The foreign diplomatic mission referred to in this circular includes:concerning the classification and determination of state management authority in the field of crop productionng được sửa lại là Quyết định số 53/2003/Q-BTC.

a) Diplomatic representative offices: Embassies, lower-level diplomatic representative offices than embassies, and offices attached to diplomatic representative offices.

b) General consulates and consulates.

c) Representative offices and international organizations under the United Nations and intergovernmental organizations.

d) Diplomatic officials, international officials, administrative, technical staff, and service staff who are foreigners of the aforementioned offices.

2. The Ministry of Foreign Affairs (Diplomatic Service Bureau) shall provide services for renting houses, repairing, renovating houses, and employing labor for foreign diplomatic missions in Hanoi.

For foreign diplomatic missions with headquarters in other localities outside Hanoi, the relevant functional agencies under the People's Committees of provinces and centrally-administered cities shall handle requests for renting houses and employing labor in accordance with state regulations and guidance from the Ministry of Foreign Affairs.

3. The Ministry of Foreign Affairs (Diplomatic Service Bureau) is responsible for managing, operating, providing services, and renting the following types of houses to foreign diplomatic missions:

a) Houses transferred by the State to the Ministry of Foreign Affairs (Diplomatic Service Bureau) for management and use by foreign diplomatic missions pursuant to agreements between the Government of Vietnam and the governments of other countries or international organizations.

b) Houses built or purchased by the Ministry of Foreign Affairs (Diplomatic Service Bureau) from other owners for rent to foreign diplomatic missions.

c) Houses jointly developed or associated with business organizations in the real estate sector of all economic components for rent to foreign diplomatic missions by the Ministry of Foreign Affairs (Diplomatic Service Bureau).

4. Foreign diplomatic missions headquartered in Hanoi that need to rent, repair, or renovate houses must submit specific requests to the Ministry of Foreign Affairs (Diplomatic Service Bureau). The Ministry of Foreign Affairs (Diplomatic Service Bureau) is responsible for handling these requests.

In cases where the Ministry of Foreign Affairs (Diplomatic Service Bureau) does not have sufficient houses or cannot provide housing services for foreign diplomatic missions, it will request assistance from the city's real estate sector or relevant agencies of the Ministry of Construction in accordance with Circular No. 03-TT/LB dated April 8, 1991 of the Joint Ministries.

Foreign diplomatic missions headquartered in provinces and centrally-administered cities (outside Hanoi) should submit their requests to local housing service agencies for handling in accordance with Circular No. 03-TT/LB dated April 8, 1991 of the Joint Ministries.

Procedures for signing contracts for renting, repairing, and renovating houses must comply with Vietnamese state regulations and be consistent with international customs.

5. Vietnamese citizens residing in Hanoi who meet the criteria stipulated in Decision No. 389/HĐBT dated November 10, 1990 of the Council of Ministers and Circular No. 03-TT/LB dated April 8, 1991 may prepare applications and register with the Ministry of Foreign Affairs (Diplomatic Service Bureau) to be considered for employment with foreign diplomatic missions in Hanoi.

- Foreign diplomatic missions headquartered in Hanoi that require hiring Vietnamese labor must submit their requests to the Ministry of Foreign Affairs (Diplomatic Service Bureau).

The Ministry of Foreign Affairs (Diplomatic Service Bureau) will base on the demand for hiring labor from foreign diplomatic missions to train and select laborers for them to hire or introduce qualified Vietnamese citizens to sign labor contracts with foreign diplomatic missions and regularly send lists of workers to the Department of Labor, Invalids, and Social Affairs of Hanoi.

The Ministry of Foreign Affairs (Diplomatic Service Bureau) has the responsibility to manage Vietnamese citizens working for foreign diplomatic missions in Hanoi.

6. Vietnamese citizens residing in provinces and centrally-administered cities (outside Hanoi) who meet the criteria stipulated in Decision No. 389/HĐBT dated November 10, 1990 of the Council of Ministers and Circular No. 03-TT/LB dated April 8, 1991 may prepare applications and register with the Department of Labor, Invalids, and Social Affairs or local labor service agencies (if any) to be considered for employment with foreign diplomatic missions headquartered in their locality.

Foreign diplomatic missions headquartered in provinces and centrally-administered cities (outside Hanoi) that require hiring Vietnamese labor must submit their requests to the Department of Labor, Invalids, and Social Affairs or local labor service agencies (if any) for handling in accordance with the procedures stipulated in Circular No. 03-TT/LB dated April 8, 1991 of the Joint Ministries.

Agencies providing labor services and Vietnamese citizens working for foreign diplomatic missions are responsible for complying with laws and regulations on foreign relations, protecting national security and social order, signing and strictly implementing labor contracts in accordance with state regulations.

7. The obligations of organizations engaged in providing services for renting housing and employing labor for foreign diplomatic missions and the laborers working for foreign diplomatic missions towards the state budget shall be applied in accordance with Section C of Circular No. 03-TT/LB dated April 8, 1991 of the Joint Ministries.

8. This circular takes effect from the date of issuance. Cases of renting housing and employing labor for foreign diplomatic missions prior to this circular that are inconsistent with its provisions must be rectified.

Any violations of the regulation on renting housing and employing labor for foreign diplomatic missions must be examined and dealt with in accordance with Decision No. 389/HĐBT dated November 10, 1990 of the Council of Ministers.

All acts violating the regulation on renting houses and hiring labor for diplomatic missions must be examined and dealt with according to Decree No. 389/HĐBT dated November 10, 1990 of the Council of Ministers.
