministry, industry, province, or central mass organizations;
4. The title of "National Model Worker"
a) The title "National Model Worker" shall be awarded to individuals with the most outstanding achievements selected from those who have twice consecutively received the title of Model Worker at the Ministry, industry, provincial, or central mass organization levels;
b) Research topics and scientific studies serving as grounds for awarding the title "National Model Worker" must achieve high effectiveness and have nationwide impact;
The Innovation Council and Scientific Council at the Ministry level shall assist the head in reviewing, recognizing, and evaluating the impact of innovations and research topics;
c) The title "National Model Worker" shall be awarded in the year immediately following the second time the individual receives the title "Model Worker in the Transportation Industry";
Article 10. Criteria for commendation titles for collectives
1. The title of "Advanced Labor Collective"
The title "Advanced Labor Collective" shall be awarded annually to collectives that meet the following criteria:
a) Successfully completing assigned tasks and plans;
b) Having a regular, practical, and effective competition movement;
c) More than fifty percent of individuals in the collective achieve the title of "Advanced Worker," and there are no individuals disciplined with a warning or higher;
d) Internal unity and strict adherence to the policies and laws of the Party and State.
The title "Advanced Working Collective" shall not be awarded to collectives in the following situations: those who have not registered for competition; newly established collectives under ten months; and those with members who have been disciplined with a warning or higher.
2. The title of "Outstanding Labor Collective"
The title "Outstanding Labor Collective" shall be awarded annually to collectives that meet the following criteria:
a) Demonstrating a spirit of creativity, overcoming difficulties, and excelling in completing tasks while fulfilling their obligations to the State;
b) All individuals within the collective successfully completing assigned tasks, with at least 70% of them achieving the title "Advanced Worker";
c) Having members who have received the title "Model Worker at the Grassroots Level" and no member disciplined with a warning or higher;
d) Internal unity and exemplary compliance with the policies and laws of the Party and State;
3. Title "Outstanding Flag of Competition of the Ministry of Transport"
The title "Outstanding Flag of Competition of the Ministry of Transport" shall be awarded annually to outstanding collectives that excel comprehensively in their assigned tasks, recognized as leading units in competition groups within the Ministry (awarded to grassroots units and their superiors) and meeting the following criteria:
a) Exceeding the assigned targets and tasks for the year;
b) Having practical and effective competition movements; new factors, models, and exemplary role models for other units to emulate;
c) Internal unity and strict adherence to the policies and laws of the Party and State, leading in practicing thrift, combating waste, corruption, and other social evils;
4. The title of "Flag of Excellence of the Government"
The title "Flag of Competition of the Government" shall be awarded annually to outstanding grassroots units and their superiors meeting one of the following criteria:
a) Achieving excellent results beyond set targets and tasks for the year; being an outstanding example nationally; having new factors and models for national emulation; internal unity and leadership in practicing thrift, combating waste, corruption, and other social evils; the most outstanding collectives among those achieving the Outstanding Flag of Competition of the Ministry of Transport standard;
b) The most outstanding collectives in thematic competition movements initiated by the President or Prime Minister, evaluated during mid-term and final reviews over five years or more.
Chapter III
CLASSIFICATION, FORMS, AND STANDARDS FOR RECOGNITION AND REWARD
Article 11. Classification of Awards
1. Regular awards are annual awards given to collectives and individuals who have achieved outstanding results at the end of the implementation of the annual or multi-year plan.
2. Campaign awards (or thematic awards) are awards given to collectives and individuals who have achieved outstanding results after completing a campaign, program, or specific work theme initiated by the President, Prime Minister, Minister, or heads of agencies and units. The Ministry of Transport will provide separate guidance for awards recognizing outstanding achievements after the completion of a project or program.
3. Unexpected awards are awards given to collectives and individuals who have achieved unexpected outstanding results in labor production; bravery in rescuing people and state property (unexpected achievements are those made in unforeseen circumstances outside the regular planned work that the collective or individual must undertake).
4. Contribution awards are awards given to individuals who have made outstanding contributions during various revolutionary stages (holding leadership positions in state agencies, public institutions, political organizations, social-political organizations) and have contributed significantly to the revolutionary cause of the Party and the nation.
5. Diplomatic awards are awards given to individuals, agencies, and organizations from foreign countries and international organizations in Vietnam; and collectives and individuals outside the transport sector who have made significant contributions to the construction and development of the Vietnamese transport sector.
Article 12. Forms of Reward
1. State-level commendation forms
a) Orders of merit;
b) Friendship Medals;
c) Title of "Heroic Laborer";
d) Title of "Heroic People's Armed Forces";
đ) Title of "People's Teacher", "Outstanding Teacher";
e) Title of "People's Doctor", "Outstanding Doctor";
g) Ho Chi Minh Award, State Award;
h) Certificate of Merit from the Prime Minister.
2. Ministry-level commendation forms
a) Commemorative Medal "For the Development of the Vietnamese Transportation Industry";
b) Certificate of Merit of the Minister of Transport;
c) Banner of the Ministry of Transport.
3. Basic-level commendation forms
Certificate of Merit of the Head of subordinate agencies under the Ministry (having legal personality, having a bank account, having its own seal).
Article 13. Criteria for State-level commendation
1. Standards for Orders, Medals, titles of "Heroic Laborer", "Heroic People's Armed Forces", Certificate of Merit of the Prime Minister shall be implemented according to the provisions of Clause 1 and Clause 2, Article 20; Clause 1, Article 21; Articles 38, 39, 43, 44 of Decree No. 42/2010/NĐ-CP; Articles 7, 8, 9, 10, 11, 15, 16, 17, 22, 23 of Decree No. 65/2014/NĐ-CP and other relevant normative legal documents.
2. Standards for titles of "People's Teacher", "Outstanding Teacher", "People's Doctor", "Outstanding Doctor"
a) The objects and standards for awarding the titles of "People's Teacher", "Outstanding Teacher", "People's Doctor", "Outstanding Doctor" shall be implemented according to the provisions of Clause 32 and Clause 33, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Mobilization and Reward in 2013 and Article 45 of Decree No. 42/2010/NĐ-CP;
b) Advisory agencies assisting the Minister in the field of education and training (for the title of Teacher) and the field of health (for the title of Doctor) shall take the lead and coordinate with the Standing Committee of the Mobilization and Reward Council of the Ministry to compile and report to the specialized council of the Ministry for review and submission to the State-level council for consideration and decision.
3. Ho Chi Minh Award, State Award
a) The Ho Chi Minh Award and State Award are awarded to authors of one or more scientific research works, technological, educational projects in the transport sector meeting the criteria stipulated in Article 46 and Article 47 of Decree No. 42/2010/NĐ-CP.
b) Advisory agencies assisting the specialized council of the Ministry in these fields shall take the lead and coordinate with the Standing Committee of the Mobilization and Reward Council of the Ministry to compile and report to the specialized council of the Ministry for review and submission to the State-level council for consideration and decision.
Article 14. Criteria for Ministry-level Awards
1. Commemorative Medal "For the Development of the Vietnamese Transport Industry" is awarded according to the provisions of Circular No. 40/2011/TT-BGTVT dated May 18, 2011, issued by the Minister of Transport on procedures for granting the Commemorative Medal "For the Development of the Vietnamese Transport Industry".
2. Certificate of Merit of the Minister of Transport
a) The Certificate of Merit of the Minister of Transport is awarded to exemplary collectives that strictly follow the policies and laws of the Party and the State; maintain internal unity and meet one of the following criteria:
- Achieve outstanding results in mobilization campaigns;
- Achieve unexpected outstanding results with significant impact within their respective fields of the transport industry;
- Consistently achieve the title of Outstanding Labor Collective for two consecutive years; maintain internal unity; implement democratic regulations at the grassroots level well; organize effective mobilization campaigns; care for the material and spiritual life of the collective; practice thrift; fully implement all policies for members of the collective;
- Achieve outstanding results in traffic safety assurance; contribute land, assets to the construction and development of the transport industry.
b) The Certificate of Merit of the Minister of Transport is awarded to exemplary individuals who strictly follow the policies and laws of the Party and the State and meet one of the following criteria:
- Achieve outstanding results in mobilization campaigns;
- Achieve unexpected outstanding results with significant impact within their respective fields of the transport industry;
- Successfully complete tasks for two consecutive years prior to the recommendation period, during which recognized and effectively applied innovations at the grassroots level; or twice received certificates of merit; or once received a certificate of merit and once received the title of Model Worker at the grassroots level;
- Achieve outstanding results in traffic safety assurance; contribute land, assets to the construction and development of the transport industry.
3. Banner of the Ministry of Transport
The Banner of the Ministry of Transport is an award form given to collectives (at the grassroots or higher levels) that have been established and developed for five years or more and are awarded on the occasion of the anniversary of the agency or unit.
4. Certificate of Merit of the Head of subordinate agencies under the Ministry
The Certificate of Merit of the Head of subordinate agencies under the Ministry is awarded according to the provisions of Clause 42, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Mobilization and Reward in 2013 and Article 50 of Decree No. 42/2010/NĐ-CP.
Chapter IV
AUTHORITY TO DECIDE AND BESTOW MOBILIZATION AWARDS AND AWARD FORMS
Article 15. Decision-Making Authority
1. The authority to decide on awarding commendation titles, national-level commendation forms, Orders, Medals, State Honorary Titles, Ho Chi Minh Prize, State Prize, Government Flag of Merit, National Model Worker, and Prime Minister's Certificate of Merit shall be implemented in accordance with Articles 77 and 78 of the Law on Commendation and Awards.
2. The authority to decide on awarding commendation titles and commendation forms at the sectoral level and for subordinate agencies and units:
a) The Minister of Transport decides to award the "Outstanding Flag of the Ministry of Transport", "Outstanding Labor Collective", Banner of the Ministry of Transport to collectives, the title of "Model Worker of the Transport Industry", Commemorative Medal "For the Development of the Vietnamese Transport Industry" to individuals, and Certificates of Merit from the Minister to collectives and individuals within and outside the transport industry;
b) Heads of agencies and units under the Ministry that have legal personality consider awarding the titles of "Advanced Worker", "Commendable Model Worker", "Advanced Labor Collective", and Certificates of Merit to individuals and collectives under their management. For agencies and units without legal personality, the immediate superior head shall examine and award them.
Article 16. Organization of Awarding
1. The ceremony for presenting national commendation titles and forms includes: "Government Flag of Merit", "National Model Worker", Orders, Medals of various types, State Honorary Titles, "Ho Chi Minh Prize", "State Prize", "Prime Minister's Certificate of Merit". These ceremonies are carried out in accordance with the provisions of Government Decree No. 145/2013/NĐ-CP dated October 29, 2013, regarding the organization of commemorative days; presentation and reception ceremonies for commendation forms and commendation titles.
2. The Standing Committee of the Ministry's Commendation and Awards Council is responsible for guiding and inspecting agencies and units in organizing the presentation and reception of national commendation titles and forms solemnly and economically.
3. For collectives and individuals under the Ministry's Agencies who achieve national-level or Ministry-level commendation titles and forms, the Ministry's Office is responsible for organizing the presentation, coordinating with the Personnel Department.
Chapter V
PROCEDURES FOR AWARDS AND RECOGNITION
Article 17. Procedures for Awards
1. The entity managing organizations, cadres, civil servants, public officials, and workers is responsible for commending or submitting to a higher level for commendation of the objects under its jurisdiction.
2. For companies and corporations (which have been equitized) under the Ministry, including those companies and corporations which have transferred state capital to the State Capital Investment Corporation for Management or were previously members of an agency or unit, the Ministry delegates the responsibility to that agency or unit to commend or submit to the Ministry for commendation.
3. For specialized organizations and individuals engaged in party work, mass organizations, the procedures for awards are implemented in accordance with Article 20 of Circular No. 07/2014/TT-BNV.
4. The entity leading the initiation of a themed campaign (or period) of competition, when concluding, selects exemplary cases, then commends or submits to a higher level for commendation. Utilize the form of commendation of the initiating entity to present awards to collectives and individuals who have achieved outstanding results. In cases of particularly outstanding achievements with nationwide impact, recommend to the competent authority to submit to the Prime Minister for consideration of awarding a Certificate of Merit or the President for commendation.
5. Agencies and units under the Ministry must report to the Standing Committee of the Ministry's Commendation and Awards Council for review, comments, and reporting to the leadership of the Ministry when proposing commendations from provincial People's Committees directly under the Central Government or central ministries, sectors, and mass organizations for collectives and individuals under their units.
6. Agencies and units under the Ministry are responsible for identifying and recommending commendations at the Ministry or national levels for collectives and individuals outside the transport industry who have contributed to the construction and development of the transport industry. The Department of Transport is responsible for identifying collectives and individuals who have contributed to the industry and recommending the Minister of Transport for consideration of commendation.
7. Agencies and units within and outside the transport industry proposing commendations for foreign organizations and individuals must submit files to the Ministry of Transport for examination and resolution in accordance with regulations.
8. The Standing Committee of the Ministry's Commendation and Awards Council is responsible for identifying and recommending collectives and individuals with outstanding exemplary achievements and preparing files for submission to the Minister for consideration and decision-making or recommendation for commendation to a higher level.
Article 18. Procedures for Commending and Awarding
1. Examination of competition and commendation according to general procedures
a) The Standing Committee of the Ministry's Competition and Reward Council shall be responsible for:
Reviewing files, summarizing achievements, reporting to the Ministry's Competition and Reward Council for approval on the following forms of commendation: State rewards, Government flags, Ministry outstanding flags, National Model Worker titles (for cases proposed from Third-Class Independence Medal and above and National Model Worker titles must have the opinion of the Party Cadre and Civil Servants' Board of the Ministry before submission). The procedures for bestowing the title "People's Armed Forces Hero" shall be carried out according to the guidelines of the Ministry of Defense.
Reviewing files, reporting to the Minister of Transport for consideration and decision to present: The Flag of the Ministry of Transport, the Commemorative Medal "For the Development of Vietnam's Transport Industry", the Certificate of Merit of the Minister of Transport, the Outstanding Labor Collective title, the Model Worker of the Transport Industry title (for the Model Worker of the Transport Industry title, a list requesting opinions in writing from some members of the Ministry's Competition and Reward Council related to this matter shall be established).
b) Based on achievements in the year, collectives and individuals may be considered for higher, equal, or lower commendation titles than those registered at the beginning of the year, depending on the nature and level of achievements obtained.
c) The endorsement process for competition and reward titles and forms of state commendation shall be implemented according to Article 84 of the Law on Competition and Reward and Clauses 13, 14, and 15 of Article 53 of Decree No. 42/2010/NĐ-CP.
d) Documents submitted to the Ministry of Transport, simultaneously sending emails to the address [email protected] (in .doc format for the proposal letter, list, achievement report; in .pdf format for other related documents, except for documents containing classified information).
e) For agencies and units with the obligation to pay state budget, when preparing documents to propose competition titles and state-level commendation forms for the agency, unit, or individual who is the head of the agency or unit, they must have a confirmation document from the competent authority with the following content: Confirmation of the actual tax payment amount, social insurance contributions, and other revenues paid during the year compared to the registration; the percentage of state budget payments compared to the previous year; confirmation of full and timely payment of all types of taxes and other revenues according to the law.
2. Examination of commendation according to simplified procedures
Simple commendation procedures shall be implemented according to Article 85 of the Law on Competition and Reward. Depending on the sudden achievements and impact scope reached by collectives and individuals, commendation forms such as Medals, Orders, Certificates of Merit from the Prime Minister, Certificates of Merit from the Minister of Transport, or Letters of Commendation from the heads of agencies and units shall be awarded. In cases of posthumous awards, the directly managing unit shall prepare achievement reports and other required documents and procedures for commendation as prescribed.
Article 19. Documents for Proposing Competition Titles
1. Commendation title "Flag of Excellence of the Government"
The application dossier is established in three sets (original copies) including:
a) Report with attached list of proposals;
b) Minutes of meeting and results of secret ballot of the Commendation and Reward Council at the level to be submitted to the Ministry;
c) Achievement report according to Form No. 1 attached to this Circular;
d) For units with the obligation to pay the state budget: Implement according to Clause đ, Article 18 of this Circular;
đ) Opinion of the People's Committee of the commune, ward, town (hereinafter referred to as the People's Committee of the commune) where the main office of the unit is located regarding compliance with the policies of the Party, State, and locality.
2. Title "Outstanding Flag of the Ministry of Transport"
The application dossier is established in one set (original copy) including:
a) Report with attached list of proposals;
b) Minutes of meeting and results of secret ballot of the Commendation and Reward Council at the level to be submitted to the Ministry;
c) Achievement report according to Form No. 1 attached to this Circular.
3. Commendation title "Outstanding Labor Collective"
The application dossier is established in one set (original copy) including:
a) Report with attached list of proposals;
b) Minutes of the meeting and results of secret ballot of the Competition and Reward Council at the level proposing to the Ministry;
c) Achievement report according to Form No. 1 attached to this Circular (the Ministry authorizes the level proposing to the Ministry to store the file. The Ministry will review and check the commendation file if necessary).
4. The title of "National Model Worker"
The application dossier is established in three sets (original copies), including:
a) The proposal letter accompanied by the list must have the written agreement of the same-level Party Committee;
b) Minutes of the meeting and results of secret ballot of the Competition and Reward Council at the level proposing to the Ministry (must have the agreement votes of Council members at 90% or more);
c) Achievement report according to Form No. 2 attached to this Circular;
d) For the head of the unit with the obligation to pay the state budget: Implement according to Clause đ, Article 18 of this Circular;
đ) For individuals who are the head of the unit, there must be an opinion of the People's Committee of the commune (where the individual resides) regarding compliance with the policies of the Party, State, and locality.
5. Title "Model Worker of the Transport Industry"
The application dossier is established in one set (original copy) including:
a) Report with attached list of proposals;
b) Minutes of the meeting and results of secret ballot of the Competition and Reward Council at the level proposing to the Ministry (must have the agreement votes of Council members at 90% or more);
c) Achievement report according to Form No. 2 attached to this Circular.
6. For the titles "Model Worker at the Grassroots Level," "Advanced Worker," and "Advanced Labor Collective," they shall be implemented according to Article 84 of the Law on Competition and Reward.
Article 20. Documents for Proposing Awards
1. Orders of various types
The application dossier is established in four sets (original copies) including:
a) A proposal letter accompanied by a list of proposed awardees (in cases where awards from the Independence Order Third Class and above are proposed, there must be a written agreement from the same-level Party Committee);
b) Minutes of the meeting of the Competition and Reward Council at the level submitting to the Ministry;
c) Achievement reports according to Model No. 2 and Model No. 3 attached to this Circular;
d) For units with obligations to pay state budget and social insurance when proposing to award the unit or its head: Implement the provisions stipulated in point đ, clause 1, Article 18 of this Circular;
đ) The opinion of the People's Committee of the commune (where the main office of the unit is located; place of residence for the unit head) on compliance with the policies of the Party, State, and locality;
The procedure for granting the Friendship Medal shall be carried out in accordance with the provisions of Article 39 of Decree No. 42/2010/NĐ-CP;
2. Friendship Medal
The application dossier is established in four sets (original copies) including:
a) Report with attached list of proposals;
b) Achievement report and list of proposed awardees (the direct proposing unit must prepare an achievement report confirmed by the approving level according to Model No. 4 attached to this Circular);
3. Commendation title "Heroic Laborer"
The application dossier is established in four sets (original copies) including:
a) Proposal letters from the grassroots level to the level submitting to the Ministry must have a written agreement from the same-level Party Committee;
b) Meeting minutes and secret ballot results of the Competition and Reward Councils at all levels (must have the approval of at least 90% of the Council members);
c) Achievement reports according to Model No. 5 and Model No. 6 attached to this Circular;
d) For units with obligations to pay state budget and social insurance when proposing to award the unit or its head: Implement the provisions stipulated in point đ, clause 1, Article 18 of this Circular;
đ) The opinion of the People's Committee of the commune (where the main office of the unit is located; place of residence for the unit head) on compliance with the policies of the Party, State, and locality;
4. Commendation title "Heroic People's Armed Forces"
Procedures and documents for awarding shall be implemented in accordance with the guidelines of the Ministry of National Defense;
5. Certificate of Merit of the Prime Minister
The application dossier is established in three sets (original copies) including:
a) Report with attached list of proposals;
b) Minutes of meeting of the Commendation and Reward Council at the level to be submitted to the Ministry;
c) Achievement reports prepared according to Model No. 1 and Model No. 2 attached to this Circular;
d) For units with obligations to pay state budget and social insurance when proposing to award the unit or its head: Implement the provisions stipulated in point đ, clause 1, Article 18 of this Circular;
đ) The opinion of the People's Committee of the commune (where the main office of the unit is located; place of residence for the unit head) on compliance with the policies of the Party, State, and locality;
6. Titles "People's Teacher", "Outstanding Teacher", "People's Doctor", "Outstanding Doctor"
Procedures and documents for awarding shall be carried out in accordance with the provisions of Article 64 of Decree No. 42/2010/NĐ-CP of the Government and point 24, Article 1 of Decree No. 39/2012/NĐ-CP;
7. Ho Chi Minh Award, State Award
Procedures and documents for awarding shall be carried out in accordance with the provisions of Article 65 of Decree No. 42/2010/NĐ-CP and point 26, Article 1 of Decree No. 39/2012/NĐ-CP;
8. Commemorative Medal "For the Development of Vietnam's Transport Industry"
Procedures and documents shall be carried out in accordance with the provisions of Circular No. 40/2011/TT-BGTVT dated May 18, 2011, issued by the Minister of Transport;
9. Certificate of Merit of the Minister of Transport
The application dossier is established in one set (original copy) including:
a) Report with attached list of proposals;
b) Minutes of meeting of the Commendation and Reward Council at the level to be submitted to the Ministry;
c) Achievement report according to Model No. 1 and Model No. 2 attached to this Circular;
10. Banner of the Minister of Transport
The application dossier is established in one set (original copy) including:
a) Proposal letter of the agency or unit proposing to the Ministry;
b) Minutes of meeting of the Commendation and Reward Council at the level to be submitted to the Ministry;
c) Summary achievement report according to Model No. 1 attached to this Circular;
Article 21. Documents for Simplified Reward Procedures
1. Documents for proposing rewards under simplified procedures include:
a) Proposal letter of the agency or unit proposing to the Ministry;
b) Achievement reports according to Model No. 7 and Model No. 8 attached to this Circular;
2. The proposal documents shall be prepared in one set (original) for ministry-level awards; three sets (original) for state-level awards.
Article 22. Time for submission and examination of commendation files
1. For the titles of Excellence Flag of the Government, Excellent Flag of the Ministry of Transport, and Merit Certificate of the Minister of Transport on the rural and mountainous transport development movement, the deadline for submitting files shall be based on the annual summary guidance on competition and commendation work of the Ministry. The time to examine files shall be based on the time and form of the Department's final meeting.
2. For the forms of commendation such as Merit Certificate of the Prime Minister, various types of Orders, and the title of National Model Worker, the latest deadline for submitting files is April 30 each year. For the title of Labor Hero, according to regulations, it will be organized to examine every five years during the National Competition and Patriotism Congress at all levels, except for special cases of outstanding excellence.
The time for the Competition and Commendation Council of the Ministry to examine and submit national-level commendation files shall be carried out in accordance with point b, Clause 3, Article 1 of Decree No. 39/2012/NĐ-CP.
3. For the titles of People's Teacher, Outstanding Teacher, People's Doctor, Outstanding Doctor, Ho Chi Minh Award, State Award, the deadlines for submitting and examining files shall be in accordance with the guidance of relevant Ministries and sectors.
4. For other titles and forms of commendation not specified in Clauses 1, 2, and 3 of this Article, the latest deadline for submitting commendation files is August 28 each year.
The time for examining commendation files shall be no more than 15 working days from the date of receiving complete files and notifying the agencies and units submitting commendation requests about the results of the examination. In complex cases requiring additional time for verification, the examination period may be extended but shall not exceed 15 working days.
Chapter VI
COMPETITION AND REWARD COUNCIL,
SCIENTIFIC COUNCIL, INNOVATION COUNCIL
Article 23. The Ministry of Transport's Competition and Reward Council
1. The Competition and Commendation Council of the Ministry of Transport is the advisory body to the Minister of Transport regarding competition and commendation work throughout the sector and the rural and mountainous transport construction movement.
2. The membership of the Ministry of Transport's Competition and Reward Council includes:
a) The Chairman of the Board is the Minister;
b) Vice Chairperson:
- The Vice Chairman in charge is the Deputy Minister responsible for competition and commendation work;
- The Deputy Director of the Personnel and Organization Department responsible for competition and commendation work;
- Other Vice Chairmen are decided by the Minister of Transport.
c) Members are heads of some advisory bodies assisting the Minister.
The Minister of Transport shall specify the functions, tasks, powers, and organizational structure of the Council.
3. The Standing Office of the Council
a) The Personnel and Organization Department is the Standing Office of the Council.
b) When necessary, the Competition and Commendation Council of the Ministry of Transport may invite some related representatives to attend Council meetings. Invited representatives can express their opinions but have no voting rights at Council meetings.
4. The Standing Office of the Council has the responsibility to advise the Minister to issue decisions establishing the Competition and Commendation Council of the Ministry and the operational regulations of the Council in accordance with the operational regulations of the Central Competition and Commendation Council and the laws on competition and commendation work.
Article 24. Grassroots Competition and Reward Council
1. Agencies and units under the Ministry that have legal personality must establish a grassroots Competition and Commendation Council.
For other organizations, based on the actual situation of the organization, the head of the agency or unit shall consider and decide on the establishment of a Competition and Commendation Council. In cases where a Council is not established, the examination and recommendation for commendation shall be carried out by the leadership of the agency or unit in coordination with representatives of the Party Committee and the Trade Union of the agency or unit.
2. Based on the organizational structure, the number of civil servants, officials, and employees under the management of the agency or unit, the number of members of the grassroots Competition and Commendation Council may be 3, 5, 7, 9, or 11 members including:
a) The Chairman is the Head of the agency or unit;
b) The Vice Chairman is the person in charge of the advisory organization assisting the Head of the agency or unit in implementing competition and commendation work;
c) Members are representatives of the Party Committee, the Trade Union, and other members who are heads of some advisory organizations appointed by the Head of the agency or unit.
If the grassroots Competition and Commendation Council has 9 or 11 members, it may arrange 2 or 3 Vice Chairmen, with the person in charge of the advisory organization assisting the Head of the agency or unit in implementing competition and commendation work being the Vice Chairman in charge.
When necessary, the grassroots Competition and Commendation Council may invite some related representatives to attend its meetings; invited representatives attending the meeting can express their opinions but have no voting rights at the Council meeting.
3. The grassroots Competition and Commendation Council performs the function of advising and consulting the Head of the agency or unit on competition and commendation work; operates on the principle of democratic centralism and decides by majority.
In case the opinions of the Council members are equal, the opinion of the Chairman of the Council is decisive. The grassroots Competition and Commendation Council operates according to the operational regulations issued by the Head of the agency or unit.
4. Tasks of the grassroots Competition and Commendation Council
a) Organizing the launch, directing, guiding, inspecting, and urging the implementation of competition movements in the field and management tasks of the agency or unit, ensuring that the movement develops strongly, widely, correctly, practically, and effectively;
b) Reviewing and selecting outstanding collectives and individuals in the competition movement, submitting to the Head of the agency or unit for decision to award competition titles and commendation forms within the authority or recommending the Head of the agency or unit to submit higher competition titles and commendation forms to the Minister as prescribed;
c) Summarizing and reviewing the competition movement of the agency or unit, thereby proposing to the Head of the agency or unit plans for organizing, launching, directing, and implementing the competition movement and promoting exemplary models and good deeds in the agency or unit;
d) Implementing other tasks assigned by the Head of the agency or unit.
Specific tasks, powers, and organizational structure of the grassroots Competition and Commendation Council are stipulated by the Chairman of the Council.
Article 25. Scientific Council, Initiative Council
1. The Initiative Council or the Science Council shall be responsible for assisting the head in examining, recognizing, and evaluating the level of influence of initiatives and scientific research topics.
2. The grassroots Initiative Council or the Science Council shall be established by the head of the agency or unit with the authority to confer the title "Grassroots Model Worker" based on the decision made by the head of the organization that recognizes the initiative. The Council's members shall include those with expertise in the relevant field, representatives from the trade union where the author is a member, and other members as determined by the head of the organization that examines and recognizes the initiative (if necessary).
Based on practical circumstances, the head of the agency or unit decides to establish the Initiative Council or the Science Council.
3. The Initiative Council evaluates the solutions required for recognition and decides to recognize them as initiatives if they meet all of the following conditions:
a) They are new within the scope of that base;
b) They have been applied or tested at that base and have the potential to bring about tangible benefits (for example, increasing labor productivity, reducing production costs, improving product quality, services, technical efficiency, enhancing workplace safety, improving living conditions...);
c) They are not excluded from consideration (the application of the initiative violates public order or social morality; or the initiative is an object currently protected under intellectual property rights according to the law up to the time of recognizing the initiative). In cases where the initiative is created due to state funding, material-technical means, and the head of the organization recognizing the initiative is the author of the initiative, such an initiative must be evaluated through the Initiative Council.
4. The Initiative Council has the responsibility to organize an objective and honest evaluation of the solutions required for recognizing the initiative according to the conditions stipulated in Clause 2 of this Article and prepare an evaluation report reflecting the opinions of all members and the voting results of the Council.
Details regarding the conditions, procedures for recognizing initiatives, the rights and obligations of the investor creating the initiative, the author of the initiative, and participants in the initial implementation of the initiative, measures to promote initiative activities, and state management of initiative activities are specified in Decree No. 13/2012/NĐ-CP dated March 2, 2012, of the Government on the issuance of the Initiative Regulations.
Chapter VII
FUND FOR COMPETITION AND REWARD
Article 26. Responsibilities and Principles for Establishing the Competition and Reward Fund
1. Annually, the Standing Committee of the Competition and Reward Council of the Ministry bases its budget estimate for the next year's Competition and Reward Fund of the Ministry on the results of the previous year's Competition and Reward Fund, registered competition titles, reward forms, and anticipated expenses for the planned competition and reward activities.
2. Sources and methods for establishing and contributing to the Competition and Reward Fund
a) The formation of sources, the establishment, contribution, and use of the Competition and Reward Fund of the Ministry of Transport are carried out in accordance with the provisions of Article 3 of Circular No. 71/2011/TT-BTC dated May 24, 2011, issued by the Minister of Finance guiding the establishment, management, and use of the Competition and Reward Fund under Decree No. 42/2010/NĐ-CP.
b) Annually, the Department of Finance is responsible for allocating funds for the Ministry's competition and reward activities in accordance with Clause 1 of Article 67 of Decree No. 42/2010/NĐ-CP and Circular No. 71/2011/TT-BTC.
c) The Competition and Reward Funds of levels under the Ministry are managed by the competition and reward bodies at those levels; the sources of contributions, ratios, and amounts are based on the budget plan; settlement is based on actual expenditures in accordance with regulations and policies.
Article 27. Use of the Competition and Reward Fund
1. The Competition and Reward Fund shall be used for:
a) Printing certificates, awards, medals, commemorative plaques, badges, competition flags, award frames.
b) Awarding cash prizes or mementos to individuals and groups.
c) The Ministry of Transport shall allocate funds for printing licenses, making award frames, competition flags, and badges for honors and reward forms decided by the Minister.
d) Organizing and directing competition movements: Up to 20% of the total Competition and Reward Fund at each level may be allocated for the following tasks:
- Organizing meetings of the Competition and Reward Council;
- Building, organizing, and implementing competition movements; training competition and reward skills; organizing signing conferences for competition agreements; summary, finalization, experience-sharing, publicity, exemplary model promotion meetings;
- Initiating competition and reward movements in phases, special topics, regularly, and peak periods within sectors, fields, agencies, units, ministries, localities; cluster and group competition activities; inspecting, directing, and supervising the implementation of competition and reward movements;
- Other expenses directly serving the organization and direction of competition movements.
2. Individuals and groups receiving rewards, in addition to being recognized with competition titles, Competition Flags, State Honors, Ho Chi Minh Awards, State Awards; being awarded Orders, Medals, Certificates of Merit, Commemorative Plaques, Awards accompanied by award frames; also receive monetary rewards or equivalent gifts as stipulated in Articles 71, 72, 73, 75, and 76 of Decree No. 42/2010/NĐ-CP on the principle that:
a) Higher commendation titles and reward forms receive higher cash rewards;
b) Within the same form and level of reward, cash rewards for groups are higher than for individuals;
c) At the same time point, phase, and same reward recipient, if achieving different competition titles of the same level, then only receive the monetary reward (or accompanying gift) of the highest-level title. (Example: In 2014, Mr. Nguyen Van A was recognized as "Outstanding Worker" and later received the "Model Competitor at the Grassroots Level" title in 2014, he would only receive the monetary reward for the "Model Competitor at the Grassroots Level" title);
d) At the same time point, same recipient achieving multiple competition titles with different time periods, then receive monetary rewards for all those titles. (Example: In 2012, 2013, 2014, Mr. Nguyen Van A was awarded the "Model Competitor at the Grassroots Level", at the end of 2014, he was awarded the "Model Competitor in the Transportation Sector" title, then Mr. Nguyen Van A would receive the monetary reward for the "Model Competitor at the Grassroots Level" title in 2014 and the monetary reward for the "Model Competitor in the Transportation Sector" title);
đ) At the same time point, same recipient achieving both a competition title and a reward form, then receive monetary rewards for both the competition title and the reward form. (Example: In 2014, Mr. Nguyen Van A was awarded the "Model Competitor at the Grassroots Level" title and also received a Certificate of Merit from the Minister in the same year, then Mr. Nguyen Van A would receive the monetary reward for the "Model Competitor at the Grassroots Level" title and the monetary reward for the Certificate of Merit from the Minister).
3. Overseas Vietnamese, foreign individuals, and groups receiving rewards shall be given corresponding mementos (without monetary rewards).
Article 28. Management of the Competition and Reward Fund
1. The Cadre Organization Department shall be responsible for advising the Minister to use the Ministry's Competition and Reward Fund for its intended purposes and target groups to organize competition movements and serve reward work.
2. The Ministry Office shall be responsible for managing the Fund and coordinating with the Cadre Organization Department to disburse rewards and other expenses serving competition and reward work as prescribed.
3. The head of an agency or unit that issues a reward decision shall be responsible for disbursing rewards from their own agency or unit’s reward fund.
Collectives and individuals who are decided to be rewarded by the Minister, the Prime Minister, or the President shall have the level they report to be responsible for deducting from their competition and reward fund as prescribed to disburse rewards.
4. At the end of each year, unused portions of the Competition and Reward Funds at all levels shall be carried over to the next year for continued use in competition and reward work.
Article 29. Amounts for Rewards and Preferential Treatment
1. The amount of rewards accompanying commendation titles and reward forms shall be implemented according to the provisions of Articles 70, 71, 72, 73, 74, 75, and 76 of Decree No. 42/2010/NĐ-CP.
2. Personal benefits for those awarded the title "Model Competitor in the Transport Industry", "National Model Competitor", and those awarded Orders, honorary titles, the "Ho Chi Minh Award", and the "State Award" shall, in addition to being rewarded as prescribed, also be given priority for early salary advancement, priority for sending to study, research, work, and professional training both domestically and internationally according to the guidelines of the Ministry of Home Affairs.
Chapter VIII
RECORD KEEPING, REPORTING, INSPECTION, VIOLATION HANDLING, AND COMPLAINT AND ACCUSATION RESOLUTION REGARDING COMPETITION AND REWARD
AND SETTLEMENT OF COMPLAINTS AND ACCUSATIONS REGARDING COMPETITION AND REWARD
Article 30. Record Keeping of Reward Files
Agencies and units under the Ministry shall be responsible for storing their own and grassroots-level reward files to facilitate file searches and resolution of citizen complaints or confirmation for beneficiaries when requested. File preservation procedures shall be carried out according to archival regulations.
Article 31. Reporting on Competition and Reward Work
1. Agencies and units shall summarize and evaluate their competition and reward work and submit reports to the Ministry (through the Standing Office of the Competition and Reward Council of the Ministry) before December 15th each year.
2. Prior to each competition period, agencies and units shall organize mobilization activities; after each competition period, they shall organize mid-term and final summaries and submit reports to the Ministry (through the Standing Office of the Competition and Reward Council of the Ministry).
Article 32. Inspection of Competition and Reward Work
1. The Standing Office of the Competition and Reward Council of the Ministry shall be responsible for inspecting competition and reward work at agencies and units within the scope of the industry before, during, and after awarding rewards.
2. The heads of agencies and units shall be responsible for inspecting competition and reward work within their own units.
Article 33. Handling Violations Regarding Competition and Reward
1. The authority that issues a reward decision has the power to revoke the reward decision, strip honors, and recover awarded items and money.
2. Based on the effective legal decision of the Court or the conclusion of the competent authority, the level that has reported for rewarding in cases of violation shall be responsible for processing the procedures to request the competent authority to revoke the reward decision, strip national honorary titles, and recover awarded items and money.
3. The procedures and processes for handling violations regarding competition and reward shall be implemented according to the provisions of Articles 80 and 81 of Decree No. 42/2010/NĐ-CP; Articles 25 and 26 of Circular No. 07/2014/TT-BNV.
Article 34. Handling complaints and reports regarding competition and rewards
1. The Inspectorate of the Ministry of Transport shall advise and propose to the Minister of Transport on the handling of complaints, reports, suggestions, and reflections concerning competition and reward work within their authority as prescribed.
2. Heads of agencies and units shall be responsible for handling complaints, reports, suggestions, and reflections concerning competition and reward work within their authority as prescribed.
3. The permanent office of the Competition and Reward Council shall be responsible for coordinating with the inspectorate at the same level or directly advising (in cases where there is no inspection organization) the head to handle complaints, reports, suggestions, and reflections on competition and reward work within their authority as prescribed.
4. The procedures, formalities, deadlines, and files for handling complaints and reports on competition and rewards shall be carried out in accordance with the provisions of the Law on Complaints and the Law on Reports.
Chapter IX
IMPLEMENTING PROVISIONS
Article 35. Effective Date
This Circular takes effect from July 20, 2015, and replaces Circular No. 24/2012/TT-BGTVT dated June 29, 2012, issued by the Minister of Transport guiding competition and reward work in the transport sector.
Article 36. Responsibility for Implementation
1. The Permanent Office of the Competition and Reward Council of the Ministry assists the Minister of Transport in organizing the implementation, monitoring, and urging relevant agencies and units under the Ministry, Provincial Departments of Transport to implement this Circular.
2. The Director of the Ministry's Office, the Director of the Ministry's Inspectorate, the Heads of Departments; Heads of agencies and units under the Ministry; Directors of Provincial Departments of Transport; organizations and individuals related to this Circular shall be responsible for its implementation./.
