REGULATIONS ON SUSPENDING THE EFFECTIVENESS OF CIRCULAR NO. 04/2021/TT-BYT DATED APRIL 29, 2021 ISSUED BY THE MINISTER OF HEALTH GUIDING THE PAYMENT OF MEDICAL EXAMINATION AND TREATMENT COSTS UNDER THE HEALTH INSURANCE PACKAGE SYSTEM

Pursuant to the Law on Issuing Legal Documents dated June 22, 2015 and the Law Amending and Supplementing Certain Provisions of the Law on Issuing Legal Documents dated June 18, 2020;
Pursuant to the Health Insurance Law dated November 14, 2008 and the Law Amending and Supplementing Certain Provisions of the Health Insurance Law dated June 13, 2014;
Pursuant to Decree No. 146/2018/ND-CP dated October 17, 2018 of the Government detailing and guiding methods for implementing certain provisions of the Health Insurance Law;
Pursuant to Decree No. 75/2017/NĐ-CP dated June 20, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
At the proposal of the Director of the Department of Planning and Finance,
The Minister of Health hereby issues this Circular on suspending the effectiveness of Circular No. 04/2021/TT-BYT dated April 29, 2021 issued by the Minister of Health guiding the payment of medical examination and treatment costs under the health insurance package system.
Article 1. Suspension of the implementation of the payment of medical examination and treatment costs under the health insurance package system
1. Circular No. 04/2021/TT-BYT dated April 29, 2021 issued by the Minister of Health guiding the payment of medical examination and treatment costs under the health insurance package system shall be suspended in its entirety throughout the country.
2. Outpatient medical examination and treatment costs within the scope of the package from January 1, 2021 shall be paid according to the service fee for medical examination and treatment as prescribed in Decree No. 146/2018/NĐ-CP dated October 17, 2018 of the Government detailing and guiding the implementation of certain provisions of the Health Insurance Law.
Article 2. Effective Date
1. This Circular takes effect from the date of signature.
2. The time for suspending the effectiveness of the provisions stipulated in Clause 1, Article 1 of this Circular shall be implemented from the date this Circular takes effect until the effective date of the new regulatory document prescribing guidance on the payment of medical examination and treatment costs under the health insurance package system.
Article 3. Responsibility for Implementation
The Heads of the Department of Planning and Finance, the Director of the Office of the Ministry, the Inspector General of the Ministry, the Heads of Departments, Directors of Bureaus, and General Directors of the Departments, Bureaus, and General Departments under the Ministry of Health, and the Heads of units, agencies, organizations, and individuals related to this matter are responsible for implementing this Circular./.
