THE MINISTER OF TRANSPORTATION
Pursuant to Article 58 of the Vietnam Maritime Code dated June 30, 1990;
Pursuant to Decree No. 22/CP dated March 22, 1994 of the Government on the tasks, powers, responsibilities for state management and organizational structure of the Ministry of Transport;
Pursuant to the opinion of the People's Committee of Quảng Ngãi Province at Official Document No. 785/UB dated June 4, 2002;
Considering the proposal of the Director of the Legal and Transportation Department and the Director General of the Vietnam Maritime Administration;
DECISION:
Article 1: Now promulgating the waters of the seaports within the jurisdiction of Quảng Ngãi Province including:
1. The waters before the Dung Quất, Sa Kỳ port wharf.
2. The waters of the maritime channels, pilotage areas, quarantine areas, anchorage areas, transshipment areas, and storm shelters in the Dung Quất, Sa Kỳ seaport area.
3. The waters before the wharf and anchorage, transshipment, and storm shelter areas will be promulgated according to the provisions of the law.
Article 2: The scope of the waters of the seaports within the jurisdiction of Quảng Ngãi Province is measured based on the highest tidal water level and is defined as follows:
1. The Dung Quất Port Area;
a) The seaward boundary: Limited by straight lines connecting points DQ1, DQ2, DQ3, DQ4 with the following coordinates:
- DQ1. 15023’42” N; 108044’24” E
- DQ2. 15027’30” N; 108044’24” E
- DQ3. 15027’30” N; 108047’42” E
- DQ4. 15025’30” N; 108047’42” E (eastern tip of Van Ca Point).
b) The landward boundary: From point DQ4 (Van Ca Point) running along the coast westward, then southward, through the Trà Bồng River mouth to point DQ1.
2. The Sa Kỳ Port Area:
a) The seaward boundary: Defined by straight lines connecting points SK1, SK2, SK3, SK4 with the following coordinates:
- SK1. 15012’36” N; 108055’28” E
- SK2. 15012’36” N; 108056’06” E
- SK3. 15011’36” N; 108056’06” E
- SK4. 15012’00” N; 108054’48” E
b) The landward boundary: From points SK1, SK4 running towards the Sa Kỳ River mouth, then following both banks of the Sa Kỳ River, continuing to both banks of the Châu Me River and Bài Ca River:
- From both banks of the Châu Me River running along to the straight line intersecting the river, parallel and 100 meters downstream from the Tân Đức sluice gate.
- From both banks of the Bài Ca River running along to the straight line intersecting the river at points BC1, BC2 with the following coordinates:
+ BC1. 15012’42” N; 108054’00” E
+ BC2. 15013’06” N; 108054’00” E
Article 3: The pilotage, quarantine, anchorage, transshipment, and storm shelter areas for vessels entering the seaports within the jurisdiction of Quảng Ngãi Province are defined as follows:
1. The Dung Quất Port Area:
a) Pilotage and quarantine area: Defined by a circular area with a radius of 01 nautical mile, centered at the coordinates: 15026’30” N; 108045’30” E
b) Anchorage, transshipment, and storm shelter area: Defined by the waters specified in Clause 1, Article 2 of this Decision.
2. The Sa Kỳ Port Area:
a) Pilotage and quarantine area: Defined by a circular area with a radius of 0.3 nautical miles, centered at the coordinates: 15012’18” N; 108055’42” E
b) Anchorage, transshipment, and storm shelter area: Defined by the waters specified in Clause 2, Article 2 of this Decision.
Article 4:
1. The Quảng Ngãi Port Authority shall be responsible for performing its duties and powers as prescribed by the Vietnam Maritime Code and related legal documents for all maritime activities in the waters of the seaports within the jurisdiction of Quảng Ngãi Province.
2. The Quảng Ngãi Port Authority, based on actual conditions regarding weather, waves, draft, and vessel tonnage, shall designate specific locations for vessels to anchor, transship, and seek shelter from storms in the waters specified in point b of Clause 1 and point b of Clause 2, Article 3 of this Decision, ensuring maritime safety and environmental hygiene.
Article 5: Outside the waters defined in Articles 2 and 3 of this Decision, the Quảng Ngãi Port Authority also has the responsibility for state management of maritime order and safety in the sea areas within the jurisdiction of Quảng Ngãi Province.
Article 6: THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER THE DATE OF SIGNATURE.
Article 7: The Heads of the Ministries' Offices, Directors of Departments under the Ministries, Directors General of the Vietnam Maritime Administration, Directors General of the Vietnam Inland Waterways Administration, Directors of the Quảng Ngãi Provincial Department of Transport, Directors of the Quảng Ngãi Port Authority, Heads of relevant agencies, units, and individuals are responsible for implementing this Decision./.
