CIRCULAR

Regulations on the List of Health Foods for Children Under Six Years Old Subject to Price Declaration

Pursuant to Decree No. 149/2016/NĐ-CP dated November 11, 2016 of the Government amending and supplementing certain provisions of Decree No. 177/2013/NĐ-CP dated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Law on Prices;

Pursuant to Decree No. 75/2017/NĐ-CP dated June 20, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

At the proposal of the Director of the Food Safety Administration,

The Minister of Health issues this Circular prescribing the list of health foods for children under six years old subject to price declaration.

Article 1. Scope of Regulation

Article 1. This Circular prescribes the list of health foods for children under six years old subject to price declaration as provided for in Point n Clause 9 Article 1 of Decree No. 149/2016/NĐ-CP dated November 11, 2016 of the Government amending and supplementing certain articles of Decree No. 177/2013/NĐ-CP dated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Law on Prices.

Article 2. This Circular does not apply to milk for children under six years old that falls within the price stabilization category as prescribed in Circular No. 30/2013/TT-BYT dated October 4, 2013 of the Minister of Health promulgating the list of milk for children under six years old included in goods subject to price stabilization.

Article 2. List of Health Foods for Children Under Six Years Old Subject to Price Declaration

1. Health Foods.

2. Medical Nutrition Foods.

3. Nutritional Supplements, including products for children up to 36 months old.

Article 3. Responsibility for Announcing the List of Food Products for Children Under Six Years Old Subject to Price Declaration

1. The Food Safety Administration shall be responsible for publicly announcing on its electronic information website the list of products prescribed in Article 2 of this Circular as follows:

a) Updating monthly for products that have been issued a Certificate of Acceptance for Product Registration by the Food Safety Administration after this Circular takes effect;

b) By September 1, 2019, complete the posting of the entire list of products that have been issued a Certificate of Acceptance for Product Registration or a Confirmation of Compliance with Food Safety Regulations (still valid) or a Certificate of Acceptance for Product Registration before this Circular takes effect.

2. Provincial-level food safety management agencies designated by provincial People's Committees to manage food safety (hereinafter referred to as provincial-level food safety management agencies) shall be responsible for publicly announcing on their electronic information websites or through mass media the list of products prescribed in Article 2 of this Circular as follows:

a) Updating monthly for products that have been issued a Certificate of Acceptance for Product Registration by provincial-level food safety management agencies or self-declared by organizations or individuals in the locality since this Circular takes effect;

b) By July 1, 2019, complete the posting of the entire list of products that have been issued a Certificate of Acceptance for Product Registration by provincial-level food safety management agencies or self-declared by organizations or individuals in the locality before this Circular takes effect.

Article 4. Effective Date.

This Circular shall take effect from November 1, 2018.

Article 5. Responsibility for Implementation.

1. The list prescribed in Article 2 of this Circular serves as the basis for the Ministry of Industry and Trade, the Ministry of Finance, People's Committees of provinces and centrally governed cities, and related agencies to implement price management in accordance with the laws on prices.

2. The Minister, Heads of ministerial-level agencies, Chairpersons of People's Committees of provinces and centrally governed cities, and relevant organizations and individuals are responsible for implementing this Circular.

3. The Food Safety Department under the Ministry of Health shall be responsible for leading and coordinating with related agencies and organizations to guide the implementation and organization of this Circular. In the process of implementation, if there are difficulties or obstacles, agencies, organizations, and individuals should report them to the Ministry of Health (Food Safety Department) for consideration and resolution.
