On the basis of the Law on Government Organization dated June 19, 2015;
On the basis of the Insurance Business Law dated December 9, 2000; and the Law Amending and Supplementing Certain Provisions of the Insurance Business Law dated November 24, 2010;
On the basis of Resolution No. 32/2016/QH14 dated November 23, 2016 of the National Assembly on continuing to enhance capacity and efficiency in implementing the national target program for new rural development in conjunction with restructuring the agricultural sector;
On the basis of Decree No. 58/2018/NĐ-CP dated April 18, 2018 of the Government on agricultural insurance;
At the proposal of the Minister of Finance and the Minister of Agriculture and Rural Development;
The Prime Minister issues this Decision on implementing policies to support agricultural insurance.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decision stipulates the implementation of policies to support agricultural insurance as prescribed in Decree No. 58/2018/NĐ-CP dated April 18, 2018 of the Government on agricultural insurance, including: Subjects of organizations and individuals engaged in agricultural production eligible for support; types of crops, livestock, and aquaculture products eligible for support; types of risks covered by insurance that are eligible for support; levels of support; timeframes for providing support; areas eligible for support; levels of support from the central budget to local budgets for implementing agricultural insurance premium subsidies.
Article 2. Applicability
This Decision applies to:
1. Organizations and individuals growing rice; raising water buffalo and cattle; and farming whiteleg shrimp and black tiger shrimp are subjects as prescribed in Clause 2, Article 22 of Decree No. 58/2018/NĐ-CP dated April 18, 2018 of the Government on agricultural insurance.
2. Non-life insurance companies, branches of foreign non-life insurance companies, and reinsurance companies established and operating in accordance with the Insurance Business Law and related laws.
3. Other agencies, organizations, and individuals relevant to the implementation of policies to support agricultural insurance.
Chapter II
POLICIES TO SUPPORT AGRICULTURAL INSURANCE
Article 3. Subjects Eligible for Agricultural Insurance Premium Subsidies
1. Crops: Rice.
2. Livestock: Water buffalo and cattle.
3. Aquaculture: Whiteleg shrimp and black tiger shrimp.
Article 4. Levels of Support for Agricultural Insurance Premiums
1. Individuals engaged in agricultural production classified as poor households (including both income-based poor households and multi-dimensional poverty-based poor households) and near-poor households as prescribed in Decision No. 59/2015/QĐ-TTg dated November 19, 2015 of the Prime Minister on issuing multidimensional poverty standards applicable for the period 2016-2020: Support 90% of the agricultural insurance premium.
2. Individuals engaged in agricultural production not classified as poor or near-poor households: Support 20% of the agricultural insurance premium.
3. Agricultural production organizations as prescribed in Clause 3, Article 19 of Decree No. 58/2018/NĐ-CP: Support 20% of the agricultural insurance premium when meeting the following requirements:
- Established as a company under the Enterprise Law or a cooperative under the Cooperative Law;
- Have a contractual link with agricultural products that are eligible for the policy to support agricultural insurance, in compliance with Articles 4 and 5 of Decree No. 98/2018/NĐ-CP dated July 5, 2018 of the Government on policies to encourage the development of cooperatives and linkage in agricultural production and marketing, and any amendments, supplements, or replacements thereof (if any);
- Have agricultural products that are eligible for the policy to support agricultural insurance certified as meeting quality and food safety standards by competent authorities or recognized as high-tech agricultural enterprises under Decision No. 19/2018/QĐ-TTg dated April 19, 2018 of the Prime Minister on criteria, authority, procedures, and formalities for recognizing high-tech agricultural enterprises, and any amendments, supplements, or replacements thereof (if any).
Article 5. Insured risks supported for agricultural insurance premiums
1. Risks covered by insurance and eligible for support for rice
a) Natural disasters include: Typhoons, tropical depressions, whirlwinds, lightning, heavy rain, floods, flash floods, flooding, landslides caused by rain or runoff, subsidence caused by rain or runoff, tidal surges, saltwater intrusion, heatwaves, droughts, cold snaps, hailstorms, frost, earthquakes, tsunamis. Natural disasters must be announced or confirmed by competent state agencies.
b) Diseases include: Dwarf yellow leaf disease, dwarf curly leaf disease, dwarf black stripe disease, blast disease, bacterial blight; brown planthopper infestation, stem borer infestation. Diseases must be announced or confirmed by competent state agencies.
2. Risks covered by insurance and eligible for support for water buffalo and cattle
a) Natural disasters include: Typhoons, tropical depressions, whirlwinds, lightning, heavy rain, floods, flash floods, flooding, landslides caused by rain or runoff, subsidence caused by rain or runoff, heatwaves, droughts, pest damage, hailstorms, frost, earthquakes, tsunamis. Natural disasters must be announced or confirmed by competent state agencies.
b) Diseases include: Foot-and-mouth disease, anthrax. Diseases must be announced or confirmed by competent state agencies.
3. Risks covered by insurance and eligible for support for whiteleg shrimp and black tiger shrimp
a) Natural disasters include: Typhoons, tropical depressions, whirlwinds, lightning, heavy rain, floods, flooding, landslides caused by rain or runoff, subsidence caused by rain or runoff, tidal surges, saltwater intrusion, heatwaves, droughts, hailstorms, earthquakes, tsunamis. Natural disasters must be announced or confirmed by competent state agencies.
b) Diseases: No support for disease-related risks for whiteleg shrimp and black tiger shrimp.
Article 6. Areas eligible for agricultural insurance premium support
1. For rice, in the provinces of Thai Binh, Nam Dinh, Nghe An, Ha Tinh, Binh Thuan, An Giang, Dong Thap.
2. For cattle, in the provinces and centrally governed cities of Ha Giang, Vinh Phuc, Hanoi, Thanh Hoa, Nghe An, Binh Dinh, Dong Nai, Binh Duong.
3. For black tiger shrimp and whiteleg shrimp, in the provinces of Ben Tre, Tra Vinh, Soc Trang, Bac Lieu, Ca Mau.
The People's Committees of provinces and centrally governed cities within the areas specified in Clause 1, Clause 2, and Clause 3 of this Article shall organize the selection of areas to be supported with agricultural insurance premiums in accordance with Clause 2 of Article 21 of Decree No. 58/2018/NĐ-CP dated April 18, 2018 of the Government on agricultural insurance.
Article 7. Time for Implementing Agricultural Insurance Premium Support
The period for implementing agricultural insurance premium support runs from the date this Decision takes effect until December 31, 2020.
Article 8. Level of Support from the Central Budget to Local Budgets for Implementing Agricultural Insurance Premium Support
Apply the maximum level of support as prescribed in Decision No. 579/QĐ-TTg dated April 28, 2017 on principles for targeted support from the central budget to local budgets for implementing social welfare policies during the 2017-2020 period and any subsequent amendments, supplements, or replacements thereof.
The People's Committees of provinces and centrally governed cities within the areas specified in Clause 1, Clause 2, and Clause 3 of Article 6 shall allocate local budget funds to support agricultural insurance premiums in accordance with this Decision.
Chapter III
IMPLEMENTATION PROVISIONS
Article 9. Effective Date
1. This Decision takes effect from the date of signature.
2. The Ministry of Finance shall take the lead and coordinate with relevant agencies to review, evaluate, and propose the drafting of a Decision for the post-2020 period.
3. The Minister of Finance, the Minister of Agriculture and Rural Development, the Heads of ministries at the ministerial level, the Heads of government agencies, and the Chairpersons of provincial People's Committees shall be responsible for implementing this Decision.
