Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on Thrift and Combating Wastefulness No. 48/2005/QH11 dated November 29, 2005;
Considering the proposal of the Minister of Posts and Telecommunications,
DECISION:
Article 1. Amending certain Articles of Decision No. 169/2006/QĐ-TTg dated July 17, 2006 of the Government on investment and procurement of information technology products for agencies and organizations using state budget funds.
1. Article 1 shall be amended as follows:
Article 1. Scope and Applicability
1. Scope of Application: This Decision regulates investment and procurement of information technology products for agencies and organizations using state budget funds or funds derived from state budgets.
2. Subjects of Application: This Decision applies to state agencies, public service units, political organizations, political-social organizations, agencies and units under armed forces (hereinafter referred to as agencies and organizations) using state budget funds or funds derived from state budgets for investment and procurement of information technology products to serve non-commercial activities.
Clause 5 of Article 2 shall be amended as follows:
"5. Prioritize investment and procurement of open-source software products, especially those provided by domestic enterprises that have equivalent functions, features, and quality compared to commercial software, meeting the requirements of state agencies and organizations."
3. Clause 2 of Article 4 shall be amended as follows:
"For international bidding information technology projects, there must be mechanisms to prioritize foreign contractors who form joint ventures with Vietnamese contractors and commit to allocating larger volumes of work to Vietnamese contractors, or propose plans to use more domestically produced information technology products."
Article 2. This Decision takes effect fifteen days after its publication in the Official Gazette.
Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees, municipal People's Committees directly under the Central Government, and subjects specified in Article 1 are responsible for implementing this Decision./.
