REGULATIONS ON TEACHING AND LEARNING IN FOREIGN LANGUAGES IN EDUCATIONAL INSTITUTIONS
Pursuant to the Law on Government Organization No. 63/2025/QH15;
Pursuant to the Law on Local Administration Organization No. 72/2025/QH15;
Pursuant to the Vocational Education Law No. 74/2014/QH13;
Pursuant to the Higher Education Law No. 08/2012/QH13; and the Law Amending and Supplementing Certain Articles of the Higher Education Law No. 34/2018/QH14;
Based on the Education Law number 43/2019/QH14;
At the proposal of the Minister of Education and Training;
The Government issues this Decree on teaching and learning in foreign languages in educational institutions.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
Article 1. This Decree stipulates the teaching and learning in foreign languages in educational institutions, including: principles for teaching and learning in foreign languages; requirements for teaching and learning in foreign languages regarding curriculum, textbooks, materials, teachers, students, infrastructure, teaching equipment, examinations, assessments, quality assurance, tuition fees, and management of tuition fees; authority, documents, procedures for approval, extension, adjustment, suspension, and termination of teaching and learning in foreign languages in educational institutions.
Article 2. This Decree does not apply to teaching and learning foreign language courses, foreign language modules; implementation of educational cooperation; joint training at bachelor's, master's, and doctoral levels with foreign countries; teaching foreign education programs.
Article 2. Applicability
Article 3. Scope of application
1. This Decree applies to general education institutions, continuing education institutions, vocational education institutions, higher education institutions, and schools of state agencies, political organizations, socio-political organizations, and armed forces (hereinafter referred to as educational institutions); teachers teaching in foreign languages, students learning in foreign languages; relevant authorities, organizations, and individuals involved in teaching and learning in foreign languages.
2. This Decree does not apply to educational institutions with foreign investment implementing full foreign language curricula in general education, continuing education, vocational education, and higher education.
Article 4. Principles for teaching and learning in foreign languages
1. Teaching and learning in foreign languages must originate from social needs, the voluntary participation of learners, and the requirement to ensure educational and training quality, contributing to promoting Vietnam’s education, traditions, and culture.
2. Courses, modules, subjects, and educational contents and activities taught and learned in foreign languages must meet the objectives, content, and methods of the approved curriculum at each level of education and training degree and comply with relevant laws concerning general education, continuing education, vocational education, and higher education.
3. Teaching and learning in foreign languages must be publicly disclosed to learners and related parties on the educational institution’s website immediately after the competent authority approves the foreign language teaching and learning project.
Chapter II
REQUIREMENTS FOR TEACHING AND LEARNING IN FOREIGN LANGUAGES
Article 4. Programs, textbooks, teaching materials used for teaching and learning in foreign languages and the authority to approve such programs, textbooks, and teaching materials
1. For general education
a) General education institutions implementing the Vietnamese General Education Program may teach and learn some subjects, educational activities, or certain contents of some subjects and educational activities in a foreign language, prioritizing subjects in mathematics, natural sciences, technology, and information technology fields;
b) Programs and teaching materials taught in a foreign language in general education institutions must ensure compliance with corresponding requirements stipulated in the subject and educational activity programs of the Vietnamese General Education Program and shall be implemented according to Clause 1 of Article 10 and Article 11 of this Decree.
2. For continuing education
a) The continuing education program is partially taught and learned in a foreign language;
b) Textbooks and teaching materials taught in a foreign language in continuing education institutions are selected by the director of the institution from those issued or approved by the Ministry of Education and Training or from suitable materials provided by universities, vocational training institutions, domestic and international educational organizations based on learners' needs and the capacity of the continuing education institution;
c) Programs and teaching materials taught in a foreign language in continuing education institutions that teach the general education program shall be implemented according to Clause 1 of Article 10 and Article 11 of this Decree;
d) Programs and teaching materials taught in a foreign language in continuing education institutions that teach vocational education and higher education programs shall be implemented according to Clause 3 and Clause 4 of this Article.
3. For vocational education
a) Programs of professions that have been registered for operation by authorized agencies or self-governed professions according to the law can be partially or entirely taught in a foreign language;
b) Programs and textbooks of vocational education institutions used for teaching and learning in a foreign language shall be implemented according to current regulations on the process of building, evaluating, and issuing training programs; organizing compilation, selection, evaluation, approval, and use of textbooks for primary, secondary, and college levels;
c) Textbooks and teaching materials used for teaching and learning in a foreign language in vocational education institutions shall be approved by the Principal (hereinafter referred to as the Principal) based on the evaluation results of the Evaluation Board established by the Principal, ensuring compliance with the textbook and teaching material evaluation process.
4. For higher education
a) Higher education programs, textbooks, courses, modules, and study units that have been approved by competent authorities can be partially or entirely taught in a foreign language;
b) Textbooks and teaching materials used for teaching and learning in a foreign language in higher education institutions shall be approved by the Principal (hereinafter referred to as the Principal) based on the evaluation results of the Evaluation Board established by the Principal, ensuring compliance with the textbook and teaching material evaluation process.
5. For state agency schools, political organization schools, and social-political organizations
a) Organizing vocational education training at various levels: programs, textbooks, and teaching materials shall be implemented according to Clause 3 of this Article;
b) Organizing higher education training at various levels: programs, textbooks, and teaching materials shall be implemented according to Clause 4 of this Article.
6. For education institutions under the Ministry of National Defense and the Ministry of Public Security
a) General education institutions: the approval of programs and teaching materials shall be carried out according to Clause 1 of this Article;
b) Vocational education institutions and higher education institutions: programs, textbooks, and teaching materials shall be approved by the Minister of National Defense and the Minister of Public Security.
7. The use of foreign languages for teaching and learning is specified in the Project on Teaching and Learning in Foreign Languages approved in Article 10 and Article 11 of this Decree, encouraging the use of English in educational institutions.
8. Programs, textbooks, and teaching materials used for teaching and learning in foreign languages do not include contents in political education, security, defense, history, and Vietnamese literature-related areas.
9. Information technology, artificial intelligence, and digital transformation are applied in teaching and learning in foreign languages in educational institutions through the use of technological tools and platforms to support teaching and learning, including the development of online learning systems, electronic textbooks, student management, and assessment of learning outcomes.
Article 5. Teachers and students shall conduct teaching and learning in a foreign language
1. Requirements for teachers
a) Professional and vocational requirements
Meeting the professional and vocational requirements, level of training, and enhancement as prescribed for each educational level and training level;
b) Foreign language proficiency
Primary school and lower secondary school teachers must have a minimum foreign language proficiency level of Level 4 according to the 6-level Vietnamese Foreign Language Proficiency Framework or equivalent; upper secondary school teachers must have a minimum foreign language proficiency level of Level 5 according to the 6-level Vietnamese Foreign Language Proficiency Framework or equivalent;
Teachers at regular education institutions teaching subjects and learning contents under the regular education program for lower secondary schools must have a minimum foreign language proficiency level of Level 4 according to the 6-level Vietnamese Foreign Language Proficiency Framework or equivalent;
Teachers at regular education institutions teaching some subjects, educational activities, or certain contents of some subjects and educational activities under the regular education program for upper secondary schools must have a minimum foreign language proficiency level of Level 5 according to the 6-level Vietnamese Foreign Language Proficiency Framework or equivalent;
Teachers at regular education institutions teaching learning contents under vocational education programs and higher education programs must have a minimum foreign language proficiency level of Level 5 according to the 6-level Vietnamese Foreign Language Proficiency Framework or equivalent;
Teachers at regular education institutions teaching learning contents under other regular education programs must have a minimum foreign language proficiency level of Level 4 according to the 6-level Vietnamese Foreign Language Proficiency Framework or equivalent;
Teachers of vocational education levels must have a minimum foreign language proficiency level of Level 5 according to the 6-level Vietnamese Foreign Language Proficiency Framework or equivalent;
University lecturers teaching university education levels must have a foreign language proficiency level meeting the teaching requirements of the training program, a minimum of Level 5 according to the 6-level Vietnamese Foreign Language Proficiency Framework or equivalent;
c) Individuals who have completed full-time bachelor's, master's, or doctoral degrees abroad with the foreign language as the language of instruction, and whose graduation certificates are recognized according to regulations, or who hold a bachelor's degree in foreign languages or foreign language education from Vietnam, are exempted from the foreign language proficiency requirements stipulated in point b of Clause 1 of this Article.
2. Students participating in courses, modules, study units, and educational contents and activities taught in a foreign language shall do so voluntarily. The initial assessment of students shall be conducted by the educational institution according to the requirements of the Project on Teaching and Learning in a Foreign Language approved in Article 10 and Article 11 of this Decree.
3. Responsibilities of teachers and students
a) Teachers are responsible for monitoring and evaluating students' ability to absorb knowledge taught in a foreign language, and taking appropriate measures to adjust, including recommending students to switch to classes taught and learned in Vietnamese;
b) Students are responsible for enhancing their foreign language proficiency to meet the program requirements and reporting their absorption capacity to teachers. In necessary cases, students may proactively propose solutions to improve quality or request to switch to classes taught and learned in Vietnamese.
Article 6. Material and Teaching Facilities
Educational institutions organizing teaching and learning in a foreign language must have material and teaching facilities that meet the standards prescribed for teaching and learning in Vietnamese.
Article 7. Examinations, Assessments, Graduation Recognition, and Issuance of Certificates and Diplomas
1. For general education
The regular and periodic assessments of subjects, educational activities, or parts of the content of subjects and educational activities taught and learned in a foreign language shall be conducted in Vietnamese or in a foreign language.
2. For continuing education
The organization of examinations, assessments, recognition of academic results, graduation recognition, and issuance of certificates and diplomas for subjects, contents, and educational programs taught and learned in a foreign language shall be carried out according to the guidelines of the Ministry of Education and Training. For continuous education programs at the lower secondary and upper secondary levels, this shall be implemented in accordance with Clause 1 of this Article.
3. For vocational education
The organization of examinations, assessments, recognition of graduation, and issuance of certificates and diplomas for all subjects, modules, and courses taught and learned in a foreign language shall be conducted as if they were organized in Vietnamese. Examinations and assessments for subjects and modules taught and learned in a foreign language shall be conducted in a foreign language. The final examination content shall be conducted in Vietnamese or a foreign language as decided by the Principal.
4. For higher education
The organization of examinations, assessments, recognition of graduation, and issuance of certificates and diplomas for all subjects, modules, and courses taught and learned in a foreign language shall be conducted as if they were organized in Vietnamese. Examinations and assessments for subjects and courses taught and learned in a foreign language shall be conducted in a foreign language.
5. Educational institutions decide on the language to be used in examinations, assessments, and evaluations of subjects, modules, courses, educational activities, or certain contents of subjects, modules, courses, and educational activities taught and learned in a foreign language.
Article 8. Requirements for Organizing and Ensuring Quality of Teaching and Learning in a Foreign Language
1. There must be a project for teaching and learning in a foreign language approved by the competent authority as stipulated in Article 10 of this Decree.
2. There must be curricula, textbooks, teaching materials; teachers, material and teaching facilities to ensure the organization of teaching and learning in a foreign language.
3. Subjects, modules, courses, educational activities, and contents taught and learned in a foreign language must meet the requirements of knowledge and skill standards, and the requirements for quality and capacity as set forth in the educational program.
Article 9. Tuition Fees, Usage, and Management of Tuition Fees for Teaching and Learning in a Foreign Language
1. For public general education and continuous education institutions
a) The tuition fee revenue to organize teaching and learning in a foreign language in public general education and continuous education institutions shall be implemented based on the principle of accurate and sufficient calculation, revenue covering expenses, and with the consent of the students;
b) The collection, usage, and management of tuition fees for teaching and learning in a foreign language at public general education and continuous education institutions shall be carried out in accordance with the regulations of the People's Councils of provinces and centrally-administered cities.
2. For public vocational education institutions
Based on the degree of financial autonomy and the ability to pay of the students, the level of tuition fees shall be determined based on economic and technical norms as prescribed by the Law on Vocational Education and the Government's regulations on the mechanism for managing tuition fees for vocational education institutions within the national education system; the tuition fee level shall be publicly disclosed before enrollment and the institution shall be responsible for explaining to the students and society about the tuition fee level.
3. For public higher education institutions
Based on the degree of financial autonomy and the ability to pay of the students, the level of tuition fees shall be determined based on economic and technical norms as prescribed by the Law on Higher Education and the Government's regulations on the mechanism for managing tuition fees for public higher education institutions within the national education system; the tuition fee level shall be publicly disclosed before enrollment and the institution shall be responsible for explaining to the students and society about the tuition fee level.
4. For private and non-state educational institutions
a) Proactively establish tuition fee levels for each academic year and course for each subject, module, course, educational activity, and content taught and learned in a foreign language, ensuring coverage of costs and reasonable accumulation, and being responsible for publicly disclosing and explaining to the students and society about the tuition fee level decided by the educational institution;
b) Be responsible for explaining the average tuition fee per student, annual tuition fee level, total tuition fee level for the entire academic level; explain the roadmap and percentage increase in tuition fees for subsequent years, implement transparency and openness in accordance with the law, and explain to the students and society,
5. The collection, usage, and management of tuition fees for teaching and learning in a foreign language at schools under state agencies, political organizations, social-political organizations, and armed forces shall be carried out in accordance with current laws.
6. The use of tuition fees to ensure costs for teaching and learning in a foreign language, including payment for teachers' remuneration. Expenses from tuition fees shall be carried out in accordance with current laws.
7. The management of tuition fees, accounting work, statistics, consolidation, and annual settlement reports of the unit shall be carried out in accordance with current laws, ensuring transparency and openness. Educational institutions must comply with the requirements of financial inspection, audit, and educational management authorities regarding teaching and learning in a foreign language.
Chapter III
AUTHORITY, FILES, PROCEDURES FOR APPROVAL, EXTENSION, AMENDMENT, SUSPENSION, TERMINATION OF TEACHING AND LEARNING IN A FOREIGN LANGUAGE IN EDUCATIONAL INSTITUTIONS
Article 10. Competence to Approve Programs for Teaching and Learning in Foreign Languages
1. The People's Committee at the provincial level delegates the Department of Education and Training to approve programs for teaching and learning in foreign languages of general education institutions and regular education institutions under its management authority.
2. The principal of vocational education institutions approves programs for teaching and learning in foreign languages for their educational institutions.
3. The principal of higher education institutions, schools of state agencies, political organizations, and socio-political organizations approves programs for teaching and learning in foreign languages for their educational institutions.
4. The direct managing agency approves programs for teaching and learning in foreign languages for educational institutions not specified in Clauses 1, 2, and 3 of this Article.
5. Educational institutions under the Ministry of National Defense and the Ministry of Public Security
a) For general education institutions, they shall implement Clause 1 of this Article;
b) For vocational education institutions and higher education institutions, the Ministers of National Defense and Public Security shall approve programs for teaching and learning in foreign languages.
Article 11. Documents and Procedures for Approving Programs for Teaching and Learning in Foreign Languages
1. Application Documents for Approval of Programs for Teaching and Learning in Foreign Languages
a) For general education institutions and regular education institutions specified in Clause 1 of Article 10 and educational institutions specified in Clauses 4 and 5 of Article 10 of this Decree
A request document for approving the program for teaching and learning in foreign languages according to Model No. 01 attached to this Decree, including the following contents: information on the educational institution; objectives and scope of the program; duration of the program; name of the program, curriculum, subjects, modules, courses, teaching and learning activities in foreign languages, time allocation, type of program; outcomes, exams, assessments;
The program for teaching and learning in foreign languages is attached to the request document at Model No. 01 of the Appendix issued with this Decree, including the following contents: objectives of the program; student population, scale; teaching staff participating in teaching; exams, assessments, graduation certification, issuance of diplomas or certificates (if applicable); infrastructure, teaching equipment; tuition fees, management and use of tuition fees for teaching and learning in foreign languages; language used for teaching and learning in foreign languages; measures to ensure quality and risk management; plans to protect the rights of teachers and learners in case the program is terminated or suspended, revoked; management mechanism including organizational structure of the program, responsibilities and authorities of the assigned management unit, responsibilities and authorities of teachers, learners, and related parties; teaching materials used for teaching and learning in foreign languages.
b) For vocational education institutions, higher education institutions, schools of state agencies, political organizations, and socio-political organizations specified in Clauses 2 and 3 of Article 10 of this Decree
The educational institution builds the program for teaching and learning in foreign languages according to Model No. 01 attached to this Decree.
2. Procedure and Process for Approval
a) For general education institutions and regular education institutions specified in Clause 1 of Article 10 and educational institutions specified in Clauses 4 and 5 of Article 10 of this Decree
The educational institution submits one set of application documents as stipulated in point a of Clause 1 of this Article to the competent authority specified in Article 10 of this Decree through postal services or directly or via the online public service portal;
Within five working days, if the application documents do not meet the requirements as stipulated in point a of Clause 1 of this Article, the competent authority will notify the educational institution to supplement and complete the documents according to regulations;
Within ten working days from the date of receiving all required documents as stipulated in point a of Clause 1 of this Article, the competent authority will seek opinions from relevant units, functional agencies, and experts related to the program. Relevant functional agencies and experts provide their opinions within three working days;
Within twelve working days from the date of receiving all required documents as stipulated in point a of Clause 1 of this Article, the competent authority issues a Decision to Approve the Program according to Model No. 02 attached to this Decree. In case of disagreement, the competent authority will notify the educational institution in writing about the result of processing (specifying the reasons) if the program is not approved.
b) For vocational education institutions, higher education institutions, schools of state agencies, political organizations, and socio-political organizations specified in Clauses 2 and 3 of Article 10 of this Decree
The principal of the educational institution issues a Decision to Approve the Program for Teaching and Learning in Foreign Languages at their educational institution according to Model No. 02 attached to this Decree.
Article 12. Duration of Effectiveness of the Decision Approving the Foreign Language Teaching and Learning Project
The Decision approving the Foreign Language Teaching and Learning Project shall be effective for ten years from the date of signing and may be extended, with each extension not exceeding ten years.
Article 13. Extension or Adjustment of the Foreign Language Teaching and Learning Project
1. Principles of Extension or Adjustment
a) The extension of the implementation period of the Foreign Language Teaching and Learning Project must be carried out six months before the project expires;
b) The adjustment of the Foreign Language Teaching and Learning Project shall be implemented when there is a change or addition to one or more contents of the project during its validity period.
2. Conditions for Extension or Adjustment
An educational institution may be considered for the extension of the implementation period of the Foreign Language Teaching and Learning Project or for the adjustment of the project if it meets the following conditions:
a) Implementing all contents in the Decision approving the project that have been approved by the competent authority;
b) Continuing to meet the conditions stipulated in Articles 4, 5, 6, 7, 8, and 9 of this Decree.
3. Documents for Requesting Extension or Adjustment
a) For general education institutions and regular education institutions specified in Clause 1 of Article 10 and educational institutions specified in Clauses 4 and 5 of Article 10 of this Decree
A document requesting the extension or adjustment of the Foreign Language Teaching and Learning Project should be submitted to the competent authority approving the project, including proposals for the contents to be extended or adjusted according to Model No. 03 attached to this Decree;
A report on the implementation of the Foreign Language Teaching and Learning Project during the period the Decision approving the project is effective, according to Model No. 07 attached to this Decree, including the following contents: legal basis, general information about the foreign language teaching and learning program; results of organizing foreign language teaching and learning including enrollment work, training programs, number of learners participating, number of teachers and lecturers involved in teaching and supporting teaching, assessment of the effectiveness of improving foreign language skills of teachers and learners when implementing foreign language teaching and learning; clearly stating advantages, difficulties, and obstacles in implementing foreign language teaching and learning; local and educational institution's guidance and support in implementing foreign language teaching and learning; suggestions and recommendations (if any).
b) For vocational education institutions, higher education institutions, schools of state agencies, political organizations, and socio-political organizations specified in Clauses 2 and 3 of Article 10 of this Decree
A report on the implementation of the Foreign Language Teaching and Learning Project during the period the Decision approving the project is effective, according to Model No. 07 attached to this Decree.
4. Authority, Procedures, and Formalities for Extension or Adjustment
a) For general education institutions and regular education institutions specified in Clause 1 of Article 10 and educational institutions specified in Clauses 4 and 5 of Article 10 of this Decree
The competent authority approving the Foreign Language Teaching and Learning Project has the authority to extend or adjust the project. The application documents for extension or adjustment need to be submitted to the authority specified in Article 10 of this Decree;
An educational institution submits one set of documents to the competent authority specified in Article 10 of this Decree through postal services or directly or via the online public service portal;
Within five working days from the date of receipt of the application for extension or adjustment, if the documents do not comply with the contents prescribed in Clause 3 of this Article, the competent authority will notify the educational institution to supplement and complete the documents;
Within five working days from the date of receipt of valid documents, the competent authority approving and issuing the Decision on extending or adjusting the project according to Model No. 02 attached to this Decree. In case the educational institution does not meet the conditions for extending or adjusting the project, the competent authority will respond in writing, specifying the reasons why the project has not been extended or adjusted.
b) For vocational education institutions, higher education institutions, schools of state agencies, political organizations, and socio-political organizations specified in Clauses 2 and 3 of Article 10 of this Decree
The Principal of the educational institution issues the Decision on extending or adjusting the Foreign Language Teaching and Learning Project at their institution according to Model No. 02 attached to this Decree.
Article 14. Suspension of activities, resumption after expiration of suspension period; revocation of Decision approving and termination of operation of foreign language teaching and learning project
1. Suspension of activities of foreign language teaching and learning project
a) Suspension of activities of foreign language teaching and learning project in the following cases:
The Decision approving the project ceases to be effective;
Educational institutions fail to meet the requirements stipulated in Articles 4, 5, 6, 7, 8, and 9 of this Decree;
Educational institutions commit acts of violation of laws related to organizing foreign language teaching and learning or are subject to administrative penalties at the level of suspension of activities by competent authorities.
b) Duration of suspension: six months from the date of notification by the competent authority suspending the project.
c) Authority to suspend activities of foreign language teaching and learning project
For general education institutions, regular education institutions specified in Clause 1, Article 10 and educational institutions specified in Clauses 4 and 5, Article 10 of this Decree: The authority to suspend the project's activities is the authority that approves the project according to Article 10 of this Decree;
For vocational education institutions, higher education institutions, schools of state agencies, political organizations, and socio-political organizations specified in Clauses 2 and 3, Article 10 of this Decree: The authority to suspend the project's activities is the direct management agency or the state management agency for education within its jurisdiction.
d) Procedures for implementation
When discovering violations by educational institutions as stipulated in point a, Clause 1 of this Article, the competent authority organizes inspections to assess the actual situation, prepares inspection records, and notifies the educational institution about the violation;
Within seven working days from the date of notifying the educational institution about the violation, the competent authority decides on the suspension of the project's activities based on the degree of violation, informs the educational institution in writing, and implements it. The Decision to suspend the project is made according to Model No. 05 attached to this Decree.
đ) Educational institutions request to continue implementing the project after rectifying the errors and violations leading to the suspension of activities
During the suspension period, if the cause of the suspension is rectified, the educational institution shall notify the competent authority in writing along with evidence. Within three working days from the date of receipt of the notification from the educational institution, the competent authority shall examine and decide to allow the educational institution to continue implementing the project, and inform the educational institution in writing.
2. Revocation of Decision approving foreign language teaching and learning project
a) Revocation of Decision approving foreign language teaching and learning project in the following cases:
Educational institutions commit acts of violation of laws related to organizing foreign language teaching and learning or are subject to administrative penalties up to the level of revoking the Decision during the implementation of the project;
After the suspension period expires, the project is not extended or the educational institution fails to rectify the errors and violations leading to the suspension of activities.
b) Authority to revoke Decision approving foreign language teaching and learning project
For general education institutions, regular education institutions specified in Clause 1, Article 10 and educational institutions specified in Clauses 4 and 5, Article 10 of this Decree: The authority to revoke the Decision approving the project is the authority that approves the project according to Article 10 of this Decree;
For vocational education institutions, higher education institutions, schools of state agencies, political organizations, and socio-political organizations specified in Clauses 2 and 3, Article 10 of this Decree: The authority to revoke the Decision approving the project is the direct management agency or the state management agency for education within its jurisdiction.
c) Procedures for implementation
When discovering violations by educational institutions as stipulated in point a, Clause 2 of this Article, the competent authority organizes inspections to assess the actual situation, prepares inspection records, and notifies the educational institution about the violation;
Within seven working days from the date of notifying the educational institution about the violation, the competent authority decides on the revocation of the Decision approving the project based on the degree of violation, informs the educational institution in writing, and implements it. The Decision to revoke the Decision approving the project is made according to Model No. 05 attached to this Decree.
3. Termination of activities of foreign language teaching and learning project by educational institutions
a) The termination of the foreign language teaching and learning project must ensure the rights and interests of teachers and learners.
b) For general education institutions, regular education institutions specified in Clause 1, Article 10 and educational institutions specified in Clauses 4 and 5, Article 10 of this Decree
The educational institution submits a written request to terminate the activities of the foreign language teaching and learning project to the competent authority specified in Article 10 of this Decree according to Model No. 04 attached to this Decree, including contents about the educational institution, the Decision allowing the implementation of the project; reasons for terminating the project; commitment to ensuring the rights and interests of teachers and learners, honesty and accuracy of the content of the request to terminate; proposals and recommendations (if any);
The educational institution submits one set of documents to the competent authority specified in Article 10 of this Decree through postal services or directly or through the online public service portal; Within three working days from the date of receipt of the request to terminate the project's activities from the educational institution, the competent authority examines and issues a Decision to terminate the project's activities according to Model No. 06 attached to this Decree.
c) For vocational education institutions, higher education institutions, schools of state agencies, political organizations, and socio-political organizations specified in Clauses 2 and 3, Article 10 of this Decree
The Rector of the educational institution shall issue a Decision to terminate the operation of the foreign language teaching and learning project at their educational institution according to Model No. 06 attached for implementation pursuant to this Decree.
Chapter IV
IMPLEMENTATION
Article 15. Responsibilities of the Ministry of Education and Training
1. Shall be responsible for assisting the Government in uniformly managing state administration over foreign language teaching and learning in educational institutions.
2. Direct and guide foreign language teaching and learning activities in educational institutions under its state management scope; inspect and supervise the implementation of foreign language teaching and learning in localities and educational institutions within its state management responsibility.
3. Study and propose to competent authorities to promulish or promulish within their authority mechanisms and policies to improve the quality of foreign language teaching and learning in educational institutions.
Article 16. Responsibilities of ministries, ministerial-level agencies, and government agencies
1. Encourage and create conditions for educational institutions under their state management to implement foreign language teaching and learning activities.
2. Based on assigned functions and tasks, coordinate with the Ministry of Education and Training to direct and inspect foreign language teaching and learning activities in educational institutions within their management scope.
Article 17. Responsibilities of Provincial People's Committees and Municipal People's Committees under the Central Government
1. Direct, guide, and organize the implementation of this Decree for educational institutions under their management authority within their administrative areas.
2. Submit to the provincial People's Councils regulations on tuition fees to ensure conditions for serving foreign language teaching and learning activities that meet the needs and aspirations of learners in public educational institutions within their management area, in accordance with the actual conditions of the locality.
3. Based on education development policies and actual conditions of the locality, allocate resources, enhance socialization, create conditions, and adopt measures to encourage foreign language teaching and learning activities.
4. Inspect, check, handle complaints and denunciations, and perform state management functions over foreign language teaching and learning activities in educational institutions within their administrative areas.
Article 18. Reporting System on the Implementation of Foreign Language Teaching and Learning Activities
1. Content of the report: General situation regarding the implementation of foreign language teaching and learning activities; difficulties, obstacles, and recommendations, proposals (if any).
2. Agencies sending and receiving reports and reporting deadlines
a) General education schools and regular education institutions in the locality shall submit reports to the People's Committees of provinces and centrally-administered cities;
b) Vocational education institutions, higher education institutions, and schools of state agencies, political organizations, and socio-political organizations conducting vocational and higher education training programs shall submit reports to the Ministry of Education and Training;
c) People's Committees of provinces and centrally-administered cities (where they have implemented the foreign language teaching and learning project) shall submit reports to the Ministry of Education and Training.
3. Method of submitting reports: through postal services or directly or via the online public service portal.
4. Based on the reporting system stipulated in this Article, the agency submitting the report shall integrate the content of the report on the implementation of foreign language teaching and learning activities into periodic reports as prescribed within the scope of their state management under the Ministry of Education and Training.
Chapter V
IMPLEMENTING PROVISIONS
Article 19. Transitional Provisions
Programs of foreign language teaching and learning currently being implemented according to Decision No. 72/2014/QĐ-TTg dated December 17, 2014, of the Prime Minister on foreign language teaching and learning in schools and other educational institutions shall continue to be implemented until the end of the academic level or the program training cycle.
Article 20. Effective Date
This Decree shall take effect from September 25, 2025.
From the date this Decree takes effect, Decision No. 72/2014/QĐ-TTg dated December 17, 2014, of the Prime Minister on foreign language teaching and learning in schools and other educational institutions and Circular No. 16/2016/TT-BGDĐT dated May 18, 2016, of the Ministry of Education and Training guiding the implementation of certain contents of Decision No. 72/2014/QĐ-TTg dated December 17, 2014, of the Prime Minister on foreign language teaching and learning in schools and other educational institutions shall be abolished.
Article 21. Responsibility for Implementation
The Minister, the Heads of ministerial-level agencies, the Heads of government agencies, the Chairpersons of Provincial People's Committees and Municipal People's Committees under the Central Government, relevant organizations, and individuals shall be responsible for implementing this Decree.
