Guidelines on pilot auctioning of tariff quota for sugar imports in 2018

BASED ON Decree No. 98/2017/NĐ-CP dated August 18, 2017 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Article 1. Amending and supplementing certain articles of Circular No. 16/2021/TT-BGTVT dated August 12, 2021, issued by the Minister of Transport on technical safety inspection and environmental protection for motor vehicles (hereinafter referred to as Circular No. 16/2021/TT-BGTVT), Circular No. 02/2023/TT-BGTVT dated March 21, 2023, issued by the Minister of Transport amending and supplementing certain articles of Circular No. 16/2021/TT-BGTVT (hereinafter referred to as Circular No. 02/2023/TT-BGTVT), and Circular No. 08/2023/TT-BGTVT dated June 2, 2023, issued by the Minister of Transport amending and supplementing certain articles of Circular No. 16/2021/TT-BGTVT (hereinafter referred to as Circular No. 08/2023/TT-BGTVT).
Pursuant to Decree No. 62/2017/NĐ-CP dated May 16, 2017 of the Government detailing some provisions regarding measures to implement the Law on Auctioning of Assets;
Pursuant to Decree No. 151/2017/NĐ-CP dated December 26, 2017 of the Government detailing certain provisions of the Law on Management and Use of Public Assets;
At the proposal of the Director of the Department of Import-Export;
The Minister of Industry and Trade issues this Circular guiding the auctioning of tariff quota for sugar imports in 2018.
Article 1. Scope of Regulation
This Circular stipulates the quantity of tariff quota for sugar imports and the principles of pilot auctioning of tariff quota for sugar imports in 2018.
Article 2. Applicability
1. Direct traders who use sugar as raw material for production and traders using raw sugar to produce refined sugar.
2. Individuals and organizations related to the import of sugar under the tariff quota in 2018.
Article 3. Quantity of Tariff Quota for Sugar Imports Subject to Auction in 2018
The quantity of sugar (HS Code 17.01) imported under the tariff quota in 2018 is 94,000 tons.
Article 4. Principles of Auctioning
1. The auctioning of the tariff quota for sugar imports in 2018 shall be conducted through the Pilot Tariff Quota Auction Council for Sugar Imports in 2018.
2. The principles, procedures, and formalities for selling assets at auction shall be carried out in accordance with the laws on auctioning, taking into account the nature of the assets being auctioned.
3. The Ministry of Industry and Trade shall establish the Pilot Tariff Quota Auction Council for Sugar Imports in 2018. The Chairman of the Auction Council shall issue the Auction Regulations for the Pilot Tariff Quota Auction for Sugar Imports in 2018.
Article 5. Import Procedures
1. After receiving the Report on the Results of the Auction from the Auction Committee, the Ministry of Industry and Trade shall issue a notification granting the right to use the import duty quota for sugar to the successful bidders.
2. When processing import procedures for sugar, in addition to complying with current regulations, traders must submit the notification document from the Ministry of Industry and Trade granting the right to use the tariff quota for sugar imports to the customs authority responsible for handling the customs declaration for imported goods in accordance with customs laws.
Article 6. Effectiveness
This Circular takes effect from August 21, 2018 to December 31, 2018./.
