CIRCULAR
Regulations on non-commissioned officers and conscripts with specialized technical qualifications when performing military service being prioritized for employment in positions suitable to the needs of the Military
Based on the Law on Military Service dated June 19, 2015;
Pursuant to Decree No. 35/2013/NĐ-CP dated April 22, 2013, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;
At the proposal of the Chief of General Staff;
The Minister of National Defense issues this Circular stipulating that non-commissioned officers and conscripts with specialized technical qualifications when performing military service shall be prioritized for employment in positions suitable to the needs of the Military.
Article 1. Scope of Regulation
This Circular stipulates that non-commissioned officers and conscripts with specialized technical qualifications when performing military service shall be prioritized for employment in positions suitable to the needs of the Military; responsibilities of agencies, organizations, units, and individuals.
Article 2. Applicability
This Circular applies to non-commissioned officers and conscripts with specialized technical qualifications trained before serving their compulsory military service; agencies, organizations, units, and individuals related thereto.
Article 3. Specialized Technical Fields Prioritized for Employment
1. College and university level:
a) Computer science; Telecommunications and computer networks; Software engineering; Information systems; Cybersecurity and network safety;
b) Civil law and civil procedure; Criminal law and criminal procedure; Economic law; International law;
c) Environmental science; Meteorology; Hydrology; Oceanography;
d) Foreign languages and cultures: English; French; Russian; German; Chinese; Japanese; Korean and countries in Southeast Asia;
đ) Languages and cultures of ethnic minorities in Vietnam;
e) Film and television technology; Museums; Cinematography; Sound and lighting design; Dance; Vocal music; Musical instruments; Photography;
g) Archival management;
h) Physical education and sports;
i) Finance; Accounting;

Article 4. Employment Arrangements
1. Commanders at regimental, brigade, and equivalent levels shall base their decisions on lists of non-commissioned officers and conscripts with specialized technical fields to ensure employment for subordinate units.
2. Principles of employment arrangements:
a) Assign non-commissioned officers and conscripts with specialized technical fields to positions corresponding to their job titles as established, without overlapping assignments;
b) Implement the assignment of non-commissioned officers and conscripts with specialized technical qualifications from highest to lowest level; prioritize fields not trained by the Military;
c) Non-commissioned officers and conscripts with specialized technical fields must undergo military training and knowledge enhancement appropriate to their assigned positions prior to employment.
3. Upon completion of compulsory military service, if the Military has no need or does not meet the criteria to recruit them into the officer corps, professional soldiers, defense workers, or defense officials, they will be discharged according to the provisions of the Law on Military Service Obligation.
Article 5. Responsibilities of agencies, organizations, and units
1. Level of subordinate units under the Ministry of National Defense:
a) Direct subordinate units to conduct reviews and compile reports on the quantity and list of new recruits with technical and professional qualifications from basic level and above;
b) Based on the staffing needs, current strength of non-commissioned officers and technical soldiers; the number of new recruits with technical and professional qualifications. After completing the training period for new soldiers, develop plans to transfer personnel to subordinate units for deployment according to management levels. Timely adjust non-commissioned officers and technical soldiers from units with surplus to those with shortages;
c) Summarize and evaluate the results of deploying and utilizing non-commissioned officers and technical soldiers with professional qualifications of subordinate units and report to the immediate superior;
2. Division-level and equivalent:
a) Based on the staffing needs, current strength of non-commissioned officers and technical soldiers; the number and list of new recruits with technical and professional qualifications and the number transferred for supplementary purposes by superiors. Transfer personnel to subordinate units for deployment according to management levels. Timely adjust non-commissioned officers and technical soldiers from units with surplus to those with shortages;
b) Compile lists and quantities of new recruits with technical and professional qualifications from basic level and above; periodically inspect, compile, and evaluate the results of deploying and utilizing non-commissioned officers and technical soldiers with professional qualifications of subordinate units and report to the immediate superior;
3. Regimental, brigade-level and equivalent:
a) Based on the staffing needs, current strength of non-commissioned officers and technical soldiers; the number and list of new recruits with technical and professional qualifications and the number transferred for supplementary purposes by superiors. Organize military training and education, deploy and utilize personnel for subordinate units;
b) Accurately grasp the number and list of new recruits with technical and professional qualifications from basic level and above; evaluate the results of deploying and utilizing non-commissioned officers and technical soldiers with professional qualifications of subordinate units and report to the immediate superior;
4. Company, battalion-level and equivalent:
a) Deploy and utilize non-commissioned officers and technical soldiers with professional qualifications in accordance with the provisions of Article 4 of this Circular;
b) Directly manage and effectively utilize existing non-commissioned officers and technical soldiers with professional qualifications;
c) Promptly propose adjustments and supplements and report to the immediate superior the results of deploying and utilizing non-commissioned officers and technical soldiers with professional qualifications as prescribed;
Article 6. Effectiveness
This Circular takes effect from February 15, 2017.
Article 7. Responsibility for Implementation
The Chief of General Staff, heads of agencies, organizations, units, and individuals concerned are responsible for implementing this Circular./.
