Regarding the approval of the Plant Seed Program, Livestock Breed Program, and Forestry Seedling Program for the period 2000-2005

Approving the Plant Seed Program, Livestock Breed Program, and Forestry Seedling Program for the period 2000-2005 with the aim of:

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

At the request of the Minister of Agriculture and Rural Development,

DECISION:

Article 1. 1. Ensuring sufficient high-quality seeds to meet the needs for production development, primarily important industries related to the income of a large number of farmers and having significant export value such as rice, coffee, rubber, tea, cashew nuts, pepper, vegetables, fruit trees, oilseed crops, sugarcane, feed crops, pigs, beef cattle, dairy cattle, poultry, and important forestry seedlings serving paper and wood production, etc.

2. Applying new and traditional science and technology towards utilizing hybrid advantages while maintaining biological diversity, gradually applying biotechnology in breeding programs;

3. Establishing a system of plant seed, livestock breed, and forestry seedling production and service suitable for market mechanisms;

4. Encouraging all organizations and individuals both within and outside the country to participate in research, breeding, and producing quality seeds, supplying them to meet production needs.

The Ministry of Agriculture and Rural Development shall direct and guide research institutions, universities, colleges, and specialized secondary schools in the agricultural and rural development sector, mobilize institutes and schools outside the sector to participate in research, seed creation, selection, and production; encourage and create conditions for organizations and individuals from all economic sectors to participate in seed selection, breeding, propagation, production, and supply; seek international cooperation on seed work.

Article 2. Provincial People's Committees under the Central Government shall have plans to build and reinforce existing plant seed, livestock breed, and forestry seedling facilities, encouraging all organizations and individuals to participate in seed propagation, production, and supply to meet production needs.

Investment and credit.

Article 3. 1. State budget (including public expenditure) shall invest in:

a) Scientific research on seeds: The Ministries of Agriculture and Rural Development, Planning and Investment, Science, Technology, and Environment shall plan investment for some scientific research institutes and universities specializing in agriculture and forestry to strengthen basic and applied research to quickly improve the level and efficiency of seed research. Investment should be made for the Agricultural Genetic Institute to develop into an Agricultural Biotechnology Institute.

b) Maintaining genetic resources (including cultivation and protection): Assign scientific research institutes to carry out the cultivation and maintenance of genetic resources, while the Ministry of Agriculture and Rural Development shall coordinate with the People's Committees of some provinces to plan and arrange a natural forest area (botanical garden) to maintain, protect, cultivate, and preserve the genetic resources of various plants and animals.

c) Producing original seeds, super original seeds, original seeds, and grandparent seeds;

d) Importing genetic resources and new breeds necessary to quickly absorb the world's scientific and technological achievements;

e) Local budgets shall support part of the production of high-tech seeds to enable poor farmers to have good seeds for production, provide incentives for artificial insemination of dairy cows and beef cattle.

2. Credit capital: Prioritize loans for commercial seed production by institutes, schools, and organizations and individuals from various economic sectors to produce seeds.

The Ministry of Science, Technology, and Environment shall prioritize loan capital for experimental projects to implement this seed program.

Investment in developing plant seeds, livestock breeds, and forestry seedlings must have specific projects and be approved by competent authorities according to current investment management regulations.

Article 4. Based on the project approved by competent authorities, the Ministry of Finance and the Ministry of Planning and Investment shall balance annual capital plans to ensure sufficient funds for each project according to the approved plan and investment schedule.

The Ministry of Science, Technology, and Environment shall soon submit to the Government a policy on copyright for seeds in the direction that scientific products must become commodities; the State shall purchase copyrights for basic research products and seed types produced for social benefits; for copyrights of other seeds, reasonable benefits for seed scientists and seed traders must be resolved.

Article 5. The Ministry of Finance shall study and compile reports to the Government for submission to the National Assembly to amend and supplement the agricultural land use tax in the direction that for research and production facilities of plant seeds, livestock breeds, and forestry seedlings, the tax rate shall be 0%.

Article 6The Ministry of Agriculture and Rural Development shall plan and implement training programs for technical cadres, especially leading scientific cadres in seed work (including overseas training). Agricultural and forestry extension programs must strengthen training and popularize knowledge about seed work for farmers so they can participate in this program.

Article 7. Coordinate with provincial People's Committees to effectively implement state management of plant seeds and livestock breeds as stipulated in Decree No. 07/CP dated February 5, 1996 of the Government on the management of plant seeds and Decree No. 14/CP dated March 19, 1996 of the Government on the management of livestock breeds, primarily issuing certificates of seed quality, business licenses, inspection, and supervision of seed production and business activities. Regulations shall link the responsibility for seed quality of seed traders to users.

Cooperate with the People's Committees of provinces and centrally governed cities to effectively implement the state management content regarding crop seeds and livestock breeds as prescribed in Decree No. 07/CP dated February 5, 1996 of the Government on seed management for crops and Decree No. 14/CP dated March 19, 1996 of the Government on seed management for livestock, primarily issuing certificates of quality for seeds, business licenses, inspecting, and supervising the production and business activities of seeds. Establish regulations to hold business operators responsible for the quality of seeds used by users.

Article 8. THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.

Article 9. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, and Chairpersons of provincial People's Committees and municipal People's Committees directly under the Central Government are responsible for enforcing this Decision./.
