CIRCULAR

QQ to establish the List of Products and Goods with Potential Safety Risks under the Management Responsibility of the Ministry of Labor - Invalids and Social Affairs

Pursuant to the Law on Product Quality and Goods dated November 21, 2007;

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing a number of articles of the Law on Product Quality and Goods;

Pursuant to Decree No. 74/2018/NĐ-CP dated May 15, 2018 of the Government amending and supplementing certain provisions of Decree No. 132/2008/NĐ-CP dated December 31, 2018 of the Government detailing a number of articles of the Law on Product Quality and Goods; Pursuant to Decree No. 14/2017/

NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - Invalids and Social Affairs;DECREE No. 24/2017/ND-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - Invalids and Social Affairs.At the proposal of the Director of the Department of Occupational Safety;

The Minister of Labor - Invalids and Social Affairs promulgates this Circular to establish the List of Products and Goods with Potential Safety Risks under the Management Responsibility of the Ministry of Labor - Invalids and Social Affairs,

The Minister of Labor - Invalids and Social Affairs issues a Circular prescribing the List of products and goods that have the potential to cause safety hazards under the management responsibility of the Ministry of Labor - Invalids and Social Affairs.

Article 1. Scope of Regulation

This Circular stipulates the List of Products and Goods with Potential Safety Risks (hereinafter referred to as Group 2 products and goods) under the Management Responsibility of the Ministry of Labor - Invalids and Social Affairs, accompanied by product and good codes (HS).

Article 2. Applicability

1. Organizations and individuals within Vietnam and abroad engaged in production, importation, exportation, trading, and use of Group 2 products and goods under the Management Responsibility of the Ministry of Labor - Invalids and Social Affairs;

2. Organizations and individuals related to management, evaluation, and certification activities concerning the quality of Group 2 products and goods under the Management Responsibility of the Ministry of Labor - Invalids and Social Affairs.

Article 3. List of Products and Goods in Group 2 under the Management Responsibility of the Ministry of Labor - Invalids and Social Affairs

1. This Circular hereby establishes the List of Products and Goods in Group 2 under the Management Responsibility of the Ministry of Labor - Invalids and Social Affairs, along with their product and good codes (HS) detailed in the Appendix attached to this Circular.

2. Principles for applying HS codes to products and goods in Group 2 listed herein:

a) In cases where four-digit HS codes are listed, all products and goods with eight-digit HS codes within that product or good category shall be subject to application;

b) In cases where six-digit HS codes are listed, all products and goods with eight-digit HS codes within that product or good category shall be subject to application;

c) In cases where eight-digit HS codes are specifically listed, only the products and goods with those specific eight-digit HS codes shall be subject to application.

Article 4. Effective Date

1. This Circular shall take effect from February 1, 2019.

2. The list of products and goods in Group 2 prescribed herein replaces the list of products and goods in Group 2 stipulated in Appendix I of Circular No. 03/2010/TT-BLDTBXH dated January 19, 2010 issued by the Minister of Labor - Invalids and Social Affairs regarding the list of products and goods in Group 2 and guidelines on procedures, formalities, and content for state inspection of quality of such products and goods under the management responsibility of the Ministry of Labor - Invalids and Social Affairs.

Article 5. Implementation

1. The Department of Occupational Safety and Health and local Departments of Labor - Invalids and Social Affairs shall be responsible for implementing and guiding the implementation of this Circular;

2. The Department of Occupational Safety and Health, in collaboration with relevant agencies, shall review and submit to the Minister of Labor - Invalids and Social Affairs for consideration amendments and supplements to the list of products and goods in Group 2 as required by management;

3. In cases where legal regulations, technical standards, or technical norms cited herein are amended, supplemented, or newly issued, they shall be implemented according to the new documents;

4. During implementation, if there are difficulties or obstacles, agencies, organizations, and individuals shall report them to the Ministry of Labor - Invalids and Social Affairs for study and resolution./.
