THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to the Law on Protection and Development of Forests, Government Decree No. 23/2006/ND-CP dated March 3, 2006, guiding the implementation of the Law on Protection and Development of Forests;
Pursuant to Government Decree No. 117/2010/ND-CP dated December 24, 2010, on the organization and management of special-use forests;
Pursuant to Government Decree No. 01/2008/ND-CP dated January 3, 2008, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; Government Decree No. 75/2009/ND-CP dated September 10, 2009, amending Article 3 of Government Decree No. 01/2008/ND-CP dated January 3, 2008;
Pursuant to Decision No. 1243/QD-BTNMT dated June 13, 2008, of the Ministry of Natural Resources and Environment approving the environmental impact assessment report for the 500kV Son La - Hiep Hoa power transmission line project;
Considering the proposal of the Director of the Vietnam Forest Science Institute at Report No. 540/TT/KHLN-KH dated September 21, 2011, of the Vietnam Forest Science Institute regarding the change of forest land use purpose for constructing the power transmission project and recovering the value of forest products on the converted land area and within the power line safety zone;
At the proposal of the Director General of the Forest Management Department,
DECISION:
Article 1. Approve the file for changing the purpose of forest land use to construct the 500kV Son La - Hiep Hoa national power transmission project passing through the land area of the Northeast Forest Science and Production Center under the Vietnam Forest Science Institute with the following contents:
1. The location for changing the purpose of forest land use to construct the power transmission project is at two tower positions in lot 3, lot 5, compartment 1, Lung Va area, Ngoc Than commune, Vinh Phuc province;
2. The area for changing the purpose of forest land use to construct the power transmission towers is 0.19151 hectares and the power line safety zone is 0.97 hectares;
Article 2. Direct the Vietnam Forest Science Institute to instruct the Northeast Forest Science and Production Center to cooperate with the National Power Transmission Corporation to prepare the design exploitation harvesting plan for planted forests strictly according to the locations and areas specified in Clause 1.
The National Power Transmission Corporation shall be responsible for cooperating with the Northeast Forest Science and Production Center to develop the replanting plan in accordance with current laws.
Article 3. The Head of the Ministry's Office, Heads of relevant Departments, General Directors of the Forestry General Department, Director of the Vietnam Forest Science Institute, Heads of related agencies shall be responsible for implementing this Decision.
