REGARDING PARTICIPATION IN COMPENSATION SCHEMES
WHEN THE STATE ACQUIRES LAND
Respected: - Ministries, ministerial-level agencies, central government agencies, and central-level political-social organizations.
- People's Committees of provinces and centrally-administered cities.
On April 24, 1998, the Government issued Decree No. 22/1998/NĐ-CP on compensation for losses when the State acquires land for national defense, security, national interests, or public interest purposes, replacing Decree No. 90/CP dated August 17, 1994 of the Government. Clause 6 of Article 34 of Decree No. 22/1998/NĐ-CP stipulates: "... Specifically for investment projects funded by central government budget funds, before being approved by provincial or centrally-administered city People's Committees, project sponsors must report compensation plans to the Ministry of Finance for comments."
Until the Ministry of Finance issues guidelines on determining the K factor for land valuation in calculating compensation, the Ministry of Finance requests that ministries and sectors responsible for investment management temporarily participate in compensation schemes for central government budget-funded projects. Provincial or centrally-administered city People's Committees are responsible for approving compensation plans.
