ON THE FUNCTIONS, DUTIES, POWERS AND ORGANIZATIONAL STRUCTURE OF THE ANTI-CORRUPTION AGENCY

GENERAL INSPECTOR

  Pursuant to the Inspection Law dated June 15, 2004;
  Pursuant to the Anti-Corruption Law dated November 29, 2005;
  Pursuant to the Complaints and Petitions Law dated November 25, 1998 and the Law Amending and Supplementing Certain Articles of the Complaints and Petitions Law dated June 15, 2004; the Law Amending and Supplementing Certain Articles of the Complaints and Petitions Law dated November 29, 2005;
  Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government on the functions, duties, powers, and organizational structure of ministries and ministerial-level agencies;
  Pursuant to Decision No. 1424/QĐ-TTg dated October 31, 2006 of the Prime Minister on the establishment of the Anti-Corruption Agency under the Government Inspectorate;
  Considering the proposal of the Organization and Cadres Department Director,

DECISION:

Article 1. Position and Functions

The Anti-Corruption Agency is a unit subordinate to the Government Inspectorate with the function of assisting the Chief Inspector in state management of anti-corruption work; implementing inspection tasks against corruption within the authority of the Government Inspectorate.

The Anti-Corruption Agency has legal personality; it has its own seal; it is entitled to open an account at the State Treasury; its main office is located in Hanoi City.

Article 2. Tasks and Authorities

1. The Anti-Corruption Agency shall have the following tasks:

 a. Drafting and submitting to the Chief Inspector strategic plans, programs, and plans for anti-corruption;

 b. Assisting the Chief Inspector in organizing, directing, and guiding the implementation of legal provisions on anti-corruption according to the functions of the Government Inspectorate;

 c. Inspecting and supervising the responsibility of ministries, ministerial-level agencies, government-affiliated agencies, provincial people's committees, and centrally governed cities in implementing legal provisions on anti-corruption;

 d. Inspecting cases with signs of corruption within the authority of the Government Inspectorate;

 đ. Receiving and collecting information on cases with signs of corruption; building a database on anti-corruption information;

 e. Summarizing and reporting results on anti-corruption within the scope of state management of the Government Inspectorate; summarizing experiences in anti-corruption work;

Article 3. Organization and Staffing

1. The Anti-Corruption Bureau shall have a Director and Deputy Directors and inspectors.

2. The organizational structure of the Anti-Corruption Bureau includes:

a. A general office;

b. A monitoring division for anti-corruption in ministries and sectors (referred to as Division I);

c. A monitoring division for anti-corruption in localities in the Northern region (referred to as Division II);

d. A monitoring division for anti-corruption in localities in the Central region (referred to as Operational Division III);

e. An office representative in Ho Chi Minh City (with its own seal) to monitor anti-corruption in southern provinces.

3. The staffing of the Anti-Corruption Bureau shall be determined by the Chief Inspector General within the total number of staff of the Government Inspectorate.

4. The Director of the Anti-Corruption Bureau is responsible for directing the establishment of operational regulations of the Bureau to be reviewed by the Chief Inspector General.

Article 4. Effective date

This Decision takes effect from the date of signature.

Article 5. Responsibilities for Implementation

The Head of the Office, the Heads of the Cadres and Civil Servants Department, the Director of the Anti-Corruption Bureau, and the Heads of units under the Government Inspectorate are responsible for implementing this decision.
