CIRCULAR

Regulations on the Self-made Training Equipment Competition

Pursuant to the Law on Vocational Education dated November 27, 2014;

Based on Decree No. 62/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

Pursuant to Decree No. 15/2019/NĐ-CP dated February 1, 2019, of the Government detailing certain provisions and measures to implement the Law on Vocational Education;

Based on the proposal of the Director General of the General Department of Vocational Education;

The Minister of Labour - War Invalids and Social Affairs issues this Circular to regulate the Self-made Training Equipment Competition.

 

PART I

GENERAL PROVISIONS

Article 1. Scope and Applicability

1. This Circular stipulates the purpose, requirements, organizing authority, participants, rewards, Organizing Committee, Judging Board, and organizational work of the Self-made Training Equipment Competition (hereinafter referred to as the Competition).

2. This Circular applies to competitions at all levels; vocational education institutions, vocational education activity institutions, and vocational education and general education centers (hereinafter referred to as vocational education activity institutions); authors and author groups with self-made training equipment in vocational education activity institutions; relevant agencies, organizations, and individuals.

3. This Circular does not apply to secondary teacher training schools, higher teacher training colleges; self-made training equipment for teacher training programs under the management of the Ministry of Education and Training.

Article 2. Purpose and Requirements of the Competition

1. Purpose of the Competition

a) To exploit the intellectual potential and creativity of teachers, students, trainees, learners, and managers at vocational education activity institutions in making training equipment to serve training activities and improve the quality of vocational education;

b) To exchange and learn from each other among vocational education activity institutions regarding experiences in inventing and improving training equipment;

c) To select high-quality and effective self-made training equipment for widespread application in vocational education activity institutions;

d) To promote vocational education; attract business participation in vocational education activities.

2. Requirements of the Competition

a) Based on the voluntary participation of vocational education activity institutions, authors, and author groups with self-made training equipment; not to create pressure on vocational education activity institutions, authors, and author groups;

b) To attract a large number of vocational education activity institutions to participate;

c) To ensure safety, transparency, fairness, objectivity, economy, effectiveness, and compliance with the law.

Article 3. Competitions at Various Levels and Authority to Organize the Competition

1. Competitions at various levels include: Institutional-level Competition; Provincial-level Competition; National-level Competition.

2. Authority to Organize the Competition

a) The Institutional-level Competition is organized annually by vocational education activity institutions;

b) The Provincial-level Competition is organized every three years by the People's Committees of provinces and centrally-run cities (Department of Labour - War Invalids and Social Affairs);

c) The National-level Competition is organized every three years by the Ministry of Labour - War Invalids and Social Affairs (General Department of Vocational Education);

d) In cases where vocational education activity institutions, provincial people's committees, and centrally-run city people's committees (Department of Labour - War Invalids and Social Affairs) do not organize competitions, they shall organize selection processes for equipment to participate in competitions at various levels. The procedures for organizing the selection process are decided by the heads of the organizing agencies and units at each level.

Article 4. Participants in the Competitions at Various Levels

1. The participants in the competition at the grassroots level are authors or groups of authors from vocational education establishments with self-made training equipment who have registered to participate in the grassroots-level competition.

2. The participants in the competition at the provincial level are authors or groups of authors whose self-made training equipment won awards at the grassroots-level competition or were selected for participation if no competition was held, and who have been registered by vocational education establishments headquartered in the province or centrally governed city.

3. The participants in the national competition are authors or groups of authors whose self-made training equipment won awards at the provincial-level competition or were selected for participation if no competition was held, and who have been registered by the People's Committee of the province or centrally governed city (Department of Labor, Invalids, and Social Affairs) to participate in the national competition.

Article 5. Equipment for Participation in the Competition

1. Self-made training equipment participating in the competition includes models, tools, parts of equipment, complete equipment, software, and other technical means used in the training process.

2. Requirements for self-made training equipment participating in the competition

a) The equipment must be invented and installed by the author or group of authors at vocational education establishments.

b) The equipment must not infringe on industrial property rights or intellectual property rights.

c) The equipment must demonstrate creativity, be suitable for the training program, and contribute to improving the quality of training.

d) Equipment that has won first, second, or third place at a higher level cannot participate in competitions at lower levels in subsequent competitions.

đ) Equipment that has won first, second, or third place at any level cannot participate in competitions at the corresponding level in subsequent competitions.

e) During the competition period, the equipment cannot be supplemented, changed, repaired, reinforced, or moved from its position arranged by the Organizing Committee without permission. The equipment must be introduced and operated according to the requirements of the Organizing Committee and the judging panel throughout the competition period by the author or representative of the group of authors.

3. Each piece of equipment participating in the competition must have an accompanying equipment dossier, which must include the following information:

a) Name of the equipment.

b) Training profession or trade group.

c) Author or group of authors.

d) Unit.

đ) Purpose and design concept.

e) Scope of application.

g) Structure and technical specifications.

h) Instructions for use, exploitation, maintenance, and repair.

Article 6. Units Hosting the Competition

1. The People's Committee of the province or centrally governed city (Department of Labor, Invalids, and Social Affairs) selects units within the province or centrally governed city that meet the conditions regarding infrastructure to host the provincial-level competition.

2. The Minister of Labor, Invalids, and Social Affairs (General Department of Vocational Education) selects the People's Committee of the province or centrally governed city that meets the conditions regarding infrastructure to host the national competition.

Article 7. Authority to Recognize and Reward Collectives and Individuals Participating in the Competition

1. The head of vocational education establishments decides to recognize and reward authors or groups of authors who win awards at the grassroots-level competition according to regulations.

2. The Chairman of the People's Committee of the province or centrally governed city, and the Director of the Department of Labor, Invalids, and Social Affairs of the province or centrally governed city decide to recognize and reward authors or groups of authors who win awards; to reward collectives that win awards; and to reward individuals and collectives with outstanding achievements at the provincial-level competition according to regulations.

3. The Minister of Labor, Invalids, and Social Affairs, and the General Director of the General Department of Vocational Education decide to recognize and reward authors or groups of authors who win awards; to reward collectives that win awards; and to reward individuals and collectives with outstanding achievements at the national competition according to regulations.

Chapter II

ORGANIZATION OF THE COMPETITION

Article 8. Organizing Committee of the Competition

1. The head of the agency or unit organizing the Competition in accordance with Clause 2, Article 3 of this Circular shall decide to establish the Organizing Committee of the Competition at the corresponding level.

2. The Organizing Committee of the Competition consists of: Chairperson, Deputy Chairpersons, and members. Based on specific conditions, the Organizing Committee of the Competition establishes sub-committees to serve the Competition such as the Infrastructure Subcommittee, the Secretariat Subcommittee, the Supervision Subcommittee, the Incentive Subcommittee, and other sub-committees (if any). The functions, tasks, and composition of sub-committees are stipulated in the Competition Organization Regulations based on the scale of the Competition at each level.

3. Tasks of the Organizing Committee of the Competition:

a) Develop detailed plans for organizing the Competition;

b) Issue the Competition Organization Regulations;

c) Establish the Evaluation Board and sub-committees to serve the Competition;

d) Develop evaluation forms and criteria for evaluating participating equipment;

đ) Aggregate participating equipment, arrange and classify equipment according to each sub-committee;

e) Organize the Competition and other activities (if any) in accordance with the plan and ensure regulations;

g) Submit to the competent authority for approval of the decision to award prizes at the Competition;

h) Resolve complaints and grievances of individuals and groups participating in the Competition;

i) Summarize, evaluate, and announce the results of the Competition.

4. Tasks of the Chairperson of the Organizing Committee of the Competition

a) Direct all activities of the Competition;

b) Decide to establish the Evaluation Board and sub-committees to serve the Competition;

c) Decide on the scoring scale for competition contents and the score range for awards for participating equipment.

5. Tasks of the Deputy Chairperson of the Organizing Committee of the Competition

a) Assist the Chairperson of the Organizing Committee of the Competition in tasks assigned;

b) Substitute for the Chairperson of the Organizing Committee of the Competition to handle tasks when assigned by the Chairperson of the Organizing Committee of the Competition.

Article 9. Evaluation Board

1. Structure and Composition of the Evaluation Board

a) The Evaluation Board consists of: Chairman, Vice-Chairman, Secretariat Team, and evaluators. Evaluators are experts and teachers with a bachelor's degree or higher; they have at least five years of experience in the fields and trades involved in judging and are currently working in those fields and trades;

b) Evaluators are structured into evaluation sub-committees. Based on actual conditions and the scale of the Competition, the Chairman of the Evaluation Board proposes lists of sub-committee evaluators for each field, trade, or group of fields and trades. An evaluation sub-committee has three or five members, including one evaluator who is the Head of the sub-committee.

2. Tasks of the Evaluation Board

The Evaluation Board is responsible for objectively and accurately assessing the contents of participating equipment.

3. Tasks of the Chairman of the Evaluation Board

a) Direct, supervise, and be responsible for the evaluation activities of participating equipment, competition results, and related issues;

b) Propose to the Chairperson of the Organizing Committee of the Competition to decide on the transfer or supplementation of judges in evaluation sub-committees when necessary;

c) Report on the evaluation work of participating equipment to the Chairperson of the Organizing Committee of the Competition.

4. Tasks of the Vice-Chairman of the Evaluation Board

a) Assist the Chairman of the Evaluation Board in tasks assigned;

b) Substitute for the Chairman of the Evaluation Board to handle tasks when assigned by the Chairman of the Evaluation Board.

5. Tasks of the Head of the Evaluation Sub-Committee:

a) Direct and be responsible for the evaluation activities of participating equipment and related issues of the sub-committee;

b) Propose and recommend to the Chairman of the Evaluation Board adjustments to professional issues during the evaluation process of participating equipment and resolve related issues;

c) Perform the duties of an evaluator.

6. Tasks of an Evaluator:

a) Study the files of participating equipment;

b) Independently assess, score, and be responsible for their assessment opinions.

7. Tasks of the Secretariat Team

a) Receive files of participating equipment and evaluation forms from the Organizing Committee of the Competition and hand them over to each evaluation sub-committee;

b) Receive evaluation results of participating equipment from the Head of the evaluation sub-committee, aggregate the evaluation results, and hand them over to the Organizing Committee of the Competition;

c) Perform other tasks assigned by the Chairman of the Evaluation Board.

Article 10. Announcing the plan and registering to participate in the Competition

1. The Competition Organizing Committee shall notify the competition plan to participating teams at least 30 days before the date of the competition for grassroots-level competitions; 60 days for provincial-level competitions; and 90 days for national-level competitions.

2. Teams shall register their participation with the Competition Organizing Committee according to the Competition Organization Regulations.

Article 11. Evaluation of Participating Equipment

1. Participating equipment shall be evaluated and scored on a scale of 100 points.

2. Procedure for evaluating participating equipment

a) The author or group of authors shall present a summary of the participating equipment;

b) Members of the Small Judging Board shall ask questions to the author or group of authors;

c) The author or representative of the group of authors shall answer each member of the judging board's questions;

d) Members of the Small Judging Board shall provide comments and evaluate the participating equipment;

đ) Members of the Small Judging Board shall independently score the participating equipment through secret ballot voting and submit the sealed ballots to the Head of the Small Judging Board immediately after the completion of the evaluation;

e) The Head of the Small Judging Board shall submit the sealed scoring sheets to the Secretariat of the Judging Council.

3. Compilation of Competition Results

a) Judges shall score (rounding down to the nearest whole number) each detailed item under each evaluation criterion;

b) Each judge's score for the equipment is the total of all scores given to each detailed item under each evaluation criterion;

c) The score for the participating equipment is the average of the scores from all judges, rounded to two decimal places without rounding up or down;

d) In a Small Judging Board, if a judge's score differs by more than ten points above or below the average score of all judges in the Small Judging Board, that judge's score will not be included in the calculation of the equipment's score. In such cases, the score for the participating equipment is the average of the remaining judges' scores in the Small Judging Board. The Head of the Small Judging Board is responsible for reporting these cases to the Chairman of the Judging Council.

Article 12. Activities of the Competition

Depending on the actual conditions of the Competition at various levels, activities such as specialized seminars on self-made training equipment; exploitation and utilization of training equipment and other related contents; exhibitions and displays of self-made training equipment and training equipment from manufacturing and trading companies; signing cooperation agreements for production and supply of self-made training equipment between enterprises and educational institutions can be organized.

Article 13. Ranking Prizes and Announcing Competition Results

1. Individual and Team Rankings

a) For individual or team awards: The award assessment is based on the competition scores of the equipment and ranked in descending order within each industry or profession or across all participating industries and professions. Specific ranking for individuals or teams is carried out according to the Competition Organization Regulations;

b) For team awards: Based on the number of first, second, third prizes, and commendation awards obtained by vocational education institutions, team rankings are assessed. The specific rules for team rankings are stipulated in the Competition Organization Regulations.

2. Announcing Competition Results The results of individual and team rankings shall be announced at the Closing Ceremony of the Competition. Individuals or groups receiving awards at the Competition shall be awarded certificates of merit, commendation letters, and prizes.

Article 14. Report on the Competition Results

1. Within the latest thirty working days after the end of the Competition, the vocational education establishments shall submit the Competition results report at their level to the People's Committees of provinces and centrally-run cities (Department of Labor, Invalids and Social Affairs); the People's Committees of provinces and centrally-run cities shall submit the Competition results report at provincial level to the Ministry of Labor, Invalids and Social Affairs (General Department of Vocational Education).

2. The Competition results report shall include the following contents: the number of devices participating in the Competition by trades and occupations; list of individuals and groups winning awards at the Competition; general assessment of the Competition organization work, complaints and complaint resolution results (if any).

Article 15. Utilization of Competition Results

1. The Competition results serve as evidence for assessing professional standards; occupational title standards for vocational education professionals and implementing other policies for teachers; rewarding and awarding students, trainees according to current regulations.

2. Encouragement is given to authors and author groups who win awards at the Competition; management agencies at all levels continue to study and support resources for developing self-made training equipment to be replicated in vocational education establishments; registering to participate in technical innovation competitions at all levels; registering industrial property rights and intellectual property rights for equipment according to current regulations.

Article 16. Complaints and Complaint Resolution

1. Individuals and units participating in the Competition may file complaints in writing with the Competition Organizing Committee regarding the Competition organization; evaluation results and ranking of individuals and groups during the Competition period.

2. Competition Organizing Committees at all levels are responsible for resolving complaints in accordance with the law on complaints. The specific complaint resolution process is stipulated in the Competition Organization Regulations at all levels.

Chapter III

IMPLEMENTATION

Article 17. Responsibilities of the Host Unit Organizing the Competition

1. Develop plans and allocate resources to ensure conditions for organizing the Competition.

2. Coordinate with Competition Organizing Committees at all levels to organize the Opening Ceremony and Closing Ceremony.

3. Prepare the ground for installing competition devices.

4. Coordinate with competent authorities to ensure fire prevention and fighting, security, public order, and traffic for the Competition; arrange medical personnel on standby at the venue.

5. Support and guide delegations with devices participating in the Competition.

Article 18. Responsibilities of the Organizing Agencies at All Levels

1. Organize Competitions at all levels and fulfill responsibilities according to the authority stipulated in this Circular.

2. Develop plans to coordinate the organization of the Competition and allocate resources to ensure conditions for organizing the Competition.

Article 19. Effective Date

1. This Circular takes effect from January 1, 2023.
