DECISION

Regarding the establishment of the Management Board of Kon Tum Province Economic Zone

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 108/2006/NĐ-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain provisions of the Investment Law;

Pursuant to Decree No. 29/2008/NĐ-CP dated March 14, 2008 of the Government on industrial zones, export processing zones, and economic zones;

Considering the proposal of the Chairman of the People's Committee of Kon Tum Province at the report No. 134/TTr-UBND dated December 14, 2009; and the Minister of Home Affairs at the letter No. 4110/BNV-TCBC dated December 18, 2009,

DECISION:

Article 1. Establishing and defining the position and functions of the Management Board of Kon Tum Province Economic Zone.

1. Establish the Management Board of Kon Tum Province Economic Zone (hereinafter referred to as the Management Board) based on the merger of the Management Board of Border Gate International Economic Zone Bo Y, Kon Tum Province (as stipulated in Decision No. 156/2008/QĐ-TTg dated December 1, 2008 of the Prime Minister) with the Management Board of Industrial Zones of Kon Tum Province (established pursuant to Decision No. 177/2005/QĐ-TTg dated July 15, 2005 of the Prime Minister).

2. The Management Board is an agency under the People's Committee of Kon Tum Province, performing the function of direct state management over industrial zones and border gate economic zones within Kon Tum Province; managing and organizing the provision of administrative public services and other supporting services related to investment and business activities for investors in industrial zones and border gate economic zones within the province according to the provisions of the law.

3. The Management Board has legal personality, has a bank account, a seal bearing the National Emblem, its office located in Kon Tum Province; it is the focal point for the provincial budget plan; it is allocated development capital from the central budget separately. Administrative management expenses and operating expenses of the Management Board are funded from the state budget according to the provisions of the law.

Article 2. Tasks and powers of the Management Board

The Management Board performs tasks and powers as prescribed in:

1. Article 81 of Decree No. 108/2006/NĐ-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain provisions of the Investment Law.

2. Articles 37 and 38 of Decree No. 29/2008/NĐ-CP dated March 14, 2008 of the Government on industrial zones, export processing zones, and economic zones.

3. Other relevant legal documents.

Article 3. Organizational structure and staffing of the Management Board.

1. Leadership of the Management Board:

The Management Board has a Director and not more than three Deputy Directors.

The Director is appointed and relieved of duty by the Chairman of the People's Committee of Kon Tum Province according to the criteria set forth by the Ministry of Planning and Investment; Deputy Directors are appointed and relieved of duty by the Chairman of the People's Committee of Kon Tum Province upon the recommendation of the Director of the Management Board.

2. Organizational structure of the Management Board:

a) Administrative organizations include: office, specialized and functional departments, and representatives of the Management Board in industrial zones and border gate economic zones within Kon Tum Province;

b) Affiliated public service organizations

Based on the requirements and tasks of developing industrial zones and border gate economic zones within Kon Tum Province at each specific stage, the Director of the Management Board shall take the lead and coordinate with relevant Ministries, Departments, and Agencies to submit to the Chairman of the People's Committee of Kon Tum Province for decision within their authority regarding the establishment of affiliated public service organizations under the Management Board.

3. Staffing:

a) The administrative staffing of the Management Board is decided by the People's Committee of Kon Tum Province within the total administrative staffing assigned, including: Director, Deputy Directors, and staffing of the office, specialized and functional departments, and representatives of the Management Board in industrial zones and border gate economic zones within Kon Tum Province.

b) The public service staffing of the Management Board is decided by the Chairman of the People's Committee of Kon Tum Province according to the provisions of the law on the decentralization of administrative and public service staffing management and the staffing management mechanism for state public service units.

4. The Director of the Management Board shall submit to the People's Committee of Kon Tum Province for detailed regulations on the functions, tasks, powers, and organizational structure of the Management Board in accordance with the provisions of the law.

Article 4. Effectiveness

This Decision takes effect from the date of issuance and replaces Decision No. 156/2008/QĐ-TTg dated December 1, 2008 of the Prime Minister on the Management Board of Border Gate International Economic Zone Bo Y, Kon Tum Province and Decision No. 177/2005/QĐ-TTg dated July 15, 2005 of the Prime Minister on the establishment of the Management Board of Industrial Zones of Kon Tum Province.

Article 5. Responsibility for Implementation

Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairman of the People's Committee of Kon Tum Province, Director of the Management Board of Kon Tum Province Economic Zone are responsible for implementing this Decision./.
