On the basis of Law on Education dated June 14, 2019;

On the basis of Public Officer Law dated November 15, 2010; Law Amending and Supplementing Certain Provisions of the Civil Servants Law and the Public Officer Law dated November 25, 2019;

On the basis of Decree No. 115/2020/ND-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of civil servants;

On the basis of Decree No. 86/2022/NĐ-CP dated October 24, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

At the proposal of the Director of the Department of Teachers and Educational Management Staff;

The Minister of Education and Training issues this Circular to regulate the code number, occupational title standards, appointment, and salary grading for educational administrative staff in boarding schools for ethnic minorities; specialized high schools; preparatory universities; and public schools for persons with disabilities.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular regulates the code number, occupational title standards, appointment, and salary grading for educational administrative staff in boarding schools for ethnic minorities; specialized high schools; preparatory universities; and public schools for persons with disabilities.

2. This Circular applies to educational administrative staff in boarding schools for ethnic minorities; specialized high schools; preparatory universities; and public schools for persons with disabilities.

Article 2. Code number for the occupational title of educational administrative staff

Educational Administrative Staff - Code number: V.07.07.21.

Chapter II

STANDARDS FOR OCCUPATIONAL TITLES, APPOINTMENT, AND SALARY GRADING

ACCORDING TO OCCUPATIONAL TITLES

Article 3. Standards for the occupational title of educational administrative staff

1. Tasks

a) Develop and implement the annual administrative work plan of the school; report regularly and periodically as prescribed;

b) Manage and monitor the student-related files and records of the school;

c) Coordinate in implementing admission tasks and other responsibilities related to examinations, assessments, and evaluations of students;

d) Collaborate with teachers and other staff members in the school to manage and monitor students daily; compile academic and disciplinary results of students;

đ) Complete training programs; engage in self-study and self-improvement to enhance professional competence;

e) Fulfill other tasks assigned by the principal.

2. Professional ethics standards

a) Adhere to the Party's guidelines and policies, state laws, and regulations of the sector;

b) Be honest, impartial, have a sense of moral improvement, and demonstrate a high sense of responsibility. Maintain personal integrity, honor, and reputation; foster unity and support among colleagues and students;

c) Perform duties in accordance with regulations and laws.

3. Educational and Training Standards

a) Hold a college degree in education (or a college degree in another relevant field suitable for the position of educational administrative staff);

b) Complete the training program according to the standards for the occupational title of educational administrative staff as prescribed.

Article 4. Professional Competence Standards

a) Understand and apply Party policies, State laws, and industry requirements for the level of education in their work area;

b) Effectively implement the school's educational plans and programs;

c) Possess organizational and management skills to effectively perform the duties of educational administrative staff;

d) Have the ability to coordinate and communicate well with colleagues; advise and support students and their parents in fulfilling tasks;

đ) Have the ability to apply information technology in professional activities.

Article 4. Principles for appointment and salary grading based on occupational titles for educational administrative staff

1. Appointments to the occupational title of educational administrative staff must be based on the provisions of this Circular and the job position, responsibilities, and professional qualifications of the staff member.

2. When appointing from civil service ranks or other occupational titles of staff to the occupational title of educational administrative staff as prescribed in this Circular, there shall be no combination of salary grade increases.

Article 5. Appointment to the occupational title of educational affairs officer

Appointment to the occupational title of educational affairs officer with code V.07.07.21 shall be made for:

1. Civil servants currently engaged in educational affairs work but not yet appointed according to Circular No. 07/2019/TT-BGDĐT dated May 2, 2019 of the Minister of Education and Training on occupational titles, standards, and salary scales for educational affairs officers in boarding schools for ethnic minorities; specialized secondary schools; preparatory colleges, and schools for persons with disabilities under state management (hereinafter referred to as Circular No. 07/2019/TT-BGDĐT) when they meet the occupational standards for educational affairs officers as stipulated in this Circular.

2. Cases where they are recruited to the position of educational affairs officer after this Circular takes effect and meet the probationary period requirements as prescribed.

Article 6. Salary Classification

1. Civil servants appointed to the occupational title of educational affairs officer with code V.07.07.21 as stipulated in this Circular shall apply the salary scale for civil servants type A0 at Table 3 (salary scale for professional and technical staff in state-run units) issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for civil servants, public officials, and members of the armed forces (hereinafter referred to as Decree No. 204/2004/NĐ-CP).

2. The adjustment of salary grades for cases where recruitment and appointment to the occupational title of educational affairs officer are made from other professional categories of civil servants shall be carried out as follows:

a) In cases where they are currently assigned to salary grade A0 for civil servants according to Table 2 (salary scale for professional and technical staff in state agencies) or Table 3 (salary scale for professional and technical staff in state-run units) issued together with Decree No. 204/2004/NĐ-CP, they shall be assigned to salary grade A0 for civil servants;

b) In cases where they are currently assigned to salary grade A1 or higher or grade B, they shall be reassigned to salary grades according to the guidelines set forth in Clause 1 Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Minister of Home Affairs on salary assignment when upgrading, transferring, or changing categories of civil servants.

Chapter III

IMPLEMENTING PROVISIONS

Article 7. Implementation Organization

1. This Circular serves as the basis for implementing recruitment, utilization, and management of educational affairs officers in boarding schools for ethnic minorities; specialized secondary schools; preparatory colleges, and schools for persons with disabilities under state management.

2. Non-state educational institutions may apply the provisions of this Circular.

3. In cases where general education institutions (excluding those specified in Clause 1 Article 1 of this Circular) have positions for educational affairs officers listed in the job position directory, they may apply the provisions of this Circular.

4. Heads of boarding schools for ethnic minorities; specialized secondary schools; preparatory colleges, and schools for persons with disabilities under state management shall be responsible for:

a) Reviewing job position plans, developing appointment plans for occupational titles and salary assignments for educational affairs officers within their jurisdiction, submitting them to competent authorities for examination and decision-making or deciding according to delegated authority;

b) Reporting to competent authorities on the results of appointments and salary assignments for educational affairs officers as required.

5. Heads of competent authorities managing boarding schools for ethnic minorities; specialized secondary schools; preparatory colleges, and schools for persons with disabilities under state management shall be responsible for:

a) Approving plans for appointments to occupational titles and salary assignments for educational affairs officers in boarding schools for ethnic minorities; specialized secondary schools; preparatory colleges, and schools for persons with disabilities under their jurisdiction; resolving issues arising during the process of appointing occupational titles and assigning salaries for educational affairs officers within their jurisdiction;

b) Deciding on appointments to occupational titles and salary assignments for educational affairs officers in boarding schools for ethnic minorities; specialized secondary schools; preparatory colleges, and schools for persons with disabilities under state management according to their authority or delegated authority;

c) Reporting the results of appointments to occupational titles and salary assignments for educational affairs officers in boarding schools for ethnic minorities; specialized secondary schools; preparatory colleges, and schools for persons with disabilities under their jurisdiction to competent authorities as required;

d) Developing training plans according to occupational standards for educational affairs officers and ensuring benefits and policies when participating in training as prescribed by law.

Article 8. Application Provisions

1. In cases where civil servants are currently engaged in educational affairs work but do not meet the standards stipulated in Clause 3 Article 3 of this Circular, if they continue to be assigned to such work, they shall continue to receive their current salary until they transfer to another position, stop working, or retire as prescribed.

2. There is no requirement to reappoint the occupational title of educational affairs officer according to this Circular for those who have already been appointed to the occupational title of educational affairs officer according to Circular No. 07/2019/TT-BGDĐT.

Article 9. Effective Date of Implementation

1. This Circular shall take effect from February 12, 2023.

2. In cases where the referenced documents in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new documents.

3. This Circular replaces Circular No. 07/2019/TT-BGDĐT.

Article 10. Responsibility for Implementation

The heads of relevant units under the Ministry of Education and Training; the Chairpersons of the People's Committees of provinces and centrally governed cities; the Directors of provincial Departments of Education and Training, the Director of the Department of Education, Science and Technology of Bac Lieu Province; related agencies, organizations, and individuals are responsible for implementing this Circular./.
