REGULATIONS ON THE LEVEL OF COLLECTION, SYSTEM OF COLLECTION, PAYMENT, MANAGEMENT AND USE OF FEES FOR THE EXPLOITATION AND USE OF ENVIRONMENTAL DATA
Pursuant to the Law on Fees and Charges dated November 25, 2015;
Pursuant to the Law on Meteorology and Hydrology dated November 23, 2015;
Pursuant to the Decree No. 120/2016/NĐ-CP dated August 23, 2016 of the Government detailing and guiding the implementation of certain articles of the Law on Fees and Stamp Duties;
Pursuant to Decree No. 38/2016/NĐ-CP dated May 15, 2016 of the Government detailing certain provisions of the Law on Meteorology and Hydrology;
Pursuant to Decree No. 73/2017/NĐ-CP dated June 14, 2017 of the Government on the collection, management, exploitation and use of information and data on natural resources and the environment;
Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
At the request of the Director of the Tax Policy Department;
The Minister of Finance promulgates this Circular regulating the level of collection, system of collection, payment, management and use of fees for the exploitation and use of environmental data.
Article 1. Scope of Regulation
1. This Circular regulates the level of collection, system of collection, payment, management and use of fees for the exploitation and use of environmental data.
2. This Circular does not apply to the exploitation and use of environmental data by state agencies for purposes specified in Clause 5, Article 32 of the Law on Meteorology and Hydrology and Article 23 of Decree No. 38/2016/NĐ-CP dated May 15, 2016 of the Government detailing certain provisions of the Law on Meteorology and Hydrology.
Article 2. Applicability
1. Subjects paying the fee;
2. Organizations collecting the fee;
3. Other organizations, individuals related to the exploitation and use of environmental data and the collection and payment of fees.
Article 3. Organizations collecting the fee and subjects paying the fee
1. Organizations collecting the fee include:
a) The Environmental Information and Data Center under the General Department of Environment (Ministry of Natural Resources and Environment);
b) Agencies assigned by ministries and ministerial-level agencies to provide environmental information and data;
c) Departments of Natural Resources and Environment of provinces and centrally governed cities.
2. Organizations, individuals when submitting applications for provision of environmental information and data at the agencies and units specified in Clause 1 of this Article must pay the fee for the exploitation and use of environmental data.
Article 4. Fee Rates
1. The level of fees for the exploitation and use of environmental data is stipulated in the Fee Collection Schedule attached to this Circular.
2. From May 26, 2020 to December 31, 2020, the fee for the exploitation and use of environmental data shall be 70% of the level prescribed in the Fee Collection Schedule attached to this Circular.
Article 5. Declaration and Payment of Fees
1. Subjects paying the fee shall directly pay the fee to the organization collecting the fee or deposit the fee into the account for pending budget payments opened at the State Treasury. In case the organization collecting the fee collects the fee through non-cash payment methods, the subject paying the fee shall make the payment according to the notification from the organization collecting the fee.
2. By the fifth day of each month, the organization collecting the fee must transfer the amount of fees collected in the previous month into the account for pending budget payments opened at the State Treasury.
3. The organization collecting the fee shall declare and pay the amount of fees collected monthly, settle accounts annually in accordance with the guidance provided in Clause 3, Article 19 and Clause 2, Article 26 of Circular No. 156/2013/TT-BTC dated November 6, 2013 of the Minister of Finance guiding the implementation of certain provisions of the Law on Tax Administration; the Law Amending and Supplementing Certain Provisions of the Law on Tax Administration and Decree No. 83/2013/NĐ-CP dated July 22, 2013 of the Government.
Article 6. Management and Use of Fees
1. An organization collecting the fee that is a public service unit may retain 70% of the total amount of fees collected to cover costs as prescribed in Article 5 of Decree No. 120/2016/NĐ-CP dated August 23, 2016 of the Government detailing and guiding the implementation of certain provisions of the Law on Fees and Charges; and remit 30% of the amount of fees collected to the State budget according to the corresponding chapters, sections, sub-sections of the State Budget Classification.
2. An organization collecting the fee that is a state agency shall remit the entire amount of fees collected to the State budget. The cost of providing data and collecting fees shall be covered by the State budget allocated in the budget of the organization collecting the fee according to the State budget expenditure regulations and standards.
Article 7. Implementation organization and enforcement provisions
1. This Circular takes effect from May 26, 2020.
2. Any other contents related to the collection, payment, management, use, receipt, and publicizing of the system of fees for the exploitation and use of environmental data not mentioned in this Circular shall be implemented in accordance with the Law on Fees and Charges; Decree No. 120/2016/NĐ-CP dated August 23, 2016 of the Government detailing and guiding the implementation of certain provisions of the Law on Fees and Charges; Circular No. 156/2013/TT-BTC dated November 6, 2013 of the Minister of Finance guiding the implementation of certain provisions of the Law on Tax Administration; the Law Amending and Supplementing Certain Provisions of the Law on Tax Administration and Decree No. 83/2013/NĐ-CP dated July 22, 2013 of the Government; Circular No. 303/2016/TT-BTC dated November 15, 2016 of the Minister of Finance guiding the printing, issuance, management and use of various types of receipts for fees and charges belonging to the State budget.
3. In cases where legal normative documents cited in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new amended, supplemented, or replaced documents.
4. During the implementation process, if there are any difficulties, organizations and individuals are requested to promptly reflect them to the Ministry of Finance for research and supplementary guidance.
